    I read through the bill but don't quite understand...if I am working for a client on H1B, will I need to stop working as soon as this bill takes effect? or it only applies to newly applied H1B's (or extension/transfer)?

    We need active participation from members for the action item listed on this thread. CHC member are taking a very hard stand on the 3 bills introduced by Lofgren. If members (esp. constituents) don't call in large numbers and urge the CHC members to support the bills. The 3 bills may not even see the house floor. CHC members want only one immigration bill (CIR), nothing else is accepted.

    Please ask u'r friends and colleagues (who are constituents of CHC lawmakers) to participate in this crucial action item.

    I agree with all you folks that we should not just be happy and end our fight here after getting EAD etc...

    We should try to push it back to the government as why legal immigrants from india have only 9800 visa every year...its unjust for a country as big as india and havin so many hitech workers....

    On todays 7/18/07 NPR news, a USCIS spokesperson has mentioned that USCIS has made a note of the recent protests by legal immigrants(flowers and rally)....NPR also has mentioned this website also....it is a big achievement for us and we should pursue till the final step...check out the link below.....

    I got 6 months wait letter too. My wife (Dependent) for 60 days letter.
    EB2/TSC .
    I m lost as well!!!
    i filled up #7001 form and also E.mailed a follow up letter today.

    i had opened SR on 4th sept, same reply - case is preadjudicated and under review, wait for 6 months. my case is at TSC. i have taken infopass for 4th Nov to check again.

    I am not referring to the hypothetical scenarios and assumptions.

    I am talking about the real scenarios in past that were covered. Did you have the first hand experience of it being covered?

    I have bought it twice for my parents but did not use it (thank god). Yes that's a hypothetical scenario but I went through the policy fine print. At least it offers to cover some part of preexisting conditions which other plans do not.

    I agree .. no risk no reward!

    I'm itching to finish my 6 months on EAD to change job..

    Using H1B makes one safe. but how many years we want to do the safe job. If I-485 gets denied do u have enough patiences to file another green card. One thing is believe is "We are here to make money, most of us are in our thirties and we have short time remaining to reach our goals. I think we all have one year EAD. wait for 6 months then go on job hopping, learn whatever you can, get into whatever you want. Start a business, do something.... Anything you do will help you in future. Sitting with H1B in pocket may take 4 years cream of your life.
    If you have the talent you can get great salaries anywhere in the world. Because of your talents and hard work you guys are here. World is not small.

    I partially disagree with your analysis on markets in India. Icici and SBI are facing the problem of defaulters these days. Banks there have mimicked the model in United States and there are amny loans that had less than 10% downpayment.
    I can tell you in Hyderabad that many flats in and around madhapur are upwards of 45 lakhs.
    These prices will fall given the number of flats still unsold. There are amny unsold houses worth above 1 Cr and they are gonna come down.

    You have to understand how the market in India operates versus how it is run in developed countries especially in USA. I don't know if you noticed, but all the property transactions are conducted on credit in USA with minimum persnal contribution ( i.e. down payement). And now in hindsight, we all can understand how this practise was reason for bubble-brust. As an interested home-owner looking for houses currently, I have first hand experience. I say that beacuse people out-bidding me, even in todays market conditions, are putting down zero amount in down payment and in-turn even financing closing costs. So when you have minimal of personal equity at stake, it bothers you least to take risks on other peoples ( say banks) money.

    Now lets go to India, and I will stick to North-India, as that's where I have first hand expereience from. Go and talk to any property dealer and enquiry about properties. Wait for few weeks and return to find the rates have gone up. Well lets assume, you agreed upon the sale price and are now ready to conduct transaction. The property dealer is not going to ask you for SS number to check credit wortheness, but rather will ask for cash amount. You pay cash, you have the papers else don't waste time. So with business model, their is little risk involved and hence property business in North-India remains sizzling hot.

    If you can afford you must buy piece of land in North India. ALthough maintaining it always remains challange as their are no laws protecting you from Rich-Police-Politician gangs.

    Guys

    Don't fight for Eb2 vs Eb3 or Eb2 vs Eb1 etc. If we focus on these 3 bills then it will solve all our problems.

    (1) STEM bill remove all MS + Phd people so Eb2 will be half empty and Eb1 will be 80 % empty.

    (2) Re capture will bring new visas where they will go certaily to Eb3. ( Eb1 and Eb2 do not need visa if passes STEM bill )

    (3) No Country cap limit. Will clean Huge line of Eb3 india, China , Phili..

    Lets focus on 3 bills. We donot have time. Every one make a call to lawmakers. PLEASE.

    The "per-country limit" is definitely unfair within the realm of employment-based immigration due to the outdated and irrelevant law which needs reform. However skewing this to make it a civil rights issue is pushing it a bit too much.

    So coming back to Immigration (which is what, I believe, we are discussing), below is what I came across on congress.gov.

    The Supreme Court has ruled that the Congressional power to regulate naturalization, from Article 1, Section 8, includes the power to regulate immigration (see, for example, Hampton v. Mow Sun Wong, 426 U.S. 88 [1976]

    In other words, the Constitution does not specifically mention immigration but based on the above, delegates power to the Congress to pass laws to regulate immigration. This Article of the Constitution also clarifies the part about rules for immigrants and quotas being set at the Federal level and not State level.

    The above is a fact, not my opinion. Therefore, No - I do not agree that your reasoning has any direct parallel to our case since the correct approach and reasoning involves challenging a Supreme Court Ruling on Article 1 of the Constitution, which you would agree is next to impossible.

    Do you agree that we can draw a direct parallel of this case to our case, where they are segregating visa numbers based on the country of origin?

    Consider a scenario:

    One goes back to native country, Europe or somewhere else while GC is in process.

    Comes back after one year with new organization and files for new labor, I-140 etc.

    Will the person have his / her PD from the previous labor / I-140?

    May be I am talking something stupid, but just came to my mind.

    The company I work in is a medium sized business organization. My boss is a staunch republican. I hope to make him aware of these 2 bills and request him to write to the locol congressman and the senator. If we can all do the same then we can buil substantial momentum towards getting these 2 bills passed. Since most of the businesses have republican leanings and at some time have contributed towards the GOP in some way, their endorsements can have a major impact.

    Well per=country limit is part of the iNS law. So its legal.
    From an immigration perspective, green card is a privelege extended to "aliens" and it is the prerogative of the law to ensure a formula thats best for the country.
    INS family based immigration law was the one that conjured up the per-country limit to prevent folks from one country from flooding in. Unfortunately, this formula made its way into EB immigration and we are stuck with the consequences today.
    So if anything, we should bring up the fallacies in per-country limit as far as skill-based immigration is concerned and get the law changed.
    A lawsuit isnt the answer to everything. The chinese EB folks learnt that after spending thousands of dollars and few years on their lawsuit, the judgement they got back was that 'the law is being followed'.
    And the comment below about the constitution forbiding anything, with respect to immigration law, is pure nonsense.

    1. Constitution overrules any law and has the power to render any law invalid. No nonsense here (which means all that you said about INS,INA etc etc is nonsense)
    2. The last para is just your OPINION, so I let it pass

    I have been a member for a while now and have seen the benefits of IV. I've also seen a lot of back and forth in various thrreads betweeen various members in various issues and subjects. Before any one starts checking if I have contributed, let me assure you I have ....for the DC rally. Why? because deep down I believe in this org. No one forced me to contribute, no one asked me to have to come to this or that meeting. I live in Wisconsin but have not been able to attend any sub commitee meetings In Milwaukee because of circumstances both personal and official. I need not explain to anyone in more detail. What I mean by this is we need to set our boundries of expectations. How much do we practically expect out of members and how much can be done by a much more core group. Someone who RSVP but dont turn up should technically be a non issue, its definetly bad for the organizer and the core group, but are we hear to teach people courtesy? Its an intangible expectation. When we set this level of expectation lower, we will strain oursleves to a lesser extent. The bottom line is human behaviour and circumstances that model that behaviour and any other external circumstances cannot be changed.

    I second any idea that keeps membership open and does not restrict access if one has not paid. However in order for any legislation to happen we all know that $$ is the bottom line. So when ever we need it, we must raise as much as we can. We have to let people come to the web site browse and leave at their will. Restricting access is like closing doors and no popular internet model works like this. Take google, yahoo, hotmail, everythign is still free and has been free and is the most popular. Open source is also more popular than paid software. We have a majority of members who log in from the office or home, and we have to let these people in. Our successes should inspire people (it inspired me) to pay. I will contribute again and also join my state chapter very soon, but my only gripe is when we have emotional members who role play people and call other people names. We dont need to go there.If we are arguing over the internet like this how long will it take us to break into a fight in a state chapter meeting?

    Take the anology of our freedom struggle. Did the british grant freedom only to freedom fighters ? How many so called *fence sitters* did we have then? Eventually everyone got freedom. How did we raise money to have morchas and satyagrahas? All that needed money, time and sacrifice too..I dont want to go too deep into this analogy as it is just an example and may not be entirely 100% perfect for the scenario we are in, but its close.

    P.S The opinion I have expressed is entirely mine. I have no personal gripes against any one person and have not taken any names. If you dont like what I posted ignore it. Its freedom to express ourselves that will get us to where we need to.

    We may be angry, but let us not use bad word for him. He is doing his job and earning his bread and butter! I have heard him using very strong language against government and administration - I don't think he is against anything but he has to do certain things to maintain the popularity of his show among middle class Americans (after all it is all business!).

    Q-1 (07//19/2007): I filed I-485 application on July 2, 2007, but have yet to receive either rejection or receipt notice. Will this application be fee'd in under the reversal of the USCIS decision?

    A-1: The DOS withdrew any changes to the original July VB and assumedly visa number is current in July 2007 for any categories other than "other worker." Accordingly, the 485 application which you submitted on July 2 cannot be rejected by the USCIS at this point. The USCIS is likely to fee in your application and soon issue the Receipt Notice.
