Do they ask me regarding this at the POE? In what forms do I have to fill the info? I am not sure, as one of you suggested, if they ask we will tell them. But does this record appear in their computer screen and if we did not mention to them, will it be treated as another crime?

If not expunged, it will FOR SURE pop up immediately they punch your name in. You certainly can not lie there. You will be deported. If expunged, you still have chance BUT NOT to lie..If the form ask " If you have ever been arrested" say yes and as others suggested have all your documents ready from court but make sure you have all originals and notarized documents if required for all court orders pertaing to your case.

Experiences of friends says - blue collar, jobs that Canadian do not want to do you, you are more than welcome.
But dont ever try to get a White collar job... And if you want to - work as Software engineer - and forget of any career development....

My company has offices in both canada(toronto and vancouver) and US .. i have worked for extended periods of time in canada. I agree that career development oppourtunities are limited due to economic reasons, but I there is no way toronto or vancouver can be considered "racist". And talking of high skilled workers, who said there is absolutely no discrimination in the US ? Isnt that what programmers guild and other labor unions are all about ? how come so many people support the blue collar illegal aliens (mostly meat-packers and lettuce pickers), but nobody cares about us, tax-paying, law-abiding highly skilled people ?
The difference is at least the canadian immigration policy doesnt institutionalize the discrimination by making us wait in limbo forever, unlike the US laws. At the end of the day, I would rather live with "limited career development" opportunity in canada and change employers at will than be surrounded by plenty of such opportunity but have my hands tied behind my back by the US laws.
As for "discrimination", we as immigrants always will have to bear with some discrimination,subtle or overt, from the native-born white collar workers whether in the US or anywhere else in the developed world. Our home country is the only one where you can expect to go and join the workforce without discrimination.

First of all, please be decent to each other. Now, to the PBEC issue - this is a major problem, and a huge issue for all of us. Currently, the debate in Senate/Congress is centered around Immigration reform and this is a definitely a good time to raise these issues.
There are a few things we should strive for:
1. Keep all provisions of Specter's bill related to EB.
2. Re-instate per country soft limit.
If both of these provisions are passed, Priority dates for all countries will be current in EB2 and will rapidly move in EB3. A lot of folks in PBEC might be able to use PERM to apply another labor and priority dates will loose their importance, so it is important that these provisions pass.
This is just the kind of disingenuous logic we do not want. To suggest that folks stuck at PBEC should just file PERM is (a) just like asking people to drink coke instead of tackling water scarcity (b) reflective of the ignorance of the situation faced by many stuck at PBEC.
Note that IV has a stated goal of solving the BEC issue (6th listed goal on the homepage). The goal is not to make light of the BEC problem by using apparently simple but false logic; the goal is to resolve the BEC mess.
Do not try to play down what is important to others and hijack the agenda to suit your problems. We have all come together behind each of the stated goals of IV. Let's keep it that way.

Candidate leaves sponsoring employer and joins another employer (similar position/salary, etc.) New employer's attorneys send the AC21 letter and G-28 forms to the USCIS. The attorneys are very familiar with this, have handled lots of AC21 cases (Fragomen).
Is there any way the candidate can call USCIS customer service and ask for the attorney/representative's name on file, just to make sure that the G28 did get processed and the attorney name on file got changed from the old law firm to the new one? Would customer service share that information with the candidate?

Yes and no. It depends on the customer service representative or if you take infopass, it depends on the VO. You generally know when your Attorney files for G 28 because you actually sign the G 28. G 28 is like any other form like 485 or EAD or AP etc... so if your 485 and 140 and h1b everything gets filed properly why do you think g 28 does not get filed properly?
Try to be very pleasing and polite to a CS rep or a VO and try to get the info, they may let you know your Attorney on file.

it depends on the individual hospital... your downside is only your wife getting fired... which might not really happen unless your wife supplies 100 A grade nurses to the directly competing hospital across the street... if she does that, anyway she wont care for the job.... :-) all the best... let us know how it goes...

I am following from the start of the original post. This was a post by a new member who appears to create rift among the EB2 or EB3. The reason I believe is he just want to incite in such a way that few other folks will respond and keep the thread floating. Later few other posts by himself were created with different ids. just observe the trend and you will notice it.
So folks dont respond any more and this rift creation will die down.
I hope the admins keep this thread open and not kill it. I am not sure what the intentions of the OP ( some of you claimed that he wants to create a rift ), but this is definitely a valid concern for all the EB3(I) guys. This is a natural reaction to the frustrations of EB3(I) guys just like the mass upheaval during the July 2007 VB fiasco. Since it was across the board, there were no differences. Now since this involves only EB3(I), there is not much support from IV or others. But in my opinion, this is as much unfair as the Julay VB fiasco.
Some of the EB2(I) guys are worried that their GC dreams would get delayed if there is any Admin fix for EB3(I). For all those individuals in EB2(I) who want to oppose any kind of admin fix for EB3(I), I just want you to think about it. Is it really fair? There are individuals in EB3(I) waiting since 2001 - a total of 8+ years. Don't get me wrong - but some of the EB2(I) guys who have applied as late as 2006 and 2007 are expecting/hoping to get their GC this year if there is a spillover. And I think these are the individuals ( not all of the EB2 guys though ) who are opposing any kind of admin fix ( please dont yell at me or curse me etc...if you are not one among those mentioned, then please dont worry..this is not about you::) Ofcourse i would like each one of us to get GC as soon as possible) to EB3(I).
And I dont see why there will be a rift between EB2 and EB3 if each of us follows net etiquette in positng responses. Let's do some constuctive brainstoming - without getting into perosnal attacks or getting too emotional. Let's do what is right and not what each one of us thinks is right. Then I guess there wont be any rifts. The only thing I am asking is to get EB3(I) to advnace a little bit. I am not asking for it be on par with EB2(I). I hope some of you see a point in my frustration::))

I know this world is not fair but how can anyone else try to divide us if we all stand united? Now that we have you, i am sure you would help in this effort by sending out emails yourself and also other members can join you to contact media. I wish we can all send multiple emails to every newspaper, every tv station and radio station in this country and apprise them of our cause. such letters urging news orgs to cover our issue will help us get much needed media attention and then something will DEFNITELY happen in the coming months.

Only Eb2+ 5 years of progressive work experience requires all the employment letters throughtout the 5 years. Am I accurate?

Best way to get more immigrants to participate in advocacy efforts by immigrationvoice.org for legal immigration is by communicating to international student organizations of various universities around virginia, maryland, washingtondc,west virginia north and south carolina. Arranging busses for the students is not a bad idea. Patriotism is depends upon individual thinking. My friend's uncle is a former army officer from India and he is in the USA for 35 years. Participated in 1971 war. But he didn't become US citizen. I asked why, he told me he took the oath to serve India and fight for her whenever there is a requirement. So he want to keep his oath. If he want to become US citizen he need to break the oath and take a oath to fight for USA, even if against India. He is not a RSS or VHP person. He is a christian (for your info).
So patriotism is not by speech or blogging from USA. It is by action. How many people help poor people in India ?. Most members here want to become US citizen. Only complaint is the delay. So love your counry of birth and love the country giving opportunities.
