    Folks I wish your suggestions would be helpful, but I have taken 3 infopass appointments, and to my badluck, everytime I visit I meet the same old-fat-lady who now happens to remember me, and says, "Didnt I tell you last time that blah blah blah ", believe me, she was not willing to even accept request to send interim ead , she gave some reason that NSC outsourced callcenter work to contractors who dont know what they are saying and send us to local office to request interim EAD. She says my FP for ead was done only in Nov(my 2nd infopass resulted in 2nd FP) so it will take 4-6 weeks after that to get EAD. Anyways I will take your advice for a 4th infopass next week.

    Print that USCIS memo (see page 1) and insist that they follow procedures outlined in the memo. They required to provide you a written notice that they followed the procedures. Do not leave until they give it to you in writing. If they refuse, ask for their names and write them down. Ask them for a written notice that they refuse to follow the procedures from the memo. Try to be polite, even though it is hard during infopass, I know :) I know how frustratiing it can be when you go for infopass appointments, but be persistent and talk to the supervisor.

    seems funny that we are suddenly discussing God in this topic. But Any of the arguments presented here definitely do not prove that God does not exist.

    As for praying. If merely praying would result in me getting results why should I even pray to get a GC, I would rather just pray that I never have to work and get all the needs of this life fulfilled without any effort. Why do I even care about a GC. And everyone would have started doing that.

    The idea is never that of praying but of faith. Believers can give you millions of cases when their faith resulted in a favorable result. Almost all religions alo say that the first step towards having faith is to perform your duties as well as you can. Without this, there is no point of praying. Coming to religions, most also have ways of redemption but there is no way to redeem for acts in the future as you are expected to do your best.

    You may or may not have faith in God, but logically it is difficult to argue one way or the other. There is a reason why even the greatest of all philosophers have not been able to come to a conclusion.

    To each his own.

    In its Response to the Ombudsman’s 2006 Annual Report recommendation (AR 2006 – 01), USCIS agreed in principle to provide a breakdown of all incomplete cases by the number of months pending and application type.

    Given the constraints of existing legacy case management systems, USCIS would today need to perform a cumbersome, labor intensive, recurring manual audit of all pending files in order to compile the suggested data. Such audits would be cost prohibitive.
    USCIS has opted not to use its limited financial resources to extract data from current systems and prefers to spend it on prospective systems that are years in the planning. For example, USCIS has not made corrections to the CLAIMS 3 system to capture data on applicants’ priority date information, country of nationality, and the preference category under which the application is filed that USCIS must review before the application is accepted for green card processing.
    Failing to correct the system annually results in hundreds, if not thousands, of wasted hours by all levels of USCIS leadership in trying to account for an often asked question by Congress, the Ombudsman, stakeholders, and others: “Exactly how many employment-based green card applications does the agency have pending?” USCIS still cannot answer that question today with certainty.

    This my personal take on it, I want a GC, i have been in this country for the past 8 years, landed in 2001 finished my masters and have been employed since then. Life is good here, well thats what i think, sometimes better than home (i still call, because i was born there), i am not dissatisfied with the money i am making, although i think i get underpaid (i work in southern calif as permanent employee).
    I came to this country so that i can survive in life, i.e. too much competition in India which means you need to really work hard to keep up with the competition (i am really lazy :D) , now with the fight for GC and all, added with the daily stress and chores, i am really thinking is the effort worth the reward, i keep getting this thoughts, i mean i am the only one with the thought that the effort/patience/sacrifice is not equal to the result ?.
    I really wonder if all this is worth it, the stress is just too much. Reading other's stories makes me laud their patience, i know my struggle has just started, kudos to others who are still holding on :)

    Now that Desi consultant companies are under scanner, i hope employees working for them get their long overdue justice.

    H1B has become synonym for visa abuse bcoz of these moron's. I hope the system comesout clean.


    Rather than targeting small H1 consulting companies...they have to target big IT firms with thousands of L1 visa. Thats bigger then the H1Bs...There is only 65K H1B per years. No one knows how many L1 visa they are issuing every year and there is no accountability.

    Also the wage is too low.

    True - that's exactly what the Adjudicating Officer told me today when I went in for the Interview :)......They want to avoid another July 2007.

    So, for efficiency, they are just pre-adjudicating some of the applications; so that, they don't get overwhelmed when dates move forward - they simply have to press the button for 'Card production ordered' message!

    In fact, the officer told me that he has 'approved' my application and will have to just wait for the dates to become current to get the actual plastic - also for fyi.....they can also deny the application instantly or request more evidence or call for a follow up interview. They actually give you a letter indicating what happened during the interview (it obviously doesn't say your application is approved - but it will explicitly say whether your application needs a follow up interview or additional evidence).





    Although officially so far, USCIS has not branded an I-485 status as "pre-adjudicated", if you haven't received any RFE and/or any other negative status about your 485, and if your case is outside the processing dates of the Service Center, then obviously dude your case is pre-adjudicated.

    I tend to believe that the offical status of being "pre-adjudicated" is coming soon. A few months back I read that USCIS is considering publishing another set of date known as "Qualifying Date" in their monthly visa bulletin. That date will define if you are "qualified" to file I-485. They will determine this date based on their workload. The idea behind is to avoid another July 2007 fiasco. They intend to process the 485's early rather than have you wait for your PD to become current. That way they will manage their workload efficiently and avoid visa wastage. They did indicate these applications to be pre-adjudicated then. I am guessing the official status of "pre-adjudicated" on your 485 application is coming soon.

    Yes, you are right....he did indeed use "passive resisitance" in South Africa. We all learned about it in school and I can remember the idea making a HUGE impact on me as a kid.

    singhsa3 I absolutely agree with you. Undeserving people like GooblyWoobly will be benefited by active members hard work. And the disheartening part is these people will take the benefit and on top of that shamelessly show their ungratefulness on this forum :mad:

    I fully resonate with gc_chahiye;169769 . People like GooblyWoobly are good for nothing. They have no right to pick on one of our distinguish ,well respected and an active member. The Rally have been quite successful and have made people think about our issue.
    Unfortunately, people like GooblyWoobly will also be benefited by the hard work of people like Franklin.

    I have purchased 4 firearms during my nonimmigrant status, including a handgun. Nonimmigrants can generally not own firearms in the US. Though, there is an exception to the law if you possess a valid hunting license and have resided in the US for more than 90 days. I took a hunting class, which was a prerequisite for the hunting license and also had very good firearm safety information.

    For long-guns, you will need some paperwork before you go to the gunshop (utility bills from at least last 90 days, hunting license, Driver's license, your I-94 number). The background check will probably be delayed a day or two while FBI checks your immigration status. Your gun seller will call you when they get the ok.

    For handguns, there may be additional paperwork. I had to apply for handgun permits with the local sheriff's office. The person you first deal with will probably be unaware of the exception for individuals with hunting licenses. You will probably need to take a copy of the law (ICE has a pamphlet on firearm laws for nonimmigrants, take a copy with you) and talk to a supervisor. Once you get the permit you take the permit and your DL to the gun seller plus all the paperwork I listed for long gun purchase. Let me know if you have additional questions. Good luck.


    I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.

    I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.

    If there is unity, and all of us walk out with all our money, this would definitely get the attention of the lawmakers.

    I suggested the same action last year. Right now, waiting for 485 (EB 2 LC took close to 6 years) - but I feel if 20-30K of us left (and take our money with us too, don't leave it here to work for this country) because we are being screwed by the stupid immigration laws, that will have a bigger impact in changing the laws than any lobbying effort possibly would.

    I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.

    I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

    Congratulations to Shimul99. Good for him.

    Did he have a aging out kid who filed for 485 along with him. I have heard thoses cases get prioritized.

    In any case, I am happy for him.

    A bank wire from any bank in India is the simplest and cheapest way for you if you don;t have or need an nre/nro a/c. The limit has or is being raised to $200,000 from $100,000.

    Also for tax purposes in USA, you can get a gift of $200,000 from your parents and upto $12000 anually from other people without a tax incident up here.(completely unrelated info to your current wire)
    Also u can wire from any bank in India.

    I don't think there is any tax liability if you get the money from India to USA. So it should not matter if you get the money from India as a gift or from your local savings account in India. Is it correct ?
