I want to take this opportunity to introduce you to this new effort taken up by a group of people badly hit by the immigration delays or we can say immigration black out in U.S..
http://www.immigrationvoice.org is a banner under which we are getting together to
1) Find solution to employment based greed card retrogression
2) Labor delay in the backlog centers.
All the members of this non-profit organization are facing severe problems due to these issues. We have started the awareness drive and professional strategic help (lobbying) efforts have started for the new Comprehensive immigration reform bill due on the floor of the Senate and House in Spring of-06. To make a difference and to have the new law passed in the way the current visa retrogression & Backlog center delays cane be addresssed with the new bill, I would request you to please spread this message or forward the email to as many people as possible.

Not sure why you would generalize all H1b holders as experiencing hell - I for one did not. Anyways if you take the time to browse the forums you will find the answer to your question.
Malibuguy007 , you seem to me a guy who could save 2-3000 dollars per month and think you are in heaven(Typical GULTI mentality) . These are the points on basis of which i called life of H1 hell
1. Your spouse can't work . Think about their self esteem and self respect they are loosing.
2. You don't know about your future if tomorrow you loose your job , you will be kicked from this country.
Tell me what is hell then ? Don't think its just about counting dollars , think about your life stability and about your family members too. Try to come out of Sambhar-Rice world(thats the way you save money here and call US heaven). Live with pride ,ok . Fight for being treated like H1 ( HIGHLY SKILLED PROFESSIONAL) not slaves.
I hope now you feel we are in hell.
PS : I work with one of best semiconductor companies in world and earn decent salary .

Ideally you would like her to come to states at least for 2-3 business days to get court marriage and filing of docs, but if thats not the case then this is your best option.

If they don't approve, then, I can add her into AOS when my PD gets current again assuming I don't file for EAD (I won't - I like my employer for now).

I guess the polling on PD basis is futile it will give people false hope....
Only folks with ND prior to current processing times can expect to have a chance at appoval...I see many people over here beyond the processing date window and are still hoping to get approved....
Let's see if this theory is right or not come september.....if only my lawyer had mentioned that ND over rides PD I'd have forced him to file on July 2nd and not wait till July end....

does this mean that i cannot get a 3 yr extension based on approved I-140 pp? My labor is not pending for 365 days and so I am solely depending on I-140 approval for a 3 yr extension. I am filing i-140 and i-485 concurrently before July 5...will this give me an EAD option even if 140 takes longer to get approved?
This only applies to pending or new 140s; if you have a approved 140 it does not affect you.
One could get a 3 year extension on the basis of a approved 140 only if the PD is not current; since the PD will be current starting July, you'll get only a 1 year extension.

If you were not told the correct bill rate, you can recover that money. Simply ask them in writing to show you the contract since you are on 70/30 basis. The written contracts, oral contracts, emails all stand in the court but how will you prove an oral contract? If you have found an offer that meets your expectations just quit. We all make the same mistakes. We spend our time on working out things where they are not working. Just "quietly" without your employer getting a hint, find a job and quit.

It is easy to get carried away saying that the employer is blood sucker etc. But very clearly, you should know that there can't be these kinds of contracts on H1. The employer knows that people who go to them are on thin ice, and so does the employee (employer is there to do business -- he is not running charity).
Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.
To top it, OP goes on an offensive when people point of the bitter truth to him. This site should not promote illegal behavior, anybody seeking advise on these topics should be severely castigated, because they broke the law too (and they know it, just dont want to admit it). Or maybe we should encourage these people to report to DoL so that all of them can be punished for misusing the laws.

Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.
What are your thoughts, is it worth filing in EB2?

Unfortunately, I can't leave the US for the following reasons
a) AOS pending
b) H1 expiring soon
c) Won't get any vacation time as just joined a new job.
If you have applied for AOS in July 07, you probably would have got your EAD by now. Why dont you use your EAD to get a DL renewed?
