    Can we each leave a 'personalized note' on how much we have contributed in Federal / State / Social Security taxes + Medicare / etc.???? Even a rough order estimate... to get them to listen to us seriously.

    Is this something that IV can help co-ordinate?
    1. State-wise, collect estimates of taxes paid till date
    2. Collect the data (anonymously, of course) and send a written brief to each Senator in that state - making a clear economic case to how we contribute
    3. Collect the data (nationally, with statistical analysis thrown in) and send a written brief to all Senators - making a case at a national level.

    We need eye-popping numbers, charts and quotes ... to continue the PR around high skilled immigrant needs.

    Thoughts?

    It is a good idea to collect the data. However, the collected data will be a small part of the actual numbers. So it may underestimate the actual data.

    Rather than spending time collecting such information, lets focus on calling right now.

    Yes, that is right, I said �plight of EB2-India�.

    I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

    Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

    Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

    There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

    All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

    For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

    I feel education should be rewarded (Every where). High skilled should get prefference.

    Oh my god...
    USCIS please let our spouses work and take as much time as you want to give us the green card we are not in a hurry!!!!

    How can anyone come up with these un realistic solutions man.
    True true true This persons intension is not a GC but make money...

    Please let us not go further into this, let us prepare ourselfs to fight for the I-485 provision that IV is working on..

    First off, i have mentioned above that this is NOT a solution to retrogression. Secondly, the USCIS does not care what we say to them, they are going to take exactly how much time they want to take to process our Green cards. All I was suggesting was, we ask for interim relief. Now like Logiclife mentioned we are trying for smaller bits of interim relief and that is a reasonable answer. However please do not make remarks like "this person is here to make money and is not after GC". Are we not all after making money? Is that not why we want GCs? We certainly dont want the GC to frame it and keep it next to our other trophies do we? Then why are people accusing me of wanting to "make money"? The problem with some people on this forum is the lack of respect for an alternate view. It is one thing to disagree and it is another to make ridiculous off topic remarks about what someone said.

    I wont get into EB2/EB3 fights, but tell you what my opinion about this is.

    The law definitely supports interfiling and priority date porting. However, this is like reserving seats on a bus by throwing your handkerchief in good old India. It is unfair to let people jump ahead in the queue, even though they acquired the eligibility to file in EB2, at a far later date.

    There might be some genuine cases where people could not file in EB2, even though they were eligible. I only support these cases.

    I've a pending EB2 485. However, let me be honest. If I had EB3 to start with, I too would've interfiled in EB2 and would've ported my priority date. Who wouldn't do it if the law allowed them to!

    +1 to that.

    All,
    * Technically and Legally US is a corporation and federal-union not a country (union like UK, ussr, future-EU-federal-state etc). Even india is a union. not a country.
    * Your state/UT (DC, PR etc) will be your actual country. All states have their own state-constitution.

    Before commenting on the above two points, please take time to watch a great youtube video out there that explains the whole thing based on federal constitution. Search for “citizen 14th amendment” in youtube. When I get home, I will post the link.

    Some personal thoughts (not legal technically etc),
    * Your loyalty must be concentrated and focused on the state/UT (technically your country) you live. There was a great question asked to Kalam in his recent Seattle visit and his recent speech in WU campus kane hall. He says more than india, even NRI’s (indian citizens) must have loyalty primarily towards the local place they work and live (I assumed, specific to city/region, state/UT).
    * be a proud Californian, Texan Etc (ineffect state citizen first before federal or ancestral, ethnical, etc). In effect not indian-american.

    Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

    I wish everyone the best and hope they get GC very soon.

    Nobody is complaining because everybody has the attitude, "Let somebody else do it, I will reap the benefits". It it the like, "Why should I pay IV when everybody else is paying it; I should just get free advice".

    I & my colleague filed a complaint against our ex-employer early this year and the DOL W&H said they will work on our case in then next 3 months; they are currently working on cases filed in the last quarter of 2007. The reason why I filed a complaint was not because I need the money he owes me but because he exploits every employee and I wanted to bring him out in the open (will post the outcome once DOL does something about it).     The fact is, as long as the employer knows he can get away with shit they will continue to break rules. Now that ICE is cracking down on er's hiring illegal immigrants you will see that er's will stop hiring them. I think the reason why we cannot get our much deserved provisions passed in the house and congress is because of the fact that today lots of US Citizens and Green Card holders are loosing their job to the people who are illegally present in the U.S. I don't beleive in shit, "Employer's cannot find U.S. workers". The fact is that employer's are not willing to pay workers the wages they deserve. Imagine one hour of Federal wage today after taxes will only get you 1 gallon of gas.

    The employers are happier to hire illegals as they can pay them shit wages, they don't have to pay er's contribution of social security wages, no er's contribution of state taxes, no Medicare tax, no workers compensation. Just imagine wont we be annoyed if we can't find a job in India because Nepali or Bangladeshi (no disrespect to these countries) illegal migrants are talking our jobs away from us by working for lower wages.

    Sorry for all this rant; I am tired of waiting for GC for the last eight years and am tired of people sitting on their dump xxx hoping somebody will fight for their cause and they will get to reap the benefit. As to somebody's comment about India being a colony for 150 years, do you think it would have happened if everybody had revolted one fine day (every single human being) against the Britishers? I guess everybody must be thinking, why should I get by axx kicked when my neighbour is doing it for me.

    not sure how to do this. can some one in this thread create a poll just for eb3-India just to see a ball park number of people waiting in eb3 india and for how long they are waiting (may be we can start from jan 2001 all the way till jun 2008). This atleast would give us an idea of how many IVers are waiting in eb3 queue..pls discard if you did not like this idea. thanks.

    NYSE:GLD : SPDR Gold Trust holds physical gold
    NYSE:SLV : iShares Silver Trust, the assets consist primarily of silver held by the custodian on behalf of the Trust.

    SLV profile in yahoo mentions it tries to hold instruments to match SLV performance.
    GLD claims physical gold holding in their profile. There is not holding detail on yahoo finance.
    It will be interesting to dig into their actual portfolio holdings. But I agree that these are probably the closest instruments on gold and silver price play.

    I did paid consultation to find answer to this question with murthy office. As per them, one can do transfer and extension of H1B even after using AP as long as the current I-797 is still valid.

    You mean a future employer can transfer and extend my H1 even after I entered on AP, right ?

    That would be great news. But on this very forum I did read some posts which mentioned this wasn't possible.

    NEW YORK -- By now the shipping container carrying Jonathan Langan's material life in the United States has arrived in Ireland. The plush green furniture, his American flag and the construction tools of his trade are all gone from his Queens apartment.

    Langan, a lanky, red-haired Irishman, was bidding a final farewell to his adopted country. He didn't leave for want of work -- his fledgling construction company was booming. Success was his problem. The more prosperous his company became, the more Langan feared he would get snared by immigration agents.

    "You don't want to give off red flags because you're not supposed to be working," said Langan, 24, who lived illegally in the United States for three years. "It's too dangerous, what happens if you get caught."

    The green is draining out of the Irish immigration boom that revitalized neighborhoods across New York over the past two decades. Fear of getting caught in a post-Sept. 11 net coupled with the booming economy in Ireland is drawing thousands of Irish back to the Emerald Isle. Numbers vary on how many have left: The Irish government estimates that about 14,000 Irish returned from the United States since 2001, with more than half of them coming from New York. The Census Bureau reported that between 2000 and 2004, the Irish population throughout the United States shrank by 28,500 people, to 128,000.

    A more vivid picture of the exodus is the Gaelic downtown of the northern Bronx, on the border with Yonkers, where green signs and shamrocks decorate store windows.

    The Padded Wagon, a popular moving company among the Irish, shipped 30 containers to Ireland in the past three months, each containing the possessions of an Irish family. The Irish games -- Gaelic football and hurling -- have suffered losses. More than 200 players returned to Ireland in the past year, said Seamus Dooley, president of the Gaelic Athletic Association, which has its games at Gaelic Park in the Bronx.

    Last month, the Irish minister for social affairs visited New York, to unveil "Returning to Ireland," a guide for Irish preparing for a permanent return trip.

    "A travel agent was saying they had sold 1,700 one-way tickets to Ireland," said Geraldine McNabb, an Irish-born naturalized citizen, while she sipped a cranberry cocktail at a pub. "They're not coming back."

    Post-Sept. 11 security procedures have disrupted life for the city's undocumented Irish, who number about 20,000, according to estimates by Irish officials and activists. Few experience immigration raids in their homes and job sites. In 2005 just 43 Irish nationals were deported from the United States, none from the New York area, according to U.S. immigration officials.

    But federal and state policy changes, the fingerprinting of foreign nationals at airports and a crackdown on driver's licenses have made it much more difficult to hop a plane to visit relatives or drive a car. And tighter scrutiny of banking transactions to prevent the financing of terrorism has scared off families and made starting a business far more dicey.

    "What's more alarming to me is people who've been here for years and years are packing up. Families are moving," said Nollaig Cleary, president of the women's division of the New York Gaelic Athletic Association. "You've had the community people who set up business and their families, they're going."

    Brenda Flannagan, 31, immigrated illegally to the United States in her twenties, looking for adventure. Now she has a husband and a baby, and is looking to settle down. A trip back to Ireland to visit her parents could leave her open to discovery by immigration officials -- so she is going home for good.

    Raising a child will only compound her difficulties here. "You can't drive. It will get more difficult," said Flannagan, who expects to leave in the fall. "Things like play dates and after-school activities."

    With fewer immigrants pouring in, and so many Irish packing up, pub talk revolves around the question of the survival of the Irish spirit in New York. Irish immigrants poured in by the hundreds of thousands in the 19th century and again in the early 20th century.

    A third wave came in the 1980s when the Irish economy tanked, and it rejuvenated Irish culture in New York, as politically inspired Irish rock and hip-hop bands worked the club scene, and Irish theater and poetry spread throughout the city.

    "You have a great Irish neighborhood beginning to crumble," said Niall O'Dowd, publisher of the Irish Voice and chairman of the newly formed Irish Lobby for Immigration Reform. "Unfortunately Americans are mixing up terrorism and immigration."

    The Irish, however, retain considerable political clout. Fifteen years ago, they successfully lobbied Congress to direct tens of thousands of green cards into the hands of undocumented Irish.

    O'Dowd and other activists recently rallied the fighting Irish spirits at Rory Dolan's pub in Yonkers, as they begin lobbying for an immigration reform that includes a path to citizenship.

    The Irish government contributed 30,000 euros, ($40,000 at today's rate) to the effort. Tim O'Connor, Ireland's consul general in New York, stresses that the United States played a vital role in helping to stimulate Ireland's economic boom with investments.
    "It's in the interest of both countries that we have people who have the ability to go back and forth between both countries," said O'Connor, noting that 15 percent of new businesses in Ireland were built by returning Irish.

    Some Irish take their leave with optimism, looking to the jobs and construction boom in their homeland.

    "Everything is so good in Ireland," said Flannagan, while her husband, John, a carpenter, was at the pub enjoying "a few sociables." "There's a lot of construction work for the guys."

    Flannagan held her baby girl, a U.S. citizen and last link to the United States. "Maybe she can sponsor us when she's 21," she said. Then, she added, "I think the notion of coming back, by then, will be gone."

    Nice post, containing real facts.

    You are purely thinking about your perspective and neglecting the purpose of GC for the country.
    To qualify in EB1/Eb2/EB3 depends on some factors:

    EB1: Extra ordinary candidate, may or may not be represented by employer
    EB2: Senior Level: Job duties have to justify need for advance degree candidate (or BS + 5yrs exp) and then candidate must qualify too
    EB3: 16 years of education (ideally) with degree in related field (lets talk IT for now)

    Now current status and its cause:

    EB1: - No jumping, no gaming system : Hence NO DELAYS

    EB2: - Good chunk with genuine apps, some gaming system where applicant qualify but not the job, some gaming system and taking very high risk by showing BS +5 yrs (they actually don't have +5 factor), other jumping the category (legally :D) but taking very high risk for RFE

    Result: Got retrogressed

    EB3: Good chunk with genuine apps, some unfortunate ppl who do qualify but job doesn't support experience or higher pay, lot of gaming system with BS (3yr) in non Computer/IT and showing 1yr certifications etc, and everybody who does not qualify for EB1/EB2, lot of nurses (I heard someone said nurses in back)
    Result: Severely retrogressed with no hopes in horizon

    Now lets look at market demand ( we know supply of apps is pretty darn good)
    EB 1: Very very high : general pay range starts from $250k+ and goes up to $400k for fresher (PHDs) and in upper $150k for Int'l Managers

    EB 2:: High, general pay starts high $80k and goes somewhere $140k+,

    EB 3:: good, starts from upper $40k and goes somewhere $65-70k, (lots of job and lots of applicant)

    Now lets take a look at Supply of Apps (Assumption 1M apps already in system):
    EB1: say 50K (5%) - (fast processing - Express lane)
    EB2: may be 200K (20%) - (sounds good on paper but in realty slow but moving)
    EB3: everything else (75%) (OMG :eek: stampede : frustration with no visible progress)

    Now lets checkout preference:
    Preference from perspective of country, what benefits country the most:

    EB1: ohh : lets get them in ASAP
    EB2: yes yes we welcome you please come in (after some long wait)
    EB3: OMG its flood of ppl, use extra strong flood gate and keep them out as long as possible, and let them in with very low rate


    Now This:
    Like everything in the world, the fewer the qty the hotter the product,
    the abundance kills the market, applies perfectly with EB2, in 2000-2001 it used to take 12-24 months and you have GC in hand, and now .. may be by my kids turns 16yrs, and EB3: 2000-2001 use to take about 3 yrs and but right then we started getting flood, and thanks to 200K H1bs in 2001-2.

    End of the day EB1/EB2/EB3 all are immigrant and are victim of broken system (I�m sure EB1 disagree here with me because they enjoy express lanes), it need fix but is it high priority for law makers or we just think it is?
    how desperate we are to provide help? or we are just good at reading/writing here and using IV and other forums for venting out? ask yourself

    The list goes on and my analysis goes on, but these are just my thoughts thinking out loud,
    and trying to think for a solution.... Next thought -> Solution, I will post in coming days

    When I called Lucille Raybal Allard's office last week, a rep from the office had an extensive conversation with me about both the bills and they have not heard about them before. He recognized me when I called him back to check if they made a decision.

    Alright Folks, Let us not get distracted. We have lots of work to do.

    Money is important and has its place in the process. Grass roots effort is also important. What would you tell if some one asks which eye is more important to you? left or right? If this Q was a stretch, ignore it. I just used it to tell that $$ and grass roots efforts are important

    Money does not get every thing done. Corp America is doing everything they can to get H1B numbers increased. Do you think they are being stingy with the money they need to spend? They have stronger opposing grass roots groups like Numbers USA, FAIR etc. Our issue is a lot less volatile compared to the H1B increase issue. How ever our issue is unknown to many lawmakers until recently. I am positive that some members came to know about the bills when we called them or have been approached by our state chapters.

    You are right in that the donation would go towards the core IV funds. But if we resort to writing personal checks and What if it is short of the amount he spent ? Should he wait for months if not years to realize the amount he spent ? I think they should be compensated immediately from the core IV funds.
