    Hello all,
    not sure if this topic has been touched before; if we have a i-485 application filed; do we qualify as:
    1) non-permanent resident aliens
    OR
    2) non-resident aliens?

    Filing I-485 makes you an 'adjustee' (Under Adjustment of Status).
    But you continue to be a non-resident alien under AOS if you keep working on H1. If you switch to EAD/AP, you are just an Adjustee waiting for your status to be adjusted to that of a permanent resident.

    By reading the AILF pdf:

    I get this impression that they primarily mean the "Other Worker" category AOS rejections done in June 2007...I don't know what rules govern that category, but rejections did happen despite visa bulletin indicating current status for that category and AILF is considering this lawsuit. Now they are assuming that this might happen for EB2, EB-3 categories also. Plus we have this $4.4 billion CIR failure theory. There is no document date mentioned in this doc. So, I don't know how AILF is so confident that this will happen for EB2, EB-3 categories, for the rejections of applications has not even happened yet.

    o Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

    + This Act may be cited as the ``Reform America's Broken Immigration System Act''.

    o It is the sense of the Senate that Congress should--
    + (1) fulfill and strengthen our Nation's commitments regarding border security;

    After analyzing the normal benefits of filing 485 are:

    1. get Advance Parole so no need to go for visa stamping
    2. get EAD for spouse so spouse can start working

    Other benefits but rarely used.

    3. AC21 portability. This is rarely used as it may generate unnecessary RFE from USCIS.


    For unmarried both the normal benefits are not applicable since you need to be on H1 to bring spouse on H4; and since no spouse no need for EAD for spouse.

    The only true benefit for unmarried is AC21 portability with H1 transfer under layoffs or low salary.

    The big negative is spouse loses H4 on GC approval if your PD is not current before GC approval unless a status change had already been made.

    Thanks, I was really happy it worked. I wanted to shoot the tide pool waves, and get this effect without having to wait for a "perfect" morning (you can accomplish the same thing just before dawn or after sunset). I am trained as a physicist, and crossed polarizers are a common method of managing light in physics experiments, so I decided to try that here. This technique allows for pretty much any exposure time, and I wanted like 20s to get several waves. A couple of words of caution if any of you want to try it too (and you are welcome to do so).

    You can't use circular polarizers like most of us have for our autofocus DSLRs. Stacked C-polarizers don't black out, because they are both filtering the same light. You must buy linear polarizers. The good news is that they are cheap by comparison (<$50 ea).

    Autofocus won't work worth a damn.

    Adding two polarizers to the lens multiplies the internal reflections (I had problems with this, 3 or more reflections of the sun)

    It vignettes at super-wide focal length on my zoom. I would always expect vignetting with a prime lens.

    With two polarizers you get weird rainbow effects from diffraction, and the whole scene tends to the purple/UV. I suspect a lot of these pictures will look great in B&W.

    There is a lot of potential here I think, and thanks all for the great ideas/suggestions on what else I can try. :)

    Online information say Indian passport renewal takes around 10 - 15 days but it is usually done much quicker. I received my passport in less than 2 weeks(7 business days if i remember correctly) from Chicago, offcourse i mailed all documents.

    Yes, employment offer letter should have PERM title for sure. Same thing i mentioned in earlier post as well.

    but for Employment verification letter, may be not all attorneys asks for it. But most of them ask. And it should have your current H1B/L1 title, if they are asking for this letter.

    They probablly will put one or two into it, but I would think most of the conference member will be from other sectors, which could be positive.

    Also, PACE act is almost guarenteed to go through; We can spend all the energy to push the immigration bill to get it through the conference and then get killed again either in Senate or House because of the guest worker program.

    Don't forget that the House (Anti) Immigration Caucus has 92 members -- be assured that if not Sensenbrenner it will be another equally virulent member. Also, conference committees are nominated by the leader of the house -- nothing to stop them from nominating anyone they want.

    Technically you will be considered a Bachelors in US + 3 yrs Experience = Masters Equivallent = EB2.

    You should be a safe - EB2.

    Q : Is USCIS prioritizing certain application(s) during the receipting process?

    Yes. The Application to Adjust Status (I-485) will have first priority because USCIS needs to ensure that these applications are receipted in a timeframe that would allow processing of an application for an Employment Authorization Document (EAD) within 90 days of filing as mandated by law [8 CFR 247a.13(d)]. Our second priority will be to receipt the Application for Naturalization (N-400) so that we can minimize any delays in obtaining citizenship.

    Thanks for the link. That clarifies that the new package fee of $1010 encompasses the EAD/AP renewal for the life of 485. If one had used the old fee structure then the new fee for I 765 (EAD) - $ 340 and I 131 Advance Parole - $ 305.

    I would think that if you pay $645 (EAD and AP) for the renewal that would also be good for the life of the 485, though the link doesn't explicitly state that. Does anyone have any more info on that?

    Situation:

    Currently working full time on H1-B with I-140 approved already with company A. Cannot file 485 due to retrogression.

    Want to work with company B part time,but need to file another H1-B part time.

    My question is:

    Will filling for a 2nd H1-B for comapny B (part time) without talking to the lawyer of Company A affect my first H1-B in anyway what so ever. Or are the 2 cases entirely separate and will not be linked by USCIS. Thanks in advance for assisting me on this situation.

    Basically what this all tells me is that there is no motivation from USCIS to clear things up. They like things muddied so that they can define the processing date either as Received or Notice or Receipt as per their comfort. :)

    No. They believe they are working their best. Think of an assignment received by your company's Headoffice on July 2, 07, but it came to you to work, on Oct 11, 07. If you are to provide periodical progress, what will you call your Receiving Date of assignment? Oct 11, 07.

    Processing Centers provide their monthly progress report to be published. They treat the date when they, the centers, (not the USCIS mail room) received, as the receive date, which is close to the Notice Date. Hence the confusion. If you ask them if they use ND sequence, they will confidentally tell you that they use the receiving date for sequencing their work, which to their belief is true.

    Logically RD on your receipt should be used. Even if some senior guy at USCIS decides and instructs centers to process cases in that order, can they do it. No, as their sorting of cases is in order they (the centers) physically received them. It will be too tedious to re-sort tens of thousands of cases manually, particularly when mailroom RD is nowhere other than a stamp on the file, and as manually entered info on your receipt. Many follow up documents don't even mention that date, or even PD, as they are not part of the system information. Online info also shows some date close to ND as "your case was received on...".

    There is a motivation to use up visas by Sep 30, as bosses question if they don't do that. But if they don't give visas in order of priority (whatever it be), no one questions, as it is difficult to prove someone to be wrong, or to correct even when something is proven wrong.

    Bottomline is that the whole process translates to Luck.

    1. If you are still with university and the H1 is valid, you are not out of status.
    2. If you are out of university and if company A's H1 is valid, you can start work with company A.

    If you are out of university and company A's H1 is valid, but you are not getting job or salary - you are out of status

    If you are out of university and company A's H1 is not valid, you are out of stats.

    Please check with attorney asap.
    What Snathan said above is absolutely 100% correct.
    However as someone else said about stamping and getting over the out of status period issues is not correct, if at any point you were out of status (no salary or no valid i-94 (white card or the 797)), it may come back to haunt you during GC process.
    Without getting into the risk/debate of whether you were counted for cap when "A" filed for your H1, in order to file with another employer "C", it is advisable to work for "A" if they have a valid H1 filed for you and if you have just left the University employer without any delay and consult with an attorney to remedy the out of status issue for the period since you left the Univ. employer.     Well, not exactly. The above statement is true only as long as you do not abandon your AOS application. To make sure that USCIS does not find that you have abandoned your AOS application you should maintain the validity of your Advance Parole if at all possible. Alternatively, if you maintain a current H-1 visa for the new employer, there is a reasonable argument (but not a guarantee) that, despite your absence abroad, you have not abandoned your AOS application. Finally, if after working overseas for the new company for at least one year, the company successfully files an EB-1 I-140 petition for you, you (and your family) can immigrate via Consular Processing in the EB-1 preference category using your old EB-3 priority date if necessary.

    Should I transfer my H1B with the new company, or it's not required? My job offer will be from the Indian company, and not the US company.

    If you maintain your Advance Parole validity, an H-1 transfer to the new company would not be necessary.

    You raise an important point. Travelling on a B-1 visa would certainly be considered an abandonment of your AOS application. Similarly, if you are found not to be "employed" by a US company because you are not on the US payroll, you would not be entitled to enter in H-1 status.
