    I am suprprised if IV is working towards abiltiy to file 485 and hard country limit...Just want to know how IV is working towards these 2 items...
    If any of these two wont show out in coming bill,..then I would say goodbye to IV..because all other items in bill were there without IV;s interaction....

    Can somebody calrify if these options will anyway include in this bill..by means of ammendements...

    This is like someone in Sri Lanka saying that "if I don't get a blanket within 12 hours of the Tsunami, I will quit the Red Cross."

    How about thinking, "if these items don't show up in the coming bill, I will become a more active member and work towards getting these items to show up at the next opportunity"?

    It is probably not a good idea to treat our voluntary organization as if it were our butler. We're all part of this; we didn't "hire" IV to do this job for us.

    Whenever an attempt to increase visa numbers is made a budget point of order can usually be made. So, you will need 60 votes to amend the law.

    Not really. Senators voted against this because they opposed the underlying amendment. The Democratic opposition stems from the facts that the amendment proposed to re-capture from all categories and then re-distribute accordingly to a Republican preference. For instance EB-3, numbers re-captured didn't all go to EB-3. The amendment gave 61,000 to Schedule A and then re-distributed the rest equally.

    A much fairer, simpler and permanent solution is to simply rollover the unused numbers to next years numbers.


    I believe there is around 300,000 unused visas from previous years. Even if 61,000 visas are gone to Schedule A, we would have got the remaining 240,000 visas. Imagine they are not even ready to pass the amendment which gives relief to Schedule A(extremely shortage workers) as well as employment catagories, think about the chances if the amendment stands only for employment catagories.

    This is rather discouraging if this is true. This basically says one can't require any experience for zone IV if you require MS.
    Well, MS + 11 month (but not 12) will do then, cause zone IV is has SVP "7.0 to < 8.0"

    The question is then: In question 6-A on the PERM form do they mean experience including 4 yrs of MS or experience in addition to those 4? From my negative experience it looks like this number is what is used to compare with the respective SVP time, so it does include 4 yrs for MS (2 yrs for BS)

    Any other opinions?

    I am in the same boat and my employer has decided that they will revoke I-140 no matter what. Can you tell me how did you find out that your employer revoked your I-140. Maybe he/they did not. But my firm is really big and they go by the rules. So I just want to know whenever employer sends the revocation, does USCIS always revoke or it is upto their discretion whether or not to revoke. Problem is I do not have a job yet so I cannot even file for AC21.

    From what I have researched over the internet, employer can withdraw anytime. USCIS may work on it anytime, maybe in a month or 6 months or probably when they adjujicate/preadjujicate your case. It depends on the VO working on your case to give an RFE or a NOID or a denial. It has happened in recent times, check out some threads on and immigration.com.

    The chances that AC21 letter never reaches your file is high, because AC21 letter is not associated with any form. But it is advisable to send the AC21 letter and keep a record of the tracking information.

    I am still trying to understand why AC21 makes things so complicated? Like, why should your AC21 letter not reach your file and why must a VO issue a straight denial or NOID? Is AC21 a black hole in some cases?

    Hi,

    I have applied in EB2 category with job title of Sr. software engineer. and I have frnds who have applied for EB2 under, Programmer analyst, team lead.

    But all of them had Master of science from USA.

    And all of us have our I140 cleared and waiting to apply for I485 when its gets current.

    Reno, could you please give us more information about your and your friends' experience :

    - What your qualifications are.

    What the Sr. software engineer job requirements were. Things like:
    - Education
    - Experience

    and also more info about your experience with PERM:
    - Processing center. Chicago or Atlanta?
    - Processing time.
    - Any audits?
    - Any business necessity documentation requirements?

    I know I'm asking for a lot of info but I think it would be extremely helpful for many folks who are preparing to file under EB2 to avoid regression.

    Thanks to the efforts of everyone at IV and QGA, we have the golden opportunity for a member of IV to actually testify before Congress. No kidding!

    This has to be one of the best and most effective chance we have to make our point directly to the lawmakers

    IV is looking for someone who is in the �limbo� stage, and has made a significant contribution to the economy (ie, invented something, made a medical discovery, created a lot of jobs, etc.)

    I dont know if i quite fit the bill, I am a Environmental engineer, did my masters in the U.S. Working since the past 6 years. First LC rejected due to incompetence of lawyer, second LC (PERM) took 6 months instead of 45-60 days as promised. Now stuck in retrogression. Admitted to top MBA program in UK, and waitlisted at top program in U.S. Planning to go to UK as tired of being stuck and waiting.

    I would also check if your original GC sponsoring employer (Company A) is not involved in any fraud investigations by USCIS. In which case, USCIS can revoke an approved I-140 without any notice on the basis of fraud, which would automatically lead to your I-485 denial. I-140 online status may or may not change in such cases. Your case being in extended review is raising some flags. Do you know anything about the kind of extended review that was going on. Your lawyer on file, as well as you should get a copy of the notice. Make sure no communication was sent to the lawyer from Company A. Sometimes USCIS does not update the lawyer information even though a new G-28 is submitted. You will have to just wait for the denial notice.     Why don't you do this? Try to search just for your employer - and once you have a bunch of cases filed by your employer, go ahead and narrow yours down based on Priority Date.

    I do have the Employer and Attorney details. I searched based on that. Reg, case number, which case number we have to use, the backlog center number or any other number? I do have a copy of the approval letter received from backlog center.

    Let me know what else I can do?

    If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?

    We have seen that for every bill which gets a chance to be presented, there is a heated debate and some compromises arrived at if the bill gets a chance to move further. I am concerned that if this bill goes the same route, the compromise would be to drop the employment part of the same.
    I agree with Pappu that we need to meet lawmakers and would like to add that our agenda should be to ensure that the employment based Visa Recapture remains in the agenda.

    I support this idea most.
    I agreee with the spirit of things - that multiple ways of expressing anguish, disgust, frustration is required.

    While we have to keep generating funds and doing the lobbying, the frustration of the members must be "used".

    Here is my suggestion (and this was mentioned by someone earlier also) - let's send the criss-crossed and blackened photocopies of our degrees, patents, publications etc. to the congress and other authorities as a symbol of how useless these are becoming as we wait for GCs. We can coordinate the event such that everyone's reaches at around the same time.

    Again, all I am saying is that we can do multiple things to gain attention and make our point, and these can happen simultaneously with the other activities ongoing at the State chapter level.

    B. DIVERSITY IMMIGRANT (DV) CATEGORY

    Section 203(c) of the Immigration and Nationality Act provides a maximum of up to 55,000 immigrant visas each fiscal year to permit immigration opportunities for persons from countries other than the principal sources of current immigration to the United States. The Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997 stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. This reduction has resulted in the DV-2011 annual limit being reduced to 50,000. DV visas are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.

    For April, immigrant numbers in the DV category are available to qualified DV-2011 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers BELOW the specified allocation cut-off number:

    Further retrogressions cannot be ruled out should demand continue at the current levels for some categories and countries.

    Not much good news for EB2 and EB3 India. I hope folks realize and do the lobby day seriously.
