    Please Stop living on Employees 'Hard Earned Money' .

    Tell your employees the actuall billing rate

    I am sorry that I wasted my time searching information for you. You just wanted to rant and are looking for a shoulder to cry. You are not serious about reporting your employer to DOL. It is foolish to expect idiots like you to come out of the gutter because you just enjoy the smell of the gutter. Expecting that your rants will have any affect on people who take advantage of immigrants is extremely foolish. And expecting folks like you to stand-up for yourself and do something about this is even more foolish.

    One more thing, only desi consulting companies are not the problem. Companies who figure out a way to take advantage of its employees, will do so. All companies are in the business of making bigger bucks for its shareholders. If they can figure out a way to make more, they will, even at the cost of taking advantage of immigrants. Desi companies figured out the loop holes first. Some of the other companies followed, others are still learning. It can be argued that % of such elements in desi consulting are more because they were the first to figure out the loopholes. But desi companies are not the only group taking advantage of immigrants. They are all the same. And folks like yourself feed into the problem. So please stop blaming just the desi consulting companies, because all companies are the same. Some companies have not yet figured out the ways to take advantage of immigrant employees. But these comapnies are learning fast, because they want to be competitive, right?

    The actual problem is, the Congress. Lawmakers are the problem. They know everything what is going on. They know that not just desi companies but even larger companies take advantage of the vulnerable part of the society - the immigrants. Inspite of having all the information, the lawmakers deliberately did not add necessary protections for immigrants. And, even if the system becomes more efficient, people who enjoy the gutter will continue to live in the gutter. No laws or protections can help folks like you. Every now and then, just come to forum like these and rant once in a while. That's what you will do. The fact is you do not need better treatment or benefits. You need better therapy to tell you that you can come out of the gutter.

    Please stop ranting and stop "requesting" desi companies on forum anonymously.

    I have a feeling that they will HAVE To process EAD's in 90 days( that's what the current rule says ) or reinstate the Interim EAD's - terminating Interim EAD seems like the dumbest move they ever made. If either of these doesn't happen, lawsuits are sure to follow. So, don't worry too much about it my friend.
    Please see in the USCIS web site that you have to apply 6 months in advance if you are renewing EAD. With so many I485s, EADs, APs flooding the Service centers, you need to apply the EAD now if you want to use it after 6 months from now.

    From everything I've read before, it is safe to stay with the sponsoring employer for at least 6 mos.

    There have to be extenuating circumstances to leave earlier than that, and be prepared to elaborate during the citizenship interview.

    It is getting clear now why Legal Backlogs are not touched in this present Bill.
    Because Home Land Security Dep budgets depend on them..If backlogs are gone .. Budget is gone ...

    So our backlogged cases will not get relief ..Looks like this will remain unfair reality

    This is so outrageous! :mad:

    What can legals do then to change the situation? :confused:

    As illustrated below, since 1994 there have been over 218,000 un-recaptured employment-based visas lost due to underutilization of the employment-based visas."

    Some unused EB #s were recaptured for families in following year. For example, in 1994 there were 29,430 (column 2) unused EB #s. However, 27,721 (= 253,721 (column 3) - 226,000 (family quota)) of these #s were recaptured for families. Thus, only 29,430 - 27,721 = 1,709 (column 4) were un-recaptured.

    Also, 50,000 unused EB #s from 01-04 were recaptured for Schedule A.

    Finally, unused EB #s in 99 and 00 were recaptured, hopefully for EB.

    Thus, unused EB #s are more important then un-recaptured EB #s (mentioned above) since some of them have not been recaptured for EB.

    The unused EB #s is 506,384 (total column 2) - 98,941 (99 recaptured for EB) - 31,098 (00 recaptured for EB) = 376, 345

    people we are coming close to the situation where it is "do or get fried :)".

    I disagree that the situation is very bad.

    It is bad only for those that are laid off on H1B. All others have EAD and are happy. They will realize the bad situation only when they cannot take a promotion or salary raise or cannot change job due to same and similar. Or if I485 gets an RFE or denial.

    If the situation was bad, more people would be serious about your idea including you. Even you are not willing to do anything yourself other than asking others to do it. So this is the fate of immigrant community. We all do not want to do anything ourselves unless we ourseves are in a bad situation.

    I would stay at least 6 months with employer after getting a GC, unless ofcourse demanded by circumstances!

    Are there any implications of leaving my employer now who sponsored me for GC? I got my GC on the first week of July. I plan to leave on the 1st week of September. Thank you very much.

    Addendum: I applied for AOS for my spouse this July. Will there be a problem with her AOS?

    The problem here is not the immigration system it is sheer number of people who want to become permanent residents . The queues in Canada and Australia are far far far smaller so the point system works smoothly. The main disadvantage of the point based immigration system is that if the people in the line increase, the points will be immediately be increased so that fewer qualify .Then there will always be people like Lou Dobbs who will say that "potential immigrants will get points only if they make 240K a year and are 25 years of age". The UK is also restricting people by increasing the point based system. Now people who make 35,000 GBP a year do not get any points in the HSMP. The age also has been decreased in HSMP. So the point based system works where the queues are smaller unlike the US. The risks of point based system getting changed everyday are far larger than the US based system , which gives Green cards without any hard and fast numbers like salary , age and qualifications .

    However, for India, China etc. where PD cutoff has to be factored, it is used merely to decide to work or skip a file (when seen in the receive date order). If PD cutoff date is very restricted, they will have to skip a lot of cases, which slows them down.
    I don't think this is true. As a CSR, case is assigned to you, not you choose the case. I think it's the same way to IOs. PD current cases will be assigned to IO, not IO looks into paper mountains to find case to adjust.

    That's the reason every July they ask for wider PD cutoff dates so that they can consume a lot of visas, as they don't have to skip that many cases.
    And about this, it's not abut skip or not either. Visa Office decides the date, CIS does the work. When CIS doesn't output enough work, VO thinks CIS doesn't have enough cases so they move dates forward. Direct result is therefore CP is able to process any cases that is current in hand. When this happens, more approval numbers will show, but that has nothing to do with CIS. CIS basically still process about the same amount of cases as usual.

    Well, they knew very well that they need to honor the DOS visa bulletin and accept cases filed in July. What did they do instead?

    I don't think they will cash any checks. They know at least not to do that.

    Bottomline is they do not want to give us Greencard just use us and fool us. I am sure this 485 being current is big melodramatic thing.

    And it is only 1 year of filing I-485 ( can i take comfort that many others have been stuck 2 year, 3 year etc ). ANother reason why visa numbers got wasted is that many fellas got stuck in namecheck ( Ask many of the Indian/Chinese/Russian folks ).

    I don't what crappy way they use to separate good from bad.

    How come we didn't have any phone campaign? What were our lobbyists doing?

    I'm glued to C-SPAN whenever anything related to immigration is going on in the senate. This time I wasn't aware of it.

    It appears that you are cracking a joke, but I cannot stop from replying to your post. Why are you asking God to save IV? For the things we cannot do or for the things we dcon't understand, why do we always have to bring in 'God' in the picture? Can't we even crack a joke without brining in God?

    I am just trying to prevent world war III on these forums. Thats why my request for not referring "God'. We will all be much more happier funnier and peaceful if we try not to bring in 'God' in the mix.
