3. An affidavit, issued in India saying name is being changed, signed by the person whose name is being changed.
OR
1. If you are married and have the original marriage certificate AND the certificate was issued from India AND the certificate has the corrected name, then all of the above are not necessary.
I will try to post the format for the ads and the affidavit shortly. Watch this thread.

Hello Everybody,
This is my story,
1 - Came to US on B2 (visit visa) in October, 1999. My legal stay way valid till April, 2000
2- Found an employer and in March, 2000 filed for H1B/extension of stay. Lawyer at the time told me that since we filed H1 i don't need to file any other extension of stay
3- August, 2000 received approval notice of my H1 but approval notice mentioned start date of October, 2000 rather than March, 2000 as requested in the petition and approval notice did not have the I-94 card attached with it meaning they did not change my status. Appealed the decision and got some feedback from USCIS that they will look into this. Started working for the company in October, 2000. In January, 2001 Company received another notification from USCIS but I was never provided the copy so not sure what was the decision and was told all is fine but never provided the final approval notice. When i checked case status back in January 2001 it said case approved and approval notice sent. However when I check online case status now I see following,
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Cable sent to American Consulate or port of entry notifying them of approval.
On September 7, 2001, the appropriate American Consulate or port of entry was notified of the approval of this case. Please contact them directly if you need more information.

My wife has surname blank and given name as <Firstname><Lastname>. We filed our 485 in July 07. We didnt have any questions by lawyer. Dont know if we are in trouble.

Since you have not applied this time...you cant get in this years Quota..so get an job where you can get h1 sponsorship next year..So take off to india once your opt is over...get the employer to get you the h1b papers once approves and start to work next 08 Oct1...

On a positive note, the best that we can do is, learn from our surroundings. We can learn a lot from Republicans to understand what not to do.
One of the main reason why Obama enjoys high rating - Republican party sucks. Who is making Republican party look bad - Republicans. The best response to Obama is not to pitch twisted Jindal against Obama, because that just makes Obama look good and it help Democrats. The better response to Obama is, let Obama respond against Obama. So simply don't respond to Obama, which will prevent Republicans making him look good. And like every politician, Obama will commit mistakes, which will cause the demise of Democrats. Its that simple. So what do we learn from this?

Historically for the last 300 odd years, the country has two broad sections, believing in almost diametrically opposite philosophies. Federalists and Democratic-Republicans. Federalists believed in a strong central government whereas the Republicans believe in more power to the people and believed in self-regulation. Over the years, the tone/tenor of these parties have changed but the core beliefs have remained the same. Liberal Vs Conservatism, Tax cuts Vs Spending, Giving benefits to the comman man Vs giving benefits to small busineses who in turn will help the common man.
Obama's future success lies in how much he can pull the democratic agenda of 'helping 95 % of people who are middle class', building educational infrastructure, taxing businesses while spending to help the 'common' man, reforming healthcare while keeping deficit within acceptable limits ($500 billion maybe perfectly acceptable). A certain section of the republican party (read Bush+Cheney and gang) caused the republicans to take huge losses and gave Obama the boost. Tomorrow it can be Reid+Pelosi+Clinton who can cause the downfall of the democrats by over-doing the 'welfare' agenda. Thus I called it cyclical.

This is great going. We're 20% there now..
I think the data provided by this effort will throw light on why we have backlogs in the first place, how many visa numbers were wasted, did they follow the rules in visa bulletins, exact impact of country quotas, exact distribution of visa to different categories and countries, future date movements etc...
Some of our members, like vdlrao, make good predictions about the date movements with almost no concrete data. If we have more accurate data then it will be very helpful in knowing the future prospects of different EB categories.
So please contribute for this effort ....

Around the second week of each month, a welter of activity breaks out on the online forums of Immigration Voice, a non-profit organization set up by employment-based legal immigrants in the US. Users on the site vie with each other to predict the cut-off dates for the next month�s Visa Bulletin. These dates dictate the hopes and lives of thousands of legal immigrants and owing to their sheer numbers, Indian and Chinese applicants make up the overwhelming majority of those who wait in line for employment-based US permanent residence.
Since 200x, barring a few anomalous months, the cut-off dates have largely languished between 2003 and 2004. While the annual limit of per-country allocated visas for Indian and Chinese applicants are exceeded by the number of applicants, the problem is compounded by the ongoing inefficiency of the United States Citizenship and Immigration Services (USCIS). This inefficiency occurs at many levels of processing:
1) Slow processing times often leading to wasted visa numbers that expire at the end of the immigration year.
2) Lack of transparency throughout the process.
3) Lack of customer service in spite of regular ramping up of immigration fees.
4) Random movements, spanning months and sometimes, years, in the cut-off dates of the monthly visa bulletins.
5) Lack of communication between the USCIS and the Department of State (DOS) (the agency that sets the visa bulletin).
These are some of the most glaring inefficiencies that law-abiding, tax-paying immigrants suffer throughout the lengthy process which more often than not spans a minimum period of five years. However, the most egregious of the USCIS�s faults is the apparently complete cluelessness as to the number of applicants pending in their database. It boggles the mind how an agency of such import is unable to give a definite figure to the number of applications remaining to be adjudicated. With all of the anthrax scares going on I'd be very surprised if they even allowed the flowers to be delivered to the building (especially if they are accompanied with get well soon cards). You may want to make sure that the flowers are being signed for and delivered before you send any more.

I think the IO just say anything that comes into their mind because they know nobody's there to hold them accountable during the interview process. Thats why I think one should take an attorney along during the interview process if they think their case maybe little complicated. At least the attorney can step in when it comes to the IOs denying your application improperly. Does anyone think this is a good idea to be on safer side?
No matter what whether your case is complicated or not, it is always better to go with an attorney. My brother did that back in 2002 to represent him, but for the attorney his case would have been rejected even though his case was pretty straight forward.
His attorney rightfully explained the IO about his case which had been tranferred from CSC to NSC and finally his and his wife's case approved on the interview day.

That does not mean that IV favors or is concerned about EB2 only.
What is IV ? - it is us ... the members .....
There may be more EB2 related posts and predictions / estimates than EB3 because,
1. The EB2 numbers are a little easier to estimate ....
2. Maybe members affected by EB3 retrogression are not posting many predictions / estimates, as it seems like a hopelessly long wait....
3. There are a few members here that are making their plight seem worse by posting, wild guesses or guesstimates that are gloomy (such as 50k EB2 IN each in 2004 and 2005) ........
4. No one has yet posted a good estimate (not a guess or guesstimate) of the EB3 backlog....
5. It takes a lot of time and patience to dig for reliable data......
