For the record the raising of the FDIC limit was proposed by House Minority Whip Roy Blunt and not Obama. One article spinned it to show that Obama proposed it and then that news got the most clicks and now everyone says that he proposed the limit.
After the bail-out bill failed in the House, Obama immediately posted a response reassuring Americans and investors that the leaders will come up with another soon.
Contrast this with McCains partisan blaming of Obama for failure of bailout, while it was him that pulled the stunt of rushing to Washington to 'rescue' the bailout. After failing to show the leadership of his own party -with majority of Repubs voting against the bailout (a clear indication of leadership failure and ineffectiveness of McCain Presidency in passing anything through his own party!), he found it convenient to Obama.
And it was Obama who proposed raising FDIC insurance to $250,000 to which McCain has (thankfully) chimed in.

According to this graph we need to wait out atleast one more year for the Rent - to- Price ratio to come down to the historical averages. But you get the Federal first -time home owner credit of $8000 (more in CA) only if you buy before the end of this year. So in my opinion, a good time to buy a house is in the month of december this year, if not the best time to buy. Now this is with an assumsion that mortgage rates don't rise substantially.

Look at the bigger picture, my dear friend. The biggest thing in life that drives a man's opinion is not education or skill or awareness, it is purely perception. A good example is of the man who shot his wife as soon as she opened the door for him and all the while he was thinking that there is an intruder at home. This was his perception.
A public system always has issues and loopholes and a business is created basic on public systems like h1b or GC etc.... thats how public systems are. You are no special. I don't think the issue is that simple. The whole thing just surfaced another screw-up of the system. The actions taken by all the agencies certainly made things worse.
DoS suddenly interpretted laws differently than before. This just like the PERM, BEC, and last July episode. They took actions without considering people already in line. Those with good faith waiting in line have been constantly pushed around. How many people experienced being stuck in BEC while PERM approves new application like crazy? Who is accountable for all of these? They can't do things willy nilly any more. Someone mentioned lawsuit since DoS either interpret the law wrong now or in the past.
Needless to say that the distincation between EB2 and EB3 has become so meaniningless now. How many positions really satisfy the EB2 requirements? I have brought a house 4 years back after 2 years in this country. It is $500K house. Ss it really "Rent Apartment vs Buy House" ?
How about renting a home to provide something good to your family?
With the home values declining I think it makes way more sense to rent the same house (at least in the area I live). If your mortgage payment is only $500 above apartment rent I would say buy. But if you are looking at paying double as mortgage I think its really inflated.
I would like to read more about buying foreclosed properties. I hear there are some good deals out there.
It all depends on the situation, if a person who started this thread can afford to buy a house, wants to buy one, has found a good house in a good location, has got a good deal and if he thinks that not having a GC is the only hurdle, then my suggestion for him would be to buy the house.

1) India and China stop sending so many Engineers and doctors.
2) China and south-east Asia stop supplying Nike's and toilet paper to Walmart's
I guess the positive side of this H1 bill will be further development of Indian and Chinese economies via decreased brain-drain. I guess it already slowed down (to a trickle?!) quite a bit in the past few years and I Hope this bill plugs the leaks too. Hurray! No more brain drain from India and China.

Do you have any idea why attorneys strongly discourage their clients to travel after filing 485 but before receiving the receipt notices?
If you have a H/L visa it may not problem to re-enter US with your visa, but will it affect the 485 filing if you did not have the receipt notice when you traveled outside?
Once 485 is filed you can leave and re-enter the country if you have H or L visa.
You don't need to wait for the actual receipt.
Problem occurs if you leave before august 17th; thinking that lawyer has sent the case when he really hasn't and you were out when ucis receives the package. Eventually; uscis would figure it out and could deny the case becuase of this.
Also, not wise to leave before august 17th; because if the package gets returned for whatever reason then you need to be here to send it in again and you would have to update with new passport pages with stamps and i-94 card and date of last entry, etc.
I understand that people have to go out on business but they are unnecessary complications that people are doing.

A very simple, dumbed down calculation to see which one trumps the other, buying or renting:
1. Home Cost: $300,000
2. Down: $ 30,000 (10% of 300k)
3. Mortgage: $270,000
4. Mortgage Interest/yr: $ 13,500 (5% of 270K)
5. Tax, Insurance, Maintenance /yr: $ 9,000 (3% of 300K)
6. Returns on Downpayment otherwise/yr: $ 3,000 (10% of 30K)
7. Rent on a similar home/yr: $ 18,000 (1.5K/month)
8. Equity/yr: $ 15,000 (5% of 300K)
9. Savings on tax deductions/yr: $ 4,050 (30% bracket, $13.5K interest)
I'll take a home appraised and bought for 300K for my example. The numbers are basically self explanatory. Contrary to popular claim among those who are pro renting, I don't think I pay more than 3% for tax, insurance and maintenance combined (item# 5). Of course, I was wise enough to buy a home in good condition. But that number will change as the home gets older. Maintenance should not include any upgrades that you do, which is basically only "gravy" and based on owner's discretion. Item# 6; I am going with the average returns if you invested in S&P 500. Item# 7; is what a similar 300K home costs to rent. Item# 8; I have only taken 5% growth which is I think under normal market conditions is the growth you would see on your home. The principal payment has not been accounted for yet. I'll do it later.
Situation Rent:
If you rent, then your expense per year is item# 7 minus item# 6 = $15,000.
Of course, your capital of $30,000 is still earning compounded returns.
Situation Own:
Your expense is item# 4 + item# 5 - item# 9 - item# 8 = $3,450.
As I mentioned in the first line, this is a dumbed down cost comparator. There are many loopholes that can be plugged. All comments are welcome.
Your analysis is so spot on except for item #8 and item # 9. I have a question though.. The example you have given suits my scenario so well. I am planning to buy a house (310k ) very soon. The loan offers I have from my lender has interest rates pretty much the same for both 10% down payment and 20% down payment, 5.0 with 20% and 5.25 with 10% down payment. I can down pay 10% right away and the other 10% is also available in a risk free(can withdraw without penalty) cd which yield me a return of 3.5% . So which is better for me 10% or 20% down pay. thanks in advance.

o.k. ..I guess it was the beer that I had made my post confusing. what I am saying is even now home prices are inflated ..see mariners post above. GC is the main hurdle and it will take around 1.5 years to get it ...I guess by that time prices would have corrected and that is when I would buy it.
if I had got GC 1 year back ..would I have purchased it ..a big NO.
last point ..even when I buy the house ..I wont think of it as an investment ..because we will never see those appreciations again ..look around, there is no shortage of land whatsoever.
having a GC simplifies things as I have one less thing to worry about and I can then atleast start looking.
on EAD ..I won't even waste gas to look around ..
even in california ..as far as I know ..it is because of excessive regulation that the RE is so pricey ..as other countries and places in US open up and become innovation centres ..regulations would become less or else price appreciation would come down in california.

They lived in their home for 3-4 years, still didn't get their GC, sold their house and collected a huge profit of $200K and moved to over Texas. This happened in early 2006. They took the risk which worked out well for them ...meaning they were constantly on projects.
You gotta live in a place like CA to make reasonable profits. I am at present in VA, having bought a house there. I bought in Nov 2006 when real estate began to crash. As I speak I didn't make any equity. How much equity will I build in the next 2 years. This is anybody's guess ...maybe 10K or 20K, assuming real estate problems are bottoming out.
if I had got GC 1 year back ..would I have purchased it ..a big NO.
last point ..even when I buy the house ..I wont think of it as an investment ..because we will never see those appreciations again ..look around, there is no shortage of land whatsoever.
having a GC simplifies things as I have one less thing to worry about and I can then atleast start looking.

If we take out the religion from equation, Israelis and Palestines are one people. They belong to same genetic pool and lived together for hundreds of years. In fact it was an Arab Calipha who allowed jews back into israel/palestine area after jews were ejected from this area by Romans. It is a pity they ended up like Indians and Pakistanis (same genetic pool again). Having said that, it is Arab countries that screwed Palestine people after 1948 war with Israel. The countdown to the August recess has entered its final stretch with just one week to go. But for Washington, D.C., lobbying organizations, the steamy month of Congressional downtime means a lot more than slipping out of town to sip pi�a coladas on the beach.
It's an opportunity to contact Members back home in their districts and to mobilize constituents with issue ads and special events. The break also gives lobbyists a chance to set up along the campaign trail to push their agendas with presidential candidates in ocean-free zones such as Des Moines, Iowa.
Usual suspects AARP, the U.S. Chamber of Commerce and the Pharmaceutical Research and Manufacturers of America plan to hit the road in August along with some grass-roots newcomers, including ONE, the organization founded by rock star Bono.
"August is a critical month," said James Fuller, a managing director at Public Strategies Inc., which is working to shape patent legislation for the Coalition for 21st Century Patent Reform. "When Members go home they hear about all these types of issues. Now's the time when they take notice."
Fuller's coalition plans to organize in-district meetings, letter and e-mail writing campaigns, and efforts to get its allies to be vocal participants at Members' town hall meetings. Fuller said all of this is intended to help lay the groundwork for upcoming action in September on patent reform bills in the House and Senate. Targets of the coalition's August lobbying efforts, he said, include Democratic Sens. Dianne Feinstein (Calif.) and Edward Kennedy (Mass.), among others. "We're going to be very aggressive in August, reaching out to companies in states we know we need," he added.
Bono's ONE campaign also is planning a major effort in August, said the group's Kimberly Cadena, asking its 2.5 million supporters to speak with their Members when it comes to the farm bill and other items.
"ONE will kick off the August recess with a grass-roots legislative briefing on the evening of August 2," Cadena said. Over the recess, ONE members, sans Bono, will be lobbying for the Education for All and U.S. Commitment to Global Child Survival bills, she added.
Divided We Fail - a health care-focused effort sponsored by the AARP, Service Employees International Union and Business Roundtable - plans to hit the Iowa State Fair on Aug. 10 to make sure presidential contenders hear their views.
And Bill Miller, vice president and political director with the Chamber of Commerce, said his group dispatches lobbyists on the road during every Congressional recess.
"We decided this year to put an increased focus on doing those visits to Congressional districts and states where lots of our issues are in play and Congressional districts that are also politically in play," Miller said, adding that fundraisers also are a component of the chamber's August outreach to Members.
Miller's team will focus on restarting the free-trade agenda, the stalled efforts on immigration reform and stymying union efforts in Congress including the card-check bill. "Whether you're a union company or mid-sized, little guy or not, the passage and enactment of something like this would have severe consequences for the United States economy," he said.
On the other side of the political spectrum, the liberal group Campaign for America's Future is planning a barrage of targeted ads, direct mail and local press events.
"The Campaign for America's Future plans to take the gloves off this recess to ensure that Americans are clear on who is pushing for change and who is standing in the way," said Toby Chaudhuri, the group's communications director. "The conservative minority has chosen a strategy of blocking legislation at a record pace in the Senate. We're going to expose the obstruction."
The private equity crowd, which is working to fend off proposals to increase taxes on the industry, is planning to continue making its case during the recess, said Robert Stewart, the Private Equity Council's vice president of public affairs. "It makes much more sense for the country, for the economic growth of the country, not to single out private equity for punitive tax treatment," he said.
America's Health Insurance Plans - which went on the air last week with ads defending the Medicare Advantage program that is on the chopping block to help pay for the State Children's Health Insurance Program - is planning to run more ads in targeted districts, depending on how this week's SCHIP debate turns out. AHIP will be working closely with seniors who use Medicare Advantage through the Coalition for Medicare Choices, said AHIP spokesman Mohit Ghose.
"We are going to ensure that every Member of Congress understands what the impending cuts being proposed in the House mean for their constituents," Ghose said. The 400,000 volunteer members of the coalition, he added, "will go to town hall meetings and interact at the district office."
Also on the health care front, PhRMA plans to fuel up its Partnership for Prescription Assistance bus, which will roll into several Members' districts over August, including those of Reps. Particularly worried about what you just mentioned about USCIS using other means to deny application - this seems to go against the principle of 245(K) which was to allow folks to get GC irrespective of a violation in the past. If the intent is to not let folks use 245(K), why even publish such a law? MOre importantly, for folks who have been staying and working in a country for many years (read > 5 yrs), it is possible that they might have some glitches and 245(K) was there to cover that (I am not saying every one has gone through this but a lot of people in 2000/01/02 went through this).

b. The applicant is out of status or illegally worked for over 180 days.

Every piece of paper a person signs and sends to uscis is done under "penalty of perjury". Even though there is protection such as 245k; uscis can use the "perjury" and document fraud to override all of these friendly type policies. If they think a person is dirty or trying to get away with something then they will dig even harder until they find something. I remember as an auditor; a company wanted to fire their CFO but couldn't find a performance reason. Easiest way was to go to the persons expense report because everyone fudges it and this is essentially how he got fired. USCIS knows that if they dig hard into someones file they will find something.
Many people don't really understand the investigative powers uscis has or the extent they will go through. if person fakes paystubs to do an h-1b transfer; well uscis issues rfe's asking for a listing of all h-1b employees and payments made to each employee for last two years. I have seen them inter-relate this information for people who have faked these types of things.
Recently; I saw uscis california service center request state unemployment compensation reports for all employees for wages paid for the last two years. the service center actually picked four people who were paid substantially less and pulled their h-1b files and pointed this out in their denial that they coudn't trust the companies assertions on the LCA and they had to deny the petition for the current beneficiary.
All these talks of lawsuits, etc; will just make them dig in their heels more and find more things and make it more and more difficult.

What if a person who has been in the country for a while(say from 2000) has a few pay stubs missing and period/s of unemployment(2002 and 2003) and therefore his w2's for say 2003,2004,2005 have like 15-30 k figures on them. This is for a software engineer who is on eb3 with a employment letter that states pay should be abut 50 k or so (minimum). Now lets suppose the said person went out of the country and came back in Jan 2006.
So Does means according to the 245i rule the previous period of unemployment etc get wiped off and they have to look at whether he has violated the 180 day rule only since Jan 2006 ? In this case will they look at his all his old w2's as well? Will this constitute some sort of violation ?

It is pretty weak what the adjudicator is doing but still it is giving anxious moments to the original poster.

I am sure that once muslim community or for that matter any community prospers the radicalism reduces. Unfortunately the religious muslim leaders dont want the community to get educated, prosper and westernized because than they would loose control..its precisely for this reason that the religious leaders of this community have for centuries scared the followers of the community with gods wrath if they changed. The Muslim religion has to become progressive and moderate.
About the terrorism was thinking what options does India have to fight against this. Yes military action definitely is an option but it does more harm to India than to Pakistan. Attacking Pakistan, India has a lot to loose while Pakistan has nothing loose. It would make Pakistan from a failing state to a failed state, but would put India years behind as far as economy is concerned and create the biggest headache for India for decades to come. If one back goes back in the history, Pakistan has lost a lot more than India in the last three wars, and that is the only reason why the establishment in Pakistan including the Military has preferred encouraging and sponsoring cross border terrorism which is of very little cost to Pakistan but a constant headache to India. India has lost more from these terrorist attacks including Kargil war than they would if they had gone through a one time direct confrontation. I personally feel that if India does decide to go in for a military confrontation it has to be long term strategy to occupy the country and wipe out terrorism and help to nurture the economy so that prosperity and wealth creation takes a front seat and religion moves low in the peoples priority. In fact if Pakistan can ever have a strong economy and strong democracy, I am sure the country will move towards a moderate religious society. Lets face it, man is a very selfish being, it will never put its personal prosperity at stake for a larger cause even it that happens to be religion. An example of this is the Middle East Kingdom where the monarchs including the common folk is very possessive about personal wealth and will go to any extent to preserve it.
The only way this can ever happen is by a willing global coalition, which is ready to be there for a long haul and not by India alone. If India did do a quick military action and left the country, Pakistan would move to become another Afghanistan creating the biggest headache for India for decades and decades to come and effectively dragging Indian economy and prosperity.
Its sad that India let this headache linger on for so long, had it taken remedial action by taking control of complete kashmir and installing a pro Indian govt in 1971 we would not be confronting an nuclear dragon with very little option to fight it.

When we had multiple chances to occupy the country, we backed off and retreated.Instead if we had marched all the way to Islamabad, taken out the military dictators and set the country on a path of democracy and economic progress - you would have Pakistani economy flourishing and not living off the IMF, the American and the Asian Bank's doles. We would have seen TCS, Wipro, Infosys, Satyam counterparts in Pakistan.Anything wrong with that? Its finally the same race and the people....

If one back goes back in the history, Pakistan has lost a lot more than India in the last three wars, and that is the only reason why the establishment in Pakistan including the Military has preferred encouraging and sponsoring cross border terrorism which is of very little cost to Pakistan but a constant headache to India. India has lost more from these terrorist attacks including Kargil war than they would if they had gone through a one time direct confrontation. I personally feel that if India does decide to go in for a military confrontation it has to be long term strategy to occupy the country and wipe out terrorism and help to nurture the economy so that prosperity and wealth creation takes a front seat and religion moves low in the peoples priority. In fact if Pakistan can ever have a strong economy and strong democracy, I am sure the country will move towards a moderate religious society. Lets face it, man is a very selfish being, it will never put its personal prosperity at stake for a larger cause even it that happens to be religion. An example of this is the Middle East Kingdom where the monarchs including the common folk is very possessive about personal wealth and will go to any extent to preserve it.
The only way this can ever happen is by a willing global coalition, which is ready to be there for a long haul and not by India alone. If India did do a quick military action and left the country, Pakistan would move to become another Afghanistan creating the biggest headache for India for decades and decades to come and effectively dragging Indian economy and prosperity.
Its sad that India let this headache linger on for so long, had it taken remedial action by taking control of complete kashmir and installing a pro Indian govt in 1971 we would not be confronting an nuclear dragon with very little option to fight it.
Very good post. The main intent behind terrorist acts is to disrupt the Indian economy.
Like some one has so consistently maintained - our leaders have committed several mistakes in the past.
1. Our leaders easily conceded to the demand for a separate country of Pakistan. This has only alienated Hindus and Muslims but has potentially put nuclear arsenal in the hands of the terrorists.
2. Ok, there was a separation but was the separation clean? The terrorists have just mixed in with the Mumbai crowd. Do they even need to leave Mumbai for Karachi? There are enemies internal and external. 154 millions muslims. Are they all terrorists? Absolutely not.
But even if there is 1% who have to do anything with terrorism - its trouble and lots of it.
3. When we had multiple chances to occupy the country, we backed off and retreated.Instead if we had marched all the way to Islamabad, taken out the military dictators and set the country on a path of democracy and economic progress - you would have Pakistani economy flourishing and not living off the IMF, the American and the Asian Bank's doles. We would have seen TCS, Wipro, Infosys, Satyam counterparts in Pakistan.Anything wrong with that? Its finally the same race and the people....
4. The congress party created vote banks by appeasing muslims. Instead of this kind of appeasement (very similar to appeasements to backward class), if we had created uniform laws, the entire community would havebeen absorbed into the mainstream. Instead, we are ourselves responsible for pampering and alienating them. Its the most unfortunate.
