You can dissect it a million ways from here to sunday, the fact of the matter is that EB 3 as a whole and E3 I&C in particular are messed up big time. We cannot sit twiddling our thumbs while we wait, most EB3s have supported most of the action items. What is wrong in exploring different options. we are not obstructing anybodys efforts. Vertical allocation or horizontal allocation doesnt matter, what matters for most is that there should be consistency in actions. They keep changing the rules every couple of months. if we know the number of people stuck in each category per year/per country we can come to our own conclusions and decide if we want to stay or go. There are greener pastures everywhere. Every year our lawyer tells us that its a matter of 12-18 months and you keep waiting...the only reason is that...we have been waiting so long, lets wait a couple more and see. i know some will immediately give comments like, 'leave sooner, one less family in the queue'..or..'port to EB 2 you ##$@'...to them i say i hope you are fortunate enough to avoid getting trapped in a situation like us.

As such, you have to start looking for other jobs because you are not sure if they will accept EAD even after a week.

If they offer you the job, well and good, but if not, I think you can litigate for various reasons because what they did is not right.

I am going to start as soon as I calm down :)

Nonimmigrant Visa Number: is this the contraol number of H1B stamping?
From first stamping or last one?
My last one I got from state department by mail. The 'psot' is mentioned as 'DEPARTMENT'. So if the control# from the last visa, then
'Consulate Where Visa Was Issued' will be what? Department?

    Reply pls.

Guys, i have been trying to find some information on this but i can't seem to find any thing relevant.

I have been in the US since 2001. I came in on a F1 and then moved to a H1 and then my employer filed for my greencard and i now have an EAD and AP that is employment based. My last entry into the US was based on my AP.

I recently got married and my wife is a US citizen. I was wondering if it makes sense to apply for a family based AOS concurrently since the employment based AOS takes a long time to be processed. If this possible? and if so how do i go about doing this?

My apologies if this topic has already been covered, i tried searching the forums but could not find any similar topics.

    Appreciate the help.

I have similar experience. I moved to sunrocket (which is now teleblend) from vonage. I pay half of what I used to pay vonage for same services/usage.

currently teleblend offers $50 unlimited india calling + ofcourse US+canada unlimited. However as now vonage has come up with $25 world plan, I am sure teleblend would come up with something similar soon... may be $20 world plan or so. As they always price it below vonage. Let's hope! competition is good for consumer.

I also had Teleblend world...but I removed the unlimited world as it was $35. Lets see they might come up with something like this.

I dont understand why DOS/DHS/USCIS will not do anything RIGHT NOW and wait till July 2nd or 3rd??

They are probably wrangling right now...also it is possible that legality requires any amendments only to be published in July...not earlier..

This is a dumb idea. You want the US to give you Citizenship while you have an approved I-140 and AOS status??????? You don't even have GC !!!!

Do you even know the reason for the law that states you have to wait for 5 years after getting GC to apply for US Citizenship?

And what is this nonsense about boosting the economy because you pay mortgage?

Please don't waste time on this - GC confers enough benefits for you (and family) to be able to live and work in the USA without ever applying for citizenship. The only benefit you don't have is to work for some US Govt. agencies, to vote and no visa-free world travel (mostly) or sponsoring some more family members to take away more of the social security fund.

If you read the plan, you are essentially asking to by-pass all security laws and telling the US to sell you GC and Citizenship.

Simple: stupid and bad idea. Drop it.

    Ahuja,

Why do you even need a GC, my friend. Stick with H1B visa. the only difference between GC and H1 is independence of employer and why do you even bother about it. You can always get a job where you want, buy a house now, sell it tomorrow, then after 6 years, go out for a year, come back on new H1.
As I said, people here are highly motivated and do want to follow the rules and achieve bigger things in lives, creating value in the process. But not many are willing to wait for 5 more precious years, after your greencard takes 10 years. Or 15 years on GC and 5 years for Citizenship. Once you work very hard, then you tend to ask for the right fruit, not just take anything. And whatever the Citizenship requirements are.. they will be met while waiting for theis damn GC..
I am just hitting at the attitude.. not person.. sorry...
Assume your school makes your 4 year course extended to 6 years and in the process makes you do a lot more..What do you ask at the end of it. 4 year degree or a 4+2 year degree.. .something similar..

Remember the lambi race ka goda.. He didnt pick the coin tossed at him.. anyone.. which movie.. ???

My H1 extension and transfer to a new employer was approved around Feb 2007 and validity is between mar 2007 and feb 2010.

So did you guys notice a pattern here ?

hmmm.. i had noticed that for couple of persons whose approval was done early got their passport immediately but in you case it is not true!! so I guess it is difficult to decide any pattern.. (i am not sure whether it is related to H1 approval of any specific center.. if we decide some template and ask everyone to post all such details that might help but i am not sure whether everyone will follow that template...) was there anything complex in your case which you think might have caused this problem?

my H1 approval was done in April 2007 and I have my appointment in Feb 1 st week. I will post my details as soon as my interview is done.. Good luck to you..

I read in another forum that US consulate in Canada is actually asking to fill out some PIMS form available on their website. Also you need to fax your documents 1 week prior to your appointment.

Can anyone confirm this? Man, I wish this could be the case in India also.

I received the cards today. However, the "Resident Since" date is some date in 2008 instead of 09/20/10 (date when I-485 was approved).

I was told by USCIS customer service to fill out form I-90 and mail it to them for a replacement.

I needed clarification on a cryptic question on the form-

    Under Part 3 (Processing information)-
3: City of residence where you applied for an immigrant visa or adjustment of status

The I-90 instructions has this - "City of residence where you applied for an immigrant visa or adjustment of status - List the location of the U.S. Embassy or consulate or USCIS office where you filed your application for an immigrant visa or adjustment of status"

So does this mean it is the service center I applied to during the 2007 fiasco? or where I lived when I-485 was filed? The question is cryptic but the help in the I-90 instructions looks clear.

Any one had this issue before? They do have an option on the form for USCIS error for which I do not need to pay any processing fees...

I guess we'll need to ADD to that number:
    1. BEC stuck folks who could not file in July 07
    2. PERM approvals starting August 07

to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.

If I have to guess-- (1) would be very less, may be 100-200 max
    (2) around 5000 ( just a PUMA)
    So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.

If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

I'm a great fan of Obama for what he has achieved so far and in all probability he will in Nov. I hope the new CIR will not be similar to CIR 2007 as far legal immigration is concerned. After 8 years of paying taxes I would definitely feel greatly disappointed if we get a raw deal for being legal

Not necessary. But, not everyone entered with the visa. We are talking about the entry with the AP and H-1B approval has not expired yet. You have been answered.

Have a questions for the Gurus...Is Credit Check performed during any of the processes related to FBI (for people who are present in the US with a SSN) ? IF so, will a Foreclosure in the credit check cause any problems or delays in adjudicating the 485 petition ?

Thanks in advance for the information that anyone provides.

Would appreciate if anyone can reply to my question....

late last month my father passed away and I had to fly back to Australia to attend the funeral. My lawyer and I were already in the process of preparing my i485/ead/ap. They arrived at the service centre on may26 and I left the US shortly after midnight on the 27th ( talk about close). My lawyer told me that as long as I was present in the US the day that the Service centre recieved my applications, I was ok. I also had my L1 re-stamped in Sydney before returning.

So based on my experience, no you dont have to wait for reciept of filing, just must be in US when filled.

    LETTER TEMPLATE #2

    <<Date>>

    The Honorable George W. Bush
    President of the United States
    The White House
    1600 Pennsylvania Avenue NW
    Washington, DC 20500

    Dear Mr. President:

I write today to urge you to fix America's broken legal employment-based immigration system. Currently, more than 500,000 skilled individuals who contribute to the American economy through their hard work in high technology, scientific research, medicine and other fields find themselves trapped in a process that is hopelessly backlogged.

If nothing is done, hundreds of thousands of immigrants will wait years or even decades in a process that was never intended to take so long. While comprehensive change will require legislative action, your administration can implement administrative remedies to improve America's competitiveness, eliminate bureaucratic inefficiencies, and improve the quality of life for these legal, highly-skilled immigrants.

Sir, I came to the United States of America <<NUMBER>> years back. I graduated from <<UNIVERSITY>> with a Masters in <<FIELD>> and I have a Bachelor’s in <<FIELD>> from <<UNIVERSITY>>. After completing my Masters, I started working for <<COMPANY>> in <<YEAR>>. I am currently working as a <<POSITION>> with <<COMPANY>>. While in many respects I live the American dream of participating in a thriving economy, the dream is still incomplete because under the work visa provisions my wife of <<NUMBER>> years cannot work inspite of having a <<QUALIFICATION>>. Many people I know are contemplating moving to other economies of the world to take advantage of a fairer immigration policy. In other circles I am also aware of developing nations trying to lure back their citizens to boost their Research and Development potential.

Attracting and retaining the best and brightest minds from around the world is in America's best interest. In February 2006, your Domestic Policy Council issued a report on the American Competitiveness Initiative that recognized the importance of employment-based immigration. The report stated: "The President also recognizes that enabling the world's most talented and hardest-working individuals to put their skills to work for America will increase our entrepreneurship and our international competitiveness, and will net many high-paying jobs for all Americans. The United States benefits from our ability to attract and retain needed immigrant and non-immigrant students and workers, and it is important that America remains competitive in attracting talented foreign nationals."

You can advance your stated objective by making common-sense administrative reforms to fix a system that is clearly broken. Implementing much-needed reforms will also free government resources to focus on pressing national security matters. For example, current rules require the Department of Homeland Security to renew the Employment Authorization Documents (EADs) of hundreds of thousands of legal immigrants each year as those immigrants wait for green cards and permanent residency in the U.S. Rather than renew these EADs annually, the government could renew these documents every three years, freeing countless hours that could be better spent serving the Department's mission.

The greatest impact of the broken green card process is borne by the legal immigrants and their families. There are more than half million highly-skilled legal immigrants already working productively in the United States who find themselves trapped in a system that is taking years longer than intended. During this wait for a green card, these immigrants remain trapped in a legal maze, unable to change jobs - even within the same employer - without starting the arduous immigration process over again, and subject to waits that grow longer and longer.

We implore you to exercise your authority to implement administratively these much-needed reforms.
Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.
Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.
Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.
Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
Allow visa revalidation in the United States.
Reinstate premium processing of Immigrant Petitions.
I earnestly urge you to implement these administrative remedies without delay, otherwise many immigrant families who came to USA legally to become a part of the “American Dream”, will continue to stay in a limbo. Your help is urgently needed. Your action will also fulfill your stated goal of attracting and retaining highly-skilled legal immigrants from around the world, eliminating bureaucratic inefficiency, and improving the lives of future Americans already living and working legally in the United States.

Thank you for your attention to this matter.

    Respectfully,
