I am in a similar situation. I applied just 95 days before. My lawyer "forgot" and I applied in a rush in the end. I am hoping it will not be a problem.
My understanding is that you will remain in status even if you do not have EAD or AP. However you cannot work.
I have a meeting with my lawyer on wednesday. I will be asking her about this. I am hoping for peace of mind that this does not become an issue.
I checked with somebody in the forum like you and he got it in 2 and 1/2 months. I checked in the USCIS web site. It says you have to apply 6 months in advance. I did not know about this since I got it in a month last year when my case was in CSC.

My Guess is , It is a rumour . since the USCIS suspended the I -140 Premium Service for the month of july . It clearly indicates they are aware/expecting many of the I -485 filings from July 1st and do not want to promise I- 140 decision in 15 days during July .

NSC has approximately 26,000 I485 applications that may have a visa available and we are reviewing them as expeditiously as possible. This application is in line to be worked but it will take time. Please allow an additional 45 days for NSC to adjudicate the application. If you have not received a notice from NSC after 45 days you may submit another inquiry.

I tried to contact Customer Service at USCIS. They don't provided any information. USCIS website updates show they are processing 08/01 or later for AOS application. They are not following the First In First Out(FIFO) order.
I need help of your good to know the status of my I-485 application.

Just because you are not getting your own greencard fast enough, you are posting against L1s. If you had an opportunity, you will also apply as L1 for greencard. Did you all not try for Labor Subs? I guess only a minority of people get stuck in name check ( unlike immigration portal forums , the FBI namecheck discussion thread doesn't move much) or may be that majority still in the 'waiting for receipt notice/FP' mode.

Btw, I've got mine I-485 receipt at Sept 13th, filed with NSC and was received by well known J. Barrett at 10-25 of July 2nd.
Did you have LUD on your I 140?

(1) - (2) - (3) gives the spill over from EB2 ROW to EB2 (I&C), which is 1,426Which means EB2 ROW to EB2 I&C spill over is mere 1,426 ???? Hope we are wrong... this looks scary...

This needs to be advertised on the forums here or on the home page. Most people don't know what IV's expenses are.
A generic breakdown of costs, without going into specifics, would help members understand the expenses and provide some transparency.

See, that's the reason I think the lawsuit idea has issues. I suspect the lawsuit may end up making life difficult for a lot of genuine cases without actually achieving what you set out to achieve.
But I have no data one way or the other.
The question is how would you identify which jobs are genuine and which are not. In addition, the question the porting comes at I-485 stage.
So in other words there could very well be job out there and you won't know till its I-140 is approved if it is for porting reasons.
Also, a good/established company may most likely will not file a new labor and I-140 for a person because it an unncessary expenditure for them.
So guess who are the people who are most benefitted by this...

Hello Everyone
We had our visa interview for H1-H4 stamping on Jan 29 in Mumbai Consulate as my hubby had changed his employer and also applied for the 3 year extension.The VO asked him questions about his job,company,profile ,etc and told us the visa was approved and we will get it in mail the next day.We got our passports with new visas the next day.I don;t know about others in our line cause we were the first one's there.
Am not sure how the PIMS thing works if it is for every one or only some ppl.

This is ridiculous; all I see is unnecessary hurdles being produced � I see efforts of discouragement towards coming to this country on H1B. First they suddenly start auditing 60% PERM cases and now suddenly delaying visa unreasonably�increasing Visa numbers and making Green Card processing faster is aside, we are facing other problems.

I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.
Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.
The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants. I am afraid that Senator Durbin will make the calls when Senator Obama becomes the president.
Please post your opinions. This is a very important discussion. It is very important that the community see what is in store for us when the new Administration takes charge.
