PD porting is another labor sub in making. I hope I have presented my case logically to show who all are the people who are in position to be benefitted by this rule. Of course there will be some genuine cases too but on other hand think about the people in Eb2 line that will be severely affected.
See, that's the reason I think the lawsuit idea has issues. I suspect the lawsuit may end up making life difficult for a lot of genuine cases without actually achieving what you set out to achieve.
But I have no data one way or the other.

Our cases were approved on Sep 21, 2010. Received approval notices on Sep 25, 2010. But did not get the Cards yet. I am planing to travel next week. So I went to local USCIS office and got the I-551 stamp on my passport. Can you guys suggest me what other documents I need to take along with me if I don't receive the cards by the time I leave. Also pls let me how long will it takes to receive the cards.

It is not good disparaging the countries needing TV by calling them idiotic and asking for boycott etc. Please know that you are living in a country (USA) which is far worse than those "idiotic" countries in this respect since 2003. US needs C1 visa for transiting through its airports even when you have a valid VISA stamp in your passport to a destination country and you need to fill eqaully gruelling application (DS 156). Also you need to carry documents for travel purposes and financial support.

for some reason, the pdf file is not opening....I will do the flyer posting wherever I can.....We should also probably write up a mail that can be mass mailed to recruit the many who are affected or may potentially be affcted by this issue, or whose loved ones are affected. We should also do a smart media camapaign- even try to draw attention of network programs like 20/20 or 60 minutes that have a mass impact- to the really tragic situation many ppl are in (esp. one case from the last board comes to mind- of course we have to be ultra-sensitive about privacy and other sensitivities of the individuals involved).....getting the attention of the major networks may not be as far fetched as it seems- much less worthy causes have been championed by these programs.....if we articulate it well to the producers involved, with the right mix of facts and the personal, I believe many will consider it seriously, even though immigration is a complex issue to many....like i said we shd not underestimate the american sense of fairness, and we have a very good cause where we need some of it.....it will appear dreadfully unfair to many that people who have been paying social security taxes for 5-10 years are not even allowed the security of knowing whether they themselves will be eligible for it when they need it! That notion will give a jolt to most unbiased americans who typically associate immigration with people sponging off the system

Most of us are at the mercy of our attorney's to file for I-485. The attorney's take their sweet time to prepare the draft and send the application. In this heated moment the attorney's offices should hire more people and get the ball rolling.

So basically he is saying that count your blessings and thank god that you are stuck in Backlog centers or in retrogression because in Europe, its even worse. Its a nice way of saying : "It is what it is, take it or go to Europe or go back to India".

Backlog centers are 20 years behind schedule already? People cant get drivers license in Pennsylvania coz they get only 1 year extensions on H1 due to labor backlog and their wives are driving them to work? Does he know that there is a name-check process that FBI sometimes takes forever which is not only hurting Greencard applicants, its also not a smart thing from security and public safety perspective to sit on someone's name check process while that someone is living and working on work-permit(EAD)? Does he know that the whole greencard process, being employer centric prevents people from switching jobs, getting promotions etc for 6-7 years? Does he know that Australia gives Greencard to all advanced degree holders in few months time who have 2 years masters from Australian university(accredited CRICOS universities) and allows students to work off-campus when they are on student visas?

If they decide to cut-off some day next week can't believe how a day or two would make a huge difference in someone's lives. This is very cruel. We have to react based on the infomration we have and it keeps changing every day. So every time I have to run to my manager/director ask them to escalate to HR and they talk to Lawyer. I look like a guy pushing panic button all the time but in reality if we don't act quickly will regret for next few years. Never had a such a bad July4th holiday :(

On the other hand if those labor are sold for a price then it is serious problem. And thats why Lab Sub was eleminated. Now thats what is going to happen (and happening) in PD porting case.
any action should be against the so called "paid PD porting" cases. But why harm a honest EB3 person switching companies to go up the ladder? If he is getting the benefit of the rule, what is wrong? As long he it is done by the law, I do not see any problem.

Nothing will happen. The dates will be retrogresses on Monday. May be we will see 'U' in Visa Bulletin. The AILA will try to pursue DOS and USICS but they will politely say "sorry for the trouble" This will lead to the law suit. Some people will submit their resignation. Remember Enron, one fine morning thousands of people found that their life savings or retirment savings got wiped out clean with nothing to fall back on. Same could be said of about a lot of dot com millionaires. Life is very very unfair, what other explanation do we have other than that.
Wow. We are living in the great country built by Immigrants were there is no value of Immigrant. For undocumented immigrants, there are senators to help them. For rich people, they have money so don't have to do anything. For middle class immigrant like you and me IV forum is there to show our frustration.
I am now seriously thinking of going back to my home country were I would be considered moron who came back from US.

For those in South ( Texas, Oklahoma, New Mexico, Louisiana) best way to go to India is new Emirates direct flight between Houston and Dubai and then onward to India.
I have had 3-4 friends fly this route since they started flying in November 2007 and they have nothing but praise for everything. These guys have excellent food and entertainment and no transit visa hassels plus duty free sopping in Dubai is good.
Pluse - they put you up in a hotel if your Dubai layover is more than 8 hrs (for economy class passengers) and you get a free transit visa to visit Dubai. During my last trip to Bangalore, I went via Dubai (NYC - Dubai direct flight) and on my way back we had 11 hrs layover. My wife and I got a chance to see the city. Next time we are going to India we are planning on staying for a few days and go for their desert camp trip.

Its not true, plenty of non-white countries do not require a visa unlike India which has the worst visa policies in the world. Obviously most countries require a visa from Indians because India does the same needlessly. Its time the Indian govt revisited these primitive and ill conceived rules.
