Hey mind your business. You don't know a thing about India and I am sure you wouldn't have even visited once in your lifetime. If you have problem with individuals, companies, sue them find legal ways to stop their wrong doing. It is good for everyone. Dishonesty is not a patent of any country. You show me 10 corrupt people from India, I will show you 100 from UK, 100 from USA and 100 from Japan.. Don't blabber about things you don't know in a public forum. I am taking offense of what you wrote.. You owe an apology to India and people from that country in this forum..

If you are offended, I don't give a DAMN!! I know about India very well and has been to India many a times. I know very well about the indian corruption which has no comparison with any country in the developed world. All you have to look at is the suveys from various NGOs that track corruption at various countries in the world and you can see where India ranks relative to US or UK

I did not send G-28 even though I have an attorney. I think that part is only if you want them to respond to your attorney rather than yourself.

Here are the answers to line numbers 10, 11, etc...

    10 - Choose (b) and (iv) within (b)

    11 - Choose (b)

13 - I chose (b) and (c) since I had done both of those things. You should choose accordingly.

14 - I left this one blank because I did not want to involve the attorney

15 and 16 - Just write your name and sign. Make all family members do this to avoid separate forms for each

17 - Leave this one blank once again because it is only if you want them to respond to your attorney.

I have one more question, What should I fill in 1-9 lines? Should I fill with Primary applicant information?

Thanks Ram. What is strange that my attorney on record did not even get the letter of denial. I have scheduled infopass for Jan 5th. I have H1B until June 2009 and EAD unitil Sep 2009. My wife and I have been working on EAD and traveled on AP.

Question to you and other members: Can I work until Sept 2009? I don't think my letter says that EAD was revoked (that is me speculating until I get the letter)

    Mohican

    - H1 is still valid even if your 485 got rejected until you get notice to that regard separately.
    - If you have not shifted to EAD,You can continue working on H1

I continued working on H1 during my MTR approval process( Sep08 to Dec 08). My 485 got rejected due to earlier employers revocation of I 140.

Attorney gets the notice. Find out from all your attorneys and their staff if you have access to do so.

Call USCIS and find out the reason of rejection first or take info pass and find out the reason and act fast. You have already crossed general response time(30 days normally).

    All the best.

    - Ram

Any thoughts about this one? I ask because I am not sure whether they send 1 receipt notice, 1 finger print notice for the entire family, or whether they send one for each applicant.

    Thanks

My spouse and I live in different cities - each will file their I-485/EAD/AP. She as dependent.

What should the spouse write for her address? Her current address, or mine?

    Please advise.

    Thanks

    Ams

Seeing this data and if USCIS and DOS follow quarterly spillover (as some mentioned that this is the law), then things look a lot better. But again, who knows...

Quarterly spillover is very important for us and we should make sure that if that is what the law intends, then USCIS/DOS follow that.

I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.

Good Luck to everyone including myself!:(

    I had the same issue...
Here is the short version of how it unfolded. I've seen some quick responses from USCIS.

9/15/2010 - USCIS email indicating that cards mailed for both me and spouse
    9/16/2010 - Spouse received card
9/21/2010 - Got email (LUD) that my card returned undelivered.
9/22/2010 - Called customer service updated the address
9/23/2010 - Got my card in mail (wrapped in an usps priority envelope) with tracking number

I was pleasantly surprised with the fastness of USCIS.

    Thanks,

    Congrats!!

My attorney's office contacted USCIS and was told that USCIS has current address on system  They told that since the case is waiting for RFE it must have happend by mistake

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right. Why cant you guys understand this simple fact?. Now stop making fools of yourself and get a life.

That USCIS director gave a good answer. Is your pain more than those citizens of this country who gave their limbs and life for US?.

BTW, i am one of the guys who couldn't file I-485 because of this fiasco. But i understand the reality.:)

The following is the response I got from an american friend and my previous roommate who just came from vacation .

"I feel so bad about what happened with your application.

Can you send me the letter you wrote to the congress people?
If I can read it and understand it ok then I can send it myself (as a registered voter) too. "

No one is here is foolish to say that Green card is a right or no one here is saying ones life is miserable than the soldier who made sacrifices for ones country.

According to commander in chief , look what constitutes a sacrifice

    http://www.pbs.org/newshour/bb/white_house/jan-june07/bush_01-16.html

Its ridiculous on your part to compare those brave men and women in uniform to people on this forum(including me).

There is a reason why people who fought in world war II are called greatest generation.

To begin with I was not comfortable with the idea of sending flowers. But I did not call people fools. Dont be judgemental .

    BTW guys,

Thanks for those who think the idea has merit.
i suddenly see a red dot against my username for trying to think out of the box:
"please dont be foolish and waste everyones time with ur insane proposal? thanks"

It is OK - whoever wanted to go this length. FYI, 'have been a member of IV and a donor since inception. Is anyone from the core who thinks this idea is insane?

Like-minded folks - let us work on it
How about having a list of action items and getting an opinion from the IV core on them?

Any comment? It is a very interesting article, it look like an advice from the WSJ to the repubblican party : do not get dirty with the Immigration, becasue US citizens does not cares. I agree with that. The unemployment rate is very low, and the Agricolture business is based with the immigration labor, the same with trucking, storage and do not talk about resturant and cleaning business.

It is not true. The orignal text in IMMIGRATION AND NATIONALITY ACT says "Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraph (1), to qualified immigrants who are members of the professions holding advanced degrees or their equivalent or who because of their exceptional ability in the sciences, arts, or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, an d whose services in the sciences, arts, professions, or business are sought by an employer in the United States.
    "

The item mentioned above is for EB2, meaning any spill over to EB2 is from unused EB1.

for EB3 the ACT mentions the following

Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):

The meaning is EB3 gets all unused from EB1 and EB2... This is the catch, does this mean spillover from EB1 after EB2 catches up (or) spillover from EB1 even if EB2 is not current..

If they have done spillover from EB1 to EB3, even when EB2 is not current...we can give this a try.

Sorry for the confusion...Just got excited and went over the allocation of visas from the ACT

I agree. Other non-useful threads are more active than this.

I am surprised that all other threads are getting updated quite frequently. People are posting question related to their RFE and as usual once they get answer to their problems, they vanish. People are posting jokes on IV, but when it is their turn to call, we've to "bump" this thread and send e-mails to members. So pathetic.
I felt very sad when I read 30000+ members donated some 4000 dollars in last two months. I felt my donation of about 1000 dollars since 2006 is being wasted to answer questions of or to solve the problems of these free riders &/or one question members.

also very recently a new bill has been drafted. but i don't have more info. A gist of it is:

Republican Senate candidate David Kramer on Monday proposed an immigration reform plan that opens the door to legal status for illegal workers who have been in the United States for five years or more.

Do you have F1 stamped or you just changed your status from F-1 to H-4?

My wife has H4 stamped on her passport which expired last year. We had got H4 extended last year, but has not been stamped. After that she changed status to F1 again not stamped. Now as per my lawyer's advice probably we will need to change her status back to H4.

My lawyer has suggested that it is not advisable to be on F-1 while applying for 485. You might argue that you are not the primary applicant ( on F1), and USCIS might buy that. But risks remain. Specifically if you have to travel out of country before your I-485 application is adjudicated you will have problem.

Since we all know that right now USCIS is just taking applications, and it might be mighty long time before applications are adjudicated, I have decided to not take risk applying on F1 status.

Not been a close tracker all these years, but it all changed at the beginning of October ;)

But, both my wife and I received CPO e-mails this morning. No welcome e-mails.

These are some important events in my journey -

    First H1-B - October 2004 (Company X)
Labor (regular) filed on Jan 20th, 2005 (EB2)
    I-140 filed in August 2006 (Company X)
    I-140 approval in June 2007
    I-485 filed August 2007 (Company X) (EB2, India)
    Second H1-B in October 2007 (Company X)
Applied for EADs and APs twice since filing our I-485s (Company X)
Wife and I had a USCIS interview in July 2009 (Company X)
One LUD immediately after the interview
    No RFEs ever
Case status showed up as in the "initial review" stage till this morning when the status changed to "Document Production or Oath Ceremony"

    See the url below.

    http://www.informationweek.com/news/global-cio/training/showArticle.jhtml?articleID=215900774&subSection=H1B

"The Computing Research Association's annual Taulbee Survey of 192 U.S. universities with doctoral programs found that total enrollment by majors and pre-majors in computer science increased 6.2% last year. If only declared majors are considered, the figure jumps to an 8.1% increase, the first boost in computer science majors in six years. "

Are you happy now? Since H1-B quota is reduced, more students are considering computer science as a viable option. If H1-B is limited only for genuine requirements by american companies for the best and brightest and not used as displacing american companies by indian crooks from TCS/INFY etc., even more americans will go for those degrees.

Are you satisfied? Now get lost!!

Go f*** urself. It was your fellow country-men (a jerk desparately trying to immigrate to US) who was making nonsense incest allegations first in this forum about americans. Do you get it,IDIOT, before lecturing me?

I don't give a damn what your epics say or what you practice in India. All I pointed out was teh corruption in India pointed out by international agencies compared to western democracies.

dude, not a meaningful response. I asked you to give me the break up of foreign students. the report just talks about total number of students increasing. And again it nowhere gives data to suggest that responder thinks that reduction of h1 visa numbers is the reason. I will give you a very simple reason. It took tech sector a good 3-4 years to get out of the dot com mess!

Dude it seems you are not doing too well in IT but you should thank your stars that you did not consider the alternative career of law. you would have been massacred. your points are vague. you make utterances that tie yourself in knots and you throw words you know very little about. Start with naimg two indian epics.. next step find brahma there.

btw "f** u" does not qualify as an argument. you can thrust it where you are speaking from.
