04/10/2007: USCIS Updates 2008 H-1B Cap Status as of 04/09/2007 - Surprise, Surprise, and Surprise!!!
Somewhat very good news. It turns out the total FY 2008 H-1B cap cases which they received are not 150,000 nor 133,000. The total number is 119,193. Accordingly the odds of winning in the lottery will be only 2:1.
For U.S. advanced or higher degree cases, they only received 12,989 and the H-1B for these people is still wide open and they can file the petition now.

Do you or anyone who thinks that backlogs are due to labor substitution have any proof to claim so ?
Even if there were some, they definitely won't be in large numbers. First of all to use a sub labor, one labor had to become available. Do you think there were so many labors floating around to grab one ? I don't think so.

Well, There are many people still waiting for GC with original labor and not substitute labor with PD 2003 or prior to that. I'm not saying Sub Labor is the only reason, but it is one of the reason. Even each family member (dependent) would consume a visa... with atleat 2 visa per applicant, 3000 - 5000 total EB3 labor sub could easily consume 2 years quote... if you count all.. then the "U" in VB might make sense... For EB3 ROW, there are lotz of people from Canada, S. Korea, Thailand, Australia, UK etc, and it went 'U' from 2003... The dates could move well for ROW... but for retrogressed country, I do not see the bright side yet.... Also the 485 PD was current for all categories almost all of 2003 & 2004 till Dec 31 2004, It retrogressed starting from Jan 2005 and later.... Also, the total 140,000 is for all EB categories. Has anyone got an idea of unused visas from EB1 and ROW EB2?
It just can't be right the EB2 movement for India and China is hardly moving since EB1 is current and EB2 ROW is current since 6-10 months.
Which category does the unused/overflow visas go?
None of the lawyers I emailed have an answer (they like this retrogression btw more $).
USCIS doesn't care if a non citizen asks a question.

If you are serious about your proposal - please reach out to IV core and ask them provide the necessary guidance to take up this effort.
FYI - it's not easy to propose a bill but Sen. Jeff Sessions (R-Alabama) is your best bet. As much as you can lobby with his legislative office, you'll gain traction on your proposal. Good Luck!

I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US & came back to my home town. Have been working here for 6 years now in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh masters graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

I was just thinking and then this came up on me . How about sending a poster along with the letter campaign. I can contribute atleast four posters. They do not have to be full size posters ..can be just A4 size pamphlets kinds. We can just print them in color printer and send them along with the letters. These posters may make it to the press also as they will be funny and spicy for news. Actually, we can send copy of our letters to press as well along with our posters. If we make about 10 such posters, we can send one random poster along with the letter.

Can IV do something to talk to USCIS officials about I-485 cases (very few) being adjudicated at NSC.Recently, they lost a case for not adjudicating a I-485 for 4 years and the Plantiff also got $30000 for his lawyer's expenses.
I know it is for Aug. 08 Visa Bulletin people who became current, but EB-2 doesn't move, then no other groups will. The problem is with NSC.Please advise.

Please dear god..... let them consider priority date instead of the notice date. Mine is Oct 15th 2007. Our priority dates were current for three times and our application never touched, all our friends March 2006 to Jun 2006 filers got their cards a couple of years ago....:rolleyes:

Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.

abolish per country limits on EB visas will back fire us because of diversity issue. We should propose some thing where there is no controversy to reject and that's is recapture 200K visas and EAD/APO for 3 years
