Ease in immigration standards called for

Washington (UPI) -- A leader of a semiconductor company wants the United States to ease immigrations standards to make it easier to hire and retain foreign nationals.
Intel Chairman Craig Barrett, appearing on a question-and-answer forum on FT.com, said a market-based approach to granting work visas should replace the current system, which sets numerical limits on such documents.
Several leaders of technology companies have made similar requests of U.S. officials, the Financial Times said Wednesday. The visa classification that allows foreign engineers and scientists to temporarily relocate to the United States has a limit of 65,000. Some 140,000 green cards, allowing permanent stays, are granted each year.
Barrett said the figures are too low, pointing out the work visa total has already been reached this fiscal year.
'These arbitrary caps undercut business' ability to hire and retain the number of highly educated people in the field where we need to maintain our leading position,' Barrett said on FT.com.
Barrett suggested, 'We should just staple a green card to every advanced degree granted to a foreign national from a U.S. university in science and engineering.'

I have one questions based on this comment :

reason denied, it appears that there is no reason why they can not then
re-apply for adjustment using the other approved I-140 providing all the
requirements are met under the petition.
So lets say Husbands 485 gets deined for some reason and the wife has an approved I 140 but her PD is not current any more, can the substiution still happen or are the couple doomed?

Yes, it is for a job which does NOT require security clearance.
Is there a formal way / method to let the company and USCIS know of such discrimination ? Any published guidelines from USCIS ?
Your response would depend on how badly you want this job.
Most times the hiring staff doesn't know the law and are too lazy. Anything out of the ordinary, they just reject.
If you want the job, you don't want to appear like a trouble maker. So, you could just write back politely that you were surprised by the disqualification since the Department of Homeland Security (do not write USCIS) had issued the EAD and enquire if they know that DHS guides employers against discrimination towards EAD holders. You can mention or attach form I-9.
Alternatively if you want to hold their feet to the fire, you can contact a lawyer. Hiring a lawyer should get their attention. Let the lawyer contact them. And also let DHS know about this employer. Write to them.
In any case, we cannot let employers come up with their own laws after we have gone through so much to get to the EAD stage. The law is the law and we are following it.

Why kill the messenger ?? Yesterday when the possibility of mid month retrogression was brought up every one said it is nonsense. Now every one seems to be accepting and reconciling to the fact that there is a possibility that mid month retrogression might happen.
Give it a day and see as it unfolds. Although I hope this is NOT TRUE , I will not be surprised if this is TRUE. It is better we know about it in advance, how depressing this might be, than caught by surprise.

I believe if you get your Credit score reports from Experian and others, it lists all the addresses you ever lived in USA. You can get free Credit score reports from agency once a year.

I am seeing people getting multiple #A numbers and delays.
If you have filed multiple I485s, pls share your expiences here.
You mean you know of some people who filed multiple 485s in July/August and have got 2 different A#s?
We are still waiting for a response for our second application (filed in Aug). We had A#s on our I-140s so mentioned the same A#s on both applications and also noted in the second filing that one is already pending.

Yes, I send 7001 to Ombudsman. It's been more than a month since I sent it. Like I said, I have tried everything that was on the link I provided earlier except for contacting the first lady. I am not sure how contacting the first lady will make any difference, but I am thinking of giving that a shot too, so might mail out all my case details to them this weekend.
Don't go by the receipt date/notice date crap they are giving you. Last year (in September 2008), when the senator sent an inquiry, they said they were processing cases in order of notice dates and not PDs. On a daily basis, I would see hundreds of cases with PD/RD/ND after mine getting approved and all I could do is sit and watch.
I feel like they think they are not answerable to anyone and they can get away with anything. I hope something magical happens for you and you get the green card soon...

If these are pending 485 applications at USCIS, Number of pending applications with PD later than JUL 2007 should be zero.
If these are labor filings, they probably dont include dependents.

Do you know how much time it will take to get that status change? What if your PD is no longer current?
Yes it is a concern that I have to address. However I see 2 ways to work around it.
1. Travel out of country get H4 stamping done based on my current H1B status
or
2. I apply for I-485 and add my wife later to the application when we have received her H4. In this case, once I have applied, I can add my wife to the application even if the dates are not current at that time.

"Assigned to an IO" is misleading. Do you know if it has been picked up by an IO or is it just waiting in the holding area (both of these are called assigned to IO)? If it has been picked up, I am confident of the 30 day range, based on my discussions with NSC people. If it is waiting to be picked up, then it can vary a lot.
You can email cisombudsman@dhs.gov, but they will ask you to send 7001. If you have already done that, wait. I know how difficult it is, 'coz I was in the same position last week, but have faith and wait. The fact that Nov. VB has not retrogressed indicates to me that they really do want to clear the backlog as much as possible.

Looks like they do not publish the e-mail address to contact congressman. You can send e-mail only through contact your rep system where you can send only to your local rep. If your ZIP code does not match the congressman's district, then you cannot send him the mail. Even to Judiciary committee chairman !!!!!!!!!!!
