    Hi guys,

    Sorry, I bit the bait and got off track. Let us focus on the issue again. Let us agree on a time line and act accordingly.

    I would say, this week we work on drafting the letter (I took a shot at it, available @ page 2). Having 2 or 3 differently worded letter would probably be nice, but not necessarily.

    Next week we start mailing the letters. We have about 500 responses in the poll for EB3, so if we can get most of them to send the mail (email/fax whatever), it should be a start.

    We probably should start drafting a mail for our representatives/senators too, so that they too can follow up with USCIS.

    We will face a lot of opposition, ridicule and nasty posts, but we should persevere if we want to get our GCs any time soon.

    This is my view about how USCIS has messed up in name check delays.

    Name check PROGRAM that they might be using takes into account phoenetic spelling of FIRST and LAST NAME. Now just imagine, if your name is broken into 100 different spelling combinations and when your entire BIRTH YEAR IS checked against the databse--it will be surprising if there are no HITS. And to resolve those hits, pre-1995 records needs to be serached manually. There is no responsibility or time commitment by FBI or USCIS for the delay.
    This might be true for Asian names. The argument is-- the names in the databse are translations and therefore, they need to check accordingly.

    I BET they are not doing this for AMERICAN names, I mean for passport approval, they do not apply phoenetic program. I remember that FBI testimony included the discussion that they have set up appropriate filters for passport applicants (american citizens) so that unnecessary hits are avoided. Now this is my view and a discussion point. I may be wrong too.

    In effect, Indian and Chinese professionals are deprived of immigration benefits.

    Equally controversial is per country limitations in EB categories. If you do not select based on country of origin, you should not be subjected to per country limits because you are working for an american company and you are going to be american. Any demographic adjustment need to be made in diversity visa lottery.

    This retrogression in effect deprives Indian and Chinese professionals of their benefits.

    Justice and fairness has it that these problems need to be addressed. Abundant common sense and deeply practical approach that USA has, I am sure above problems will find attention. This great nation has always supported JUST and FAIR rules.
    I think Indians have outnumbered chinese over the last 2-3 years...
    Come October, the VB will be worse for India and Much better for China.

Considering this fact, Immigration Voice has proposed the following points to President Bush's administration to fix some of the issues administratively. I urge you to support our cause by writing a letter to President Bush, as follows, to implement these administrative fixes without further delay.

    I urge you to implement the following administrative fixes immediately to help the highly-skilled immigrants waiting their turn in a severely backlogged system.

    1) Recapture 218,000 unused visas wasted over the past few years administratively, in line with Congressional intent of providing 140,000 visas annually to our community.

    2) Flexibility in the USCIS interpretation of "same and similar" jobs, to allow promotions and job mobility. Current USCIS rule is restrictive and pushes the applicant to the end of the line, if they accept promotions.

    3) Allow filing of 'Adjustment of Status Applications', even when visa numbers are not available. This will not create an increase in visas, but will allow a number of immigrants to avail the benefits of changing jobs while waiting for their visa numbers.

    4) Increase the period of Employment Authorization Document (work authorization) and Advance Parole (travel permit) to 3 years instead of the current practice of 1 year. This will reduce the burden on USCIS and on immigrants. It will also make travel to an immigrant's home country easier during emergencies.

    5) Allow visa revalidation in the US as before. Currently, immigrants have to travel to their home country to renew their visas. If it was performed here in the US, it would be helpful in making it easier to travel back and forth during emergencies.

    6) Restart premium processing for I-140 applications. Now that USCIS has cleared the receipting backlog, premium processing should be made available. Without it, many immigrants are unable to extend their stay beyond 6 years, if their labor certification was applied for after the completion of their 5th year of stay in the US.

    I completely agree with your last 2 lines. But I don't agree with the even dividing of the number into 5 categories of I,P,C,M,ROW.
    Let's take an example. Suppose for some odd coincidence....the first 8000 odd EB3 apps that USCIS processes starting Oct 1.....none are from I,P,C,M. Suppose First 2500 are from Uk, next 2500 from France, next 2500 Germany and the next 508 from Pakistan. Now the number for ROW at this point would be 8008. Now they get another app from UK next. Will they refuse to process that app as the ROW figure had reached? Then they will still process more than 2500 for I,P,C,M. Won't that be unfair to UK applicants.

    As I have said a couple of times now, and so have a few others - ROW cannot be capped at X/5. Due to the high demand from I,P,C,M....it likely gets a MINIMUM of (100 - (7 X 4)) X EB3 cap.

    That was a ateempt to establish a "fair assumtion" so It may be wrong. But simultaneously you also should not assume FIFO within EB-ROW as you tried to explain as we really do not know whether USCIS follows FIFO.. Bottomline USCIS, by law, can not exceed 9% limit for any ROW based countries (Britain, pakistan,...) as well.

    yes, but july 2007 VB and the subsequent USCIS change related to approving cases with pending namechecks added a significant number awaiting for approval. Then a couple of months back USCIS woke up from slumber or had a shot of 100 proof single malt, re read some law and decided that the overflow allocation should be changed. The result is that there will be next to nothing for EB3 (for that matter EB2 will also have less overflow available) as they clear the backlogs, i doubt anything besides a recapture in the short term and a significant rehaul in the long term will work...i hope i am wrong but EB3 I and C are in for a long wait.

    For last 10 years EB3 took numbers equally from EB2 and EB1. Even when EB2 was retrogressed EB2 numbers where made available to EB3.

    For those who are wondering about medical exam for pregant spouse. I had medical exam done for my wife (and we are expecting). Doctor decided to take Blood and TB skin test. He also decided to do blood partision exam (which will tell whether you have particular immunization done or not as a child) since we didn't have immunization record. It costed $400 (includes lab fees etc) in IL. He wanted us to come back after 2 days for TB result and after one week for blood test result.

    On the real risk of inviting personal attacks, being called Darth Vader of pessimism and negativity etc,

    i would humbly request yous guys NOT to mess with AC21 UNLESS you have legitimate grievances, and bad things have happened to you / people know to you because of AC21.

    A lot of us have used AC21 and consider this one of the few points in our favour. Please do not make it any worse than it is.

    please ignore the dots...the important thing is to make the lawmakers aware of the issue. As mirage mentions we should send a letter to the rep Logfren, (i have mailed the letters), we just want them to be aware that there is an issue, ROWs please send them too, you will also be impacted. Nothing against EB2's or the comments they have passed so far, we dont want to undermine your visas, the idea here is simply to make the lawmakers and DOS/USCIS aware of the problem.

    In a way DOS/USCIS have opened a pandoras box because EB3 as a whole will see slower approvals leading to a larger number of countries stuck in the process across a spectrum of countries. earlier it was mainly india, china and mexico. If visa allotment policy holds then you will see more countries getting retrogessed.


    Some one gave me this comment saying



    Show me where have I undermined IV efforts? And show me nonsensical or counterproductive posts that I have made -- that is, nonsensical or counterproductive to the cause of upholding the law (not pandering to a particular employment category/chargeability area).

    I have done my homework, and I have understood the law properly. I have time and again given logical proof, along with the text of the law, as to why EB3 is eligible get the EB1 numbers at the same time as EB2. On the other hand none of the detractors have provided proof, or material that shows EB3 does not qualify.


    And for all those holier-than-thou EB2, what is about the letter campaign to get NSC/TSC to process application according to PDs (no lawful basis for that), and asking the removal of NSC bosses and what not. You seem to have different standards when you are suffering, and when others are suffering. There is a word in the dictionary for that, look it up.

    I had soft LUD's yesterday (9/19) on all I-485 applications in my family and on the (July 2007) EAD's for my spouse and me. My PD is May-30 2006, so I'm wondering if they are looking at low-hanging fruit for the next month (or to hang the fruit!)


    Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?

    My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

    Based on what the person from Rep. Lofgren's office said "there would be vote in two months", does it mean really the Sept. 26 is not "the last" date for this congress? Would there be a lame duck session? And then of course for all the politicians lame duck session would be the best opportunity to tackle this.
    From the link posted by 'polapragada', the person in Rep. Lofgren's office said that there was opposition. Nothing is coming out from IV core or any of the known sources. Obviously this is becoming an uphill battle but there is still some hope. The only and I repeat "the only" thing that we can do is contact all the judiciary committee members and express support. I feel we should also call Lofgren's office, Sensenbrenner's office, Pelosi's office to express support.
    Please note that the very fact that McCain is a republican nominee proves that these NumberUSA and FAIR are minorities even in extreme right wingers. They are just noisy.
    But as I have said our call campaign has been pathetic and we should be doing at least 100 times better.
