I read your post, and your thread. All the way down to what the definitions of "is", "and" and "or" are.
First of all, lets keep the discussion civilized. Lets not comment and post on what other people think, or what their motivations are, or how biased or wrong they are.
I think we all agree that the current situation is that unused EB2-ROW numbers are flowing down to EB-3 ROW, and not across to EB2.
Regardless of what the definition of "is" is, EB-3 ROW will like things the way they are, and EB-2 India would want things to change in their favor.
Lets not fight over who should get more crumbs. Lets work to increase the size of the pie.
Lets figure out who is getting screwed, and big are they getting screwed. And then reach out to those who are getting screwed, and get them to contribute and join IV and participate.
Mr Unitednation takes the advantages of ignorance (in immgration law) of most of the forum members and spreading wrong information in both web sites.
Of course he is very informative, however he is very biased and having wrong openion that EB3 India has stolen EB3_ROW number in previous years as he belongs to ROW. He wrongly assumes that till EB3-ROW becomes current EB2 & EB3-India will not see any movement. He thinks no one knows the rules, laws ect..and he is only one knows everything. The actual fact is most peoples have been doing research on retrogression like him last two years and not having enough time to reply his post. To fuel his openion DOS is violating the section 202 of INA and no one cares about this including IV core team.

My application with my current employer under Advanced degree cap reached Vermont on April 19th, but didn't make the cap!!!! I do have another application through another company that reached under the cap but is still pending. So, I think I will reapply with that receipt notice.

This thread brings up a good point - of labor reuse & misuse in yester-years.
Incidentally there are many who have never seen a glimpse of what is inside their labor certification as the employer & their lawyer still refuses to share it with the candidate. And i am not talking of the oft-bashed consulting companies.
For the candidate - who continues to pursue the American dream, it is:
1) Not Transparent
2) Subjugation to the whim of Employer / Lawyer
3) Non compliant to a common code implying a non level field of play
Thereby Unfair.
In my humble opinion - should be part of the core argument we have against the system.

I have a question regarding "out of status" situation for me
Here is my employment history.
1/1/2001 - Enter USA with H1B from Company A
1/30/2001 - Offer letter from Company B (No pay checks from Company A)
2/9/2001 - Started working for Client via Company B (Got Pay checks from Company B)
4/2/2001 - Received H1B receipt for Company B
5/25/2001 - H1B approval notice with validity till Jan 2004
Nov 2001 - H1B Transfer Approved for Current Employer
Feb 2003 - Re entry to USA

1. I am out of status till 4/2/2001 or May 2001?

Thus, as curent processing times are at August 23, 2007, dwhuser case file is yet to be opened. Since file is not yet opened, no one yet knows his/her PD (it is nowhere other than on paper files). So the case waits - his/her PD may get current and pass.
Why so? Because USCIS prime systems are not designed for huge volumes, or PD's so much in the waiting.

Coming to the Infopass....I'll have to drive 5 hrs to go to the nearest office and a loss of pay leave for a couple of days. Not sure if it's worth the hastle :)

Yup, issues regarding passport should be taken seriously. We need to keep track of all dates in and out of US, name change, correct names, spell check etc., otherwise it will delay the process when time comes.

Thanks for the replies. I guess, I do not have time to get all that done before I file the I485. Damn, should have taken care of it earlier. I guess I will have to fill the forms just as I have done for the labor and then hope that I am not stuck. Will follow up with my lawyer to get some legal advice too. If I learn anything new, I will sure post.

What I and the majority of people in this forum do is their best to make sure they dont loose their status. If on the other hand it happens I would return to India and consider all options to reverse it. What I and majority of people here wouldnt do is stay here illegally.
Even if it happens I would ask for food as a favor from some one rather than break into their house and demand it as a right!
I dont hate them, i just think what they do is wrong and they shouldn't be rewarded for it. If an illegal comes asking for food, I am pretty sure every one will be happy to feed him. But if breaks into my house and starts raiding my refrigrator, he better watch out.
You are a senior member of IV and I know IV has concluded that any chance of meaningful immigration reform goes hand in hand with that of the illegals. I understand that, and have made contributions as and when i could to IV. But that still doesnt make illegal immigration "right".

Your analogies of breaking and entering a house/raiding your fridge are incomplete/shallow and hopefully you will change your perspective after reading the history between these two countries.
Nevertheless, it is what it is today in terms of geographical distribution of land and I am not suggesting, Mexicans have rights over California/Texas. What I am suggesting is that motivations for what people do can vary a lot and folks like you and I who come here on H1/F1 or whatever after completing our fancy degrees, can never understand certain ground realities. Looking everything via a legal/illegal magnifying glass can get you only so far. Basic respect for human life is extremely important without which there will be no difference between us and barbarians.
As you have started going this route of discussing the merits/demerits of this case and comparing with our situation, I would strongly recommend to let this go. You and I and many others here, do not have the knowledge of discussing these complex issues.
The sheriff's treatment of illegals has little to do with law and order and has more to do with his personal hatred for Hispanics. It is documented where the Sheriff has made statements to the affect of calling these folks animals, disease carrying, who smell and dress up like animals etc. Shackling a pregnant woman when she is delivering is another example of the same attitude. You condoning that fact by statements like "woman is perfectly capable of delivering with a leg shackled" is just pathetic. It is not always about your 'legality/illegality' or your brilliant career or fantastic green card. Just pathetic.

Ok, been thru this also recently.
As these days your photo comes printed in the passport unlike those old days when they used to affix the photo with gum. Hence, the new size 3.5 cm because i think they scan it and computer prints it.
To answer your question, at NY the correct size is 3.5x3.5 cm.
However, they are accepting 2x2's as well, but the downside is the computer cuts it to 3.5x3.5 cm hence showing ONLY your face without a little bit of neck or shoulder. This photo does not look good, i have seen this happen with the same guy that i mentioned in the above therad.
I took both 3.5x3.5 and 2x2, they didn't care, but i gave them 3.5x3.5 as it was stressed in the NY webpage.
Now, getting 3.5x3.5 cm photo is a PAIN. I went to PicturePeople and I had to find a really smart guy to do that job for me. At the counter, they just plainly refused to do that.

If you're worried, the easiest thing to do is to have the name changed in the passport. The Consulate doesn't ask for any questions and issues the new passport within a day. For my friend, the first name and the last name were interchanged and getting the new passport was a breeze.
