    I am telling you, this is all great!!. It is working, do not doubt it. It has to be this way for a news story. This makes a great story. Also canceling orders sends wrong messages, we care for the troops fighting for us, Why cancel.

    I think that is a smart response from USCIS. The good news is, it will not backfire the way some people were wondering... and also that the media will cover it.

    The question is how would you identify which jobs are genuine and which are not. In addition, the question the porting comes at I-485 stage.
    So in other words there could very well be job out there and you won't know till its I-140 is approved if it is for porting reasons.
    Also, a good/established company may most likely will not file a new labor and I-140 for a person because it an unncessary expenditure for them.
    So guess who are the people who are most benefitted by this...

    Ok. I am finally beginning to see your point. If the objective of your exercise is to eliminate alleged non-genuine EB2 jobs, that really don't exist, but are simply advertised just for the sake of porting by unscrupulous companies who stand to gain money by this, then you certainly are making a valid point.

    But I still do not understand how a lawsuit will help? Was the labor-sub elimination the result of a lawsuit? Also, I would be concerned about lots of other valid/genuine companies who really have jobs for BS + 5 years experience ...?

    Does anyone understand what is used to calculate the 3 year period for advanced degree olders?

    Is the end of the three year period considered when you applied for LC, or when you apply for 485/140? Since, technically, people who are pending at the BEC as well as those who are affected by retrogression are still on NIV, and have not applied for immigrant Visa yet.

    This point will have an impact on a lot of folks who may have applied for LC less than three years after getting their Degree but would have crossed that limit by the time they can apply for the immigrant Visa.

    Good. Initial Review can jump to CPO as it is literally a matter of 15mins for the Adjudication Officer to approve the case!

    Up until last year till the pre-adjudication was restarted, almost all cases were first look to approval.

    Multiple 485 and EAD filing

    Hi,

    My wife and I both got our LC approved. She filed I-140 and I-485 concurrently for both of us in Nov.2006 (Nebraska Center), based on her LC. Then I filed I-140 and I-485 concurrently for both of us again in Jan,2007 (Texas Center), based on my LC.

    The EADs she applied got aproved pretty quickly. Several days ago, my EAD applications got denied. The denial reason is, we already have approved EAD.

    Originally our plan is: My wife will switch to a Finance related job soon (her LC is based on Software job), I will wait for GC. (The reason we still filed for multiple 485 and EAD is that we want to postpone the decision on who should wait for GC). Now I'm totally confused on whether she can use the EAD, and whether I can renew the approved EAD (because they are based on her application).

    Any inputs or clarifications will be greatly appreciated.

    Yup. One should be ready for the consequences when they apply. Think carefully before you do something and do not make any errors in decisions.There are both advantages and disadvantages. A lawyer office that has done this in the past quoted a case to me. Another non-desi expensive lawyer who always gives accurate information and is not greedy told me that he would not advice multiple filing.

    Thanks guys .... for coming behind me .. Shane Warne or Purple Haze won't satisfy you guys .. Y dont we discuss how Kanimozhi's discontent couldn't play spoil sport for the new govt and how Azhagiri got cornered with chemicals and fertilizers (these 2 are not any interntaional fame for an american 'tunnel rat' to know abt them).

    Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.

    Don't worry buddy.. I am sure these guys were only pulling your leg.

    Yeah I am sure everyone should stand up against violations . It doesn't matter if it is done by Americans or Indians or any other national. Just because most of the L1's in this particular case are Indians there is no reason to turn a blind eye to someone breaking the law.

    So many consulting companies are offering H1-B resources at 40 to 50 dollars per hour.

    Actually you should consider yourself in the same group as these so called stupid people, cannot exclude yourself as a smart person just because you did not take an ARM. Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.

    Here is some real advice:
    Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

    You are not the only one who thinks this way! Do you want to stuck with your house...paying 600k mortgage for 300k worth house? It is stupid people like you who would, I won't!

    Those who are walking away are smart. Banks are stupid to finance 100%. If you go bankrupt, govt won't bail you out. If banks go belly up, govt would give 750 billion!

    Keep your emotions checked. Do not talk like you haven't returned anything in Wat Mart if you found same item 25 cents cheaper somewhere else.

    This is the reply from Attorney Murthy on a question asked on Murthy chat about filing two employment based I-485's for the same beneficiary (not the husband/wife situation).


    "Generally it is safer not to file 2 separate 485s since it can confuse USCIS since they may assign two separate Alien or A numbers to the same person. This could end up delaying the person's I-485 approval down the road or create a security delay in many cases with multiple I-485s generally we recommend one case to be filed as an AOS and the other for CP if possible."


    After much research on this, I tend to agree with this answer above (not the CP part though). As per my latest information from a lawyer who does multiple filings, the processing delay can be significant due to this. Looking back, wish our community had more information on this and more real examples of people who have done it. It would have helped members who were unsure if they should do multiple filings.

    Anyways this thread will be useful for future I485 filers.

    I am curious to know what USCIS actually does when they adjudicate adjustment of status cases. I know a security/name check is done when they have your fingerprints but what else? Do they use your social security number to look at your credit history or do they contact the IRS for transcripts of your tax returns etc, how do they verify information on your employer etc etc? Does anyone know what procedures/actions USCIS takes when adjudicating cases? Thanks...:confused:

    There seem to be 19 applications from 1998 and 25 applications from 1999. I wonder how come these have not been approved in 10 years while their dates have been current almost all the time. Either these have been abdandoned or are not approvable.

    I think its time for USCIS to do some cleaning up also to close applications where the applicants are no longer there , have abandoned the applications , left the country and so on. That would surely reduce some of the stuff from the queue.

    The Priority Date refers to the date your Labour Certification Application (LCA) was filed and the I-485 Processing date refers to your Adjustment of Status Application- specifically, it is the filing date of the I-485 application(s) that they are now processing. Translated, that means about nine months to get your Green Card once your PD becomes current. Fortunately, the processing time for an EAD in Nebraska still stands at about 2.5 months.

    If you get different A#s then definitely there is a possibility of delays in the application.
    I am not sure what happens with namechecks. Need to research further. My guess is you will have double chances of getting stuck in namechecks! This assumption is based on the fact that multiple filers need to undergo fingerprinting and background checks multiple times and thus chances of getting stuck in namechecks must also increase for them.

    i heard from my lawyer that we shoud combine them...will talk to him again on Friday...lets see wat he suggests...

    does anybody know the process of combining or withdrawing one set....
