    We could also do a signature/petition campaign that would focus on 'American Citizens' supporting our effort. We should aim at getting a lot of signatures. Afterall there have to be hundreds of thousands of formerly H1B holders who are citizens now; at least they would support our effort.

    Another question, i got my I140 approved from Texas center although filed at NSC (premium processing). Will my I485 apps also be handled by Texas or they are independent?

However, an I-485 application filed to accompany a currently pending I-140 petition would be filed either at Nebraska or Texas, depending upon which service center issued the receipt notice for the I-140."

    According to this, I guess your I-485 should be handled by Taxas service center. But don't take this as the final answer. Check with your lawyer to make sure.

    dude, how many immigrants/H1/L1/GC/Gc->US citizens work for google/Msoft/Yahoo. And if you are naming these corporations as the benchmark of success/technical excellence why do you not listen to what they say about visa programs?

    In addition why have these companies set up big shops in India. Although the innovations didn't happen there and there are several valid reasons for that, but just the fact that they have big footprints there means that they are able to find talent there.

    Dependent case is being worked on though..he said we should get approval notice in 3 days.

    I don't think it will do much good sueing uscis on this issue. The point is, they have the legal authority to be the one interporating the law. So, if there is "gray area" in the law, the law says it is their understanding that matters, not ours or any one else's. So, unless the law very specifically says it must be done in another way, you can not argue uscis did the wrong thing.
    Now that we see the immigration law does not very specifically regulate how the flow should be like, so uscis have the authority to "understand the intention of the law" and act accordingly. You can't say you think the law means otherwise and thus sue uscis, because that argument makes no sense to the court. The court will only accept the argument when the government is apparently acting against the law.
    Absolutely, I have seen misleading comments especially from EB2 guys. EB3 have to do something otherwise there is no future for us here. Now EB2 line will never end bcoz all new applications will come as EB2. Hoping for spillover after EB2-I becomes current is just a dream now that never comes true.

    Hi,

    I'd appeared for my H1B (F1 to H1) Visa interview on the 4th Jan at Mumbai. After almost 4 hours of waiting, the visa officer told me that they were unable to view/ verify my I-797 info as it was not updated in their Database. I was also told that this is an existing issue and that I should ask my company lawers to contact the Immigration Services office at DC. On being asked she told me the eta was 7-10 business days (or however long it takes for the info to get updated). I was then given the yellow slip and asked to submit my passport for stamping, after I receive an email indicating that my data is now updated. it's been 8 business days since my initial interview and I still haven't received any emails or calls.

    1) anyone who interviewed on or around 4th Jan who has received a call or email?
    2) Anyone who's aware of the procedure by which my company can expidite this issue (maybe through our lawyers)
    3) any additional info on how long the wait might be?

    I was told that on the 27th dec there were about 350 H1b pending cases (yellow slip) at the Mumbai consulate and around 150- 200 similar cases the following days. A freind of mine who appeared for his H1b interview on the 7th breezed through it with no issues.

    Vonage has a contract of 1 year. Have to pay around $100 if you break the contract.

    Lingo has a contract for 2 years. Will have to pay a similar contract break fee for Lingo as well.

    Monthly charges for world plan: Lingo is cheaper than vonage
    Voice quality: Vonage is slightly better than Lingo. Lingo is ok too.
    Customer service: Vonage is better than Lingo
    Contract Period: Vonage 1 year. Lingo 2 years
    Plan selections: Lingo has more plan selections.
    Cheapest plan: Lingo $7.95/month for 250 minutes america plan. Vonage $17.99/month for 500 minutes US plan
    I just switched from Teleblend to Vonage. This is the first time and don't have any experience with them. I talked with them yesterday and their customer service is connected immediately and they are good (for now atleast). I was a lingo customer long back (before sunrocket) and their customer service is horrible. I tried to switch to lingo when Sunrocket was closed and had a bad experience with customer service rep that time too. I decided not to go with lingo ever (what every offer they have). I may consider go back to teleblend, if they have a good deal OR any problem with Vonage.

    Punjabi is not returning it to actual seller but it is returning it to Bank which is not a seller of that house .

    This is directly not going to impact your I485, indirectly it might if you get pink slip in your new job and then you try to get another job but they reject it because of foreclosure while doing background check. And if you remain unemployed for long time and USCIS rejecting I485 application.

    Also you might end up paying more in future instead of saving anything out of this entire foreclosure ..



    I got your point and I difffer with that. Your point is-only defective items should be returned and I am saying it doesn't need to be defective. As long as you are not completely satisfied you should be able to return it and price is an element in customer satisfaction. That's why stores do price match so you don't need to return their merchandise. Stores that don't do price match deserve their goods to be returned.

    Also, I didn't put words in your mouth. "Returning used merchandise is a fraud" - these words came out of your own mouth. Check your own post.

    Below are the list that I have from my lawyer to prepare my I-485 :

    1. for Evidence of status you need a Copy of Last Entry I-94
    non immigrant arrival/departure record, showing your admission
    to the US and current status. (Front and back, make sure the date is
    clear to see)

    2. To show that you are always in status while you are in US you will need
    Copies of all immigration related documents from USCIS
    (such as I-20, OPT, H1B, H4 approval notice, or other status)

    3. Copy of Birth Certificate
    (need translate & notarize if not in English)

    4. Copy of Marriage Certificate if you are married
    (need translate & notarize if not in English)

    5. Copy of Passport pages with non immigrant visa
    (including all passports you have used since the last entry you need to
    copy all the stamp you had on the passport. Again this is to show the
    last time your in you US and to make sure you are always in status)

    6. I-693 (Medical Exam)
    (You can dial 1-800-375-5283 to choose the physician list)
    you will required to show a proof that you have take MMR, Varicella, Tetanus and hepatitis B
    if you can't show any proof they will required you to take it on their office and it will cause you quite a lot money ( you can take
    the vaccine earlier on your family/ regular dr. office and could get covered by you insurance) it could save you $300 per person.
    the mandatory test you have to take at their office is tb test, blood test
    for HIV and syphilis and regular phisical test. once you have all vaccine
    and the mandatory test they should gave you the seal envelope to send to USCIS along with your other document and they will give you a copy as well.

    7. If you apply for your family member you will need
    I-134 (Affidavit of Support) stamp by Notary for each family member

    8. Employment Verification Letter
    Employement letter on the letter head of the petitioning employer
    which confirms that the job on which visa petition is based is still
    available to you. The letter must also state the salary that will be paid.

    9 . Photos (2*2 color front-view passport photos)
    *2 for each I-485, additional 2 for each I-131,
    additional 2 for each I-765

    10 Fee Payment made to USCIS (1 per applicant)
    $325 for each I-485 filing fee
    $70 for each Fingerprint fee
    $170 for each I-131 filing fee (if apply for Advance Parole)
    $180 for each I-765 filing fee (if apply for Employment Authorization) .
