I would like to propose your name for Nobel Prize.
Well, you can do PD porting :D :D. Adopt a 16-17 year American citizen kid(?), and you will be good to go soon. I guess you cant really adopt people beyond 18 years, but if you can, it will be like PD-porting to EB1 !! ;)

High time this bill is passed. Too much fraud in L1s and H1s.Existing H1s dont have jobs and our green cards pending and no hope when it will come. They should really make L1 very very hard because I work in a huge wireless company where they get L1s from companies like TCS and they work 15 hours a day with $25 billing rate, because of which all contractors and permenant workes (on H1, GC, EAD etc) are being laid off
I wish this bill passes with full effect

@vj i would surely unmask him here , gimme another 10-15 days i will reveal everything about him pal , dont worry.
@bugsbunny i paid about $4200 for the process , he said some attorney fees and stuff
Does someone have an experience of application process, so that i send in the right papers, before leaving here. i mean the set of documents to send to DOL, so that i do not miss out on something important which could nail him to the maximum

Anti-immigrants can not be able to pick on this, because Retrogression will worsen all these things. Those people will continute to work with those desi consulting companys irrespective of the fact that they have GCs or not, because they cannot stand on their own feet.
If the retrogression goes away then people with good skills can move freely in the market and will be more readily available to the market. In fact that would harm thse companys big time. Currently both good and not so good people are hostage in the hands of these companys and these companys are sort of dictating the makket conditions.
In economic terms the difference is same as Free market and monopolistic market.
could it be that their products work for less? I am not suggesting this: just pointing out that an anti-immigrant will pick up on this to further his cause. anti-immigrants use all kind of stats to show that their products do charge lower rates.

the revised version is more pointed.
Here are a few other points to consider and highlight:
- That the woes of legal high skilled immigrants are completely forgotten
- Despite the fact that they pay taxes, social security etc
- They represent a continued American heritage of immigrants chasing the Great American Dream
While H1B workers might appear to 'displace US workers', the crux of the issue is that in order for US companies to remain innovative and competitive they cannot afford to take a hoary protectionist policy in talent management.
High skilled talent finds level ground, wherever it might be.
While the old world order was about national boundaries and international competition amongst countries, the new world order is about a flat world where transnational collaboration and commerce can enable wealth and job creation in any part of the world!
The presence of high skilled foreign workers INSIDE the US
- ensures that jobs remain in the US
- ensures that resultant taxes remain in the US
- ensures that resultant investments target the US economy
- apart from ensuring US competitive and commercial advantage
The oft repeated arguments about 'local talent being available but not tapped' is borne out of a sense of elitist entitlement; something that runs counter to the great American Dream and the quest for constant innovation, creation, improvement and execution.
The need of the hour should be on how to enable successful assimilation of high skilled labor and talent into the US economy such that the economic engines of efficient productivity are not hampered by artificial tarrifs and barriers borne out of a broken immigration system.
The quest for a color-blind, talent-oriented, country-agnostic immigration system has a long and sometimes troubling, history.
While the old world afforded the luxury of years to rectify imblances and imperfections in policy constructs, the new world leaves little room for inefficient alignment of policies.
The need to fix a broken legal immigration system is as much an economic reality as it is to address detrimental effects in womens' rights (spouses' rights), labor rights and free markets.
Folks, Sorry, The petition can't be changed even if it has 1 signature. It has close to ~700. I plan to stick with this. This petition is about that particular show. You are free to start another petition highlighting general issues with Lou Dobbs.
Again we can have several petitions and send it to CNN. If we have enough numbers there will be ample pressure on Lou to state the facts.
As far as CNN hiring H1-Bs is concerned it is an example of exposing the double standards within Time Warner Inc. I believe this petition is going to make the intended impact. You are free not to sign it.

I agree. All these are "workarounds" that we are asking for - such as letting spouses work, let us change jobs freely etc etc acutally just amount to asking for all the benefits of a green card without having one. IT detracts from our primary goal and puts us on the defensive with respect to anti immigrants - we now not only have to defend the utility of H1s to the US economy (shortage of technical skills etc), but even H4s and so on ..
thanks for explaining. my suggestion then is to go to school on F1 (maybe ?) and get a degree that can help him/her get a job that qualifies under H1b.
Our main goal to solve the retrogression problem.

I think even if we do not go as far as monetizing every aspect of IV (which I also think we shouldn't) but there should be certain privileges, which should only be there for paid members. If it pisses off a few souls, let be it.
I think, this is the least we can do as IV members, i.e. contribute (and I am sure $20 a month is not an amount folks cannot come up with) but I guess they must be enjoying the free lunch. Let them enjoy it but take away the privilege of posting new messages and getting there questions answered when they cannot even help themselves.

Do you have a copy of the H1B application?
It should show a lot of details about the employer and also as to who prepared the forms(attorney info if there is one)
As i said if the company itself has done the work themselves with a full time attorney...then the company is fully liable...if the company has hired outside attorney...the company is still liable...but the outside attorney would also be liable for building fake cases.
There is also a law that if the H1B employer has terminated your services before the estimated time your service was required then the employer has to pay you the transportation costs for your return home.
Please read the following articles for information on the H1B process

MurthyDotCom : Overview : H1B Visas (Part III) 6-year Limit, Portability, Etc (http://murthy.com/news/UDh1iii.html)

See how Numbers USA propaganda
They are saying these bills grant Amnesty.
I pity them.

http://www.numbersusa.com/content/
Please contact your U.S. Representative through the Capitol Switchboard (202-224-3121) and ask him/her to do everything possible to stop the passage of three bills in the House Judiciary Committee today: H.R. 5882, a bill that would add an additional 550,000 permanent green cards; H.R. 5924, which would add 20,000 additional foreign nurses per year for three years (plus their families); and H.R. 6020, which would grant amnesty to the illegal-alien spouses, children, brothers, sisters and parents of all 23 million U.S. military veterans
Can we sue this guy from NumbersUSA for misguiding American public and creating hatred against immigrants ?

Yes but do note you do not have endless time to file a complaint. I don't know how many months you have to file a complaint after leaving your job but I know for sure there is a time limit.
QUOTE]
I think its 3 years from the event, that you have to file a complaint. If its past 3 years, you cannot file the complaint. The event may be such as you left the employer and your employer withheld your last paycheck(very common issue with desi consultants) in the name of covering your H1 expenses etc.

Those who are celebrating .. consider this.. your employer decides for any reason to not continue filing I-140 or decides to let you go in 6th yr.. earlier you used to have at least possibility of sub labor.. now you are basically straight out of luck.. Also if microsoft needed some genius from China or India to join their team and the guy obviously deserves special consideration due to business need and/or his talent.. they are stuck..! It's not good.. yes desi folks were selling and buying these but remedy is worse than the defect.. they could have made changes to rules to make it stringent and almost impossible to get but no reason to place such arbitraty deadlines etc.. if H1B and GC is geared towards desi consulting.. it's should not and will not exist in the long run..

Felt EB3 category looked like a lost category, when the EB2 approvals was at the top all the time in our recent forums...
yep, not a single eb3-485 approval, be it ROW or China or India..

Masti_guy - Don't worry about not having an MS. If people with MS move out of the queue the queue will autmatically move forward. There are a number of MS engineers working in EB3 positions especially the one who have never changed employers after they got out of school..
