i bet it was pretty interesting to negotiate directly with the WH and DHS. kudos. i guess we now have this to build on for future... perhaps one of our next goals will be to expidite namechecks for all these new 485 applicants? ;)

I just talked to a NSC representative and he told me that my case is sent to extended review. Now what is this extended review?
Well, what annoys and confused me is that when I took Info pass day before yesterday she told me that my case is with IO. And now NSC rep is giving me another version called extended review.
Don't know whom to believe.
Does anyone here had same exp.
My ex-collegue's application went to extended review - Per his inforpass and csr calls experience, he beleives that the application was pre-adjudicated and the namecheck/security clearance completed. A month later, he received an RFE on his 140, 140 RFE replied, 140 denied w/ reason of "token employer" and hence 485 denied. So, extended review based on what I heard - they may be going to each and every page in your file or may be not.

I am of the same opinion. We must make presentations to the Foreign Affairs Dept, Justice Department, Presidential Nominees and the Current President and seek from other larger Indo-American, Indo-Chinese Organizations to highlight our suffering. It does not matter whether we are EB2 or EB3 from India or China. What matters is that this is great injustice. How many members of these departments would accept living like us in a country like USA? Are they ok with living in the uncertainty like we do? Will they accept being in the same pay bracket or at the same job level for 5 or more years and that too is not certain? Can they keep their life on hold particularly in the prime of their youth, the way we do? We must remind them how many documents and how many verifications we have to go through to get to the GC (right from F1 or H1 stage). On top of that when the depts life USCIS which are created to facilitate Immigration, turn their backs on us, what does the US Govt expect from us? What does the US Govt expect us to do when DOS second guesses everything that USCIS does and readjudicates and harasses visa applicants through the consulates (with unending and unaccounted for visa stamping delays)?
I have created a spreadsheet with visa bulletin data for the last one year. Anybody with some sense of justice and fairplay can easily look at the data and say that there is no order and no justice for our plight. I created trend charts for EB1, EB2, EB3 and ROW but these did not get uploaded properly. If somebody wishes to try again and recreate these and some how publish them, these charts could be used to communicate our plight in a very simple manner.

I think we should propose to the administration that in view of this unprecedented chaos in the USCIS, DOS, the Congress (on immigration issue) and by implication our lives, they must delink the GC process from being linked to an employer and to the level/skill level/pay scale the LCA is approved for. By linking the process to sponsoring employer they are promoting indentured labor and by forcing us to file new LCAs/ restart GC process for each promotion, they are just being anti-immigrant and anti-progress.

I just spoke to Indian consulate, NYC. The procedure to correct the last name is very simple. All you need is an Affidavit from the person (Signed in US, saying that you are correcting your name.), 4 photos and a copy of 797 or Visa. No need of advertizements, or Indian affidavit.
Please note, this is applicable only if,
In your passport Surname is Blank
Given name has <first name><last Name> (and all spelling etc are correct)
and you want it to be corrected to
Surname <last Name>
Given Name <First Name>
They will issue a new booklet with corrected name. It's same day service in NYC.
Sent you a PM, can you reply back.
Please note, this is applicable only if,

as per my under standing if u didnt apply for change of status,then your h1 papers didnt have i94 attached with them when they were first released,they might have asked you to go for chennai for stamping

As i said earlier, i relied too much on my employer as istated to him in the first place to do a change of status Visa. They didn't do it, and as i was under the impression that i didn't have to go to India to get it stamped, i didn't leave the country so far and worked all these days. The ugly thing is that even my employer didn't ask me to go to India and get my Visa stamped in India, but he did find projects for me and produced pay slips all the time so far. Now, i found out the mess i am in, that too because i was ready to apply for I-140 and I-485 together. The immigration attorney who is preparing my I-140 caught my out of status situation and all the hell broke lose. Is there a way to seek an adjustment n my status from INS based on the fact that i was eligible for Chnage of Status from L-1 to H-1 in 2005, but mistakenly, i got a H-1 that was supposed to be stamped? Would they consider any such cases? Is there any example of anybody whoever did it???
And even if i leave the country now, would i face any problem in next three years, if i attempt to come to USA on a new H1 next year, with a new Visa?
Please provide me some advice if anyone knew any situation like this before?

Here is a letter I drafted that I'd like to send to the Ombudsman .. could you'll help me edit/revise the content and also, please provide me with the contact info for the ombudsman?
we could also write letters to highlight this to Congresswoman Lofgren as well as publish it in media outlets?

provided by the USCIS and the DOS. There have been numerous times when there have been erratic movements in the published visa bulletin dates. As a result the DOS either under- or over-estimates the number of applicants available for adjustment of status. When the date moves forward by too large a window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that???
Indian employment-based immigrants are tax-paying, law-abiding, educated individuals contributing to America�s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:
1) Extended wait times at each step of the immigration process.
2) Lack of transparency on the part of USCIS.
3) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).
While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled � we are bound to our sponsoring employer from the start to the end of this extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later.
