My H1-B was extended in October 2007 for three more years. My wife went to India and is going through this PIMS BS now. Chennai Consulte applied on Feb 6th. Some cases listed on this forum are scary as hell. Called the VFS office, all they say is they have not received the pp. After four days got the number for the consulate from VFS. Calling them daily. Same story, with each passing day, I could sense the increasing irritation in the voice of the consulate personnel to my questions. I wish I could talk to them in person and vent out my anger. This afternoon I called the DOS. The number is 202-663-1225 incase anyone needs it. I explained my case and asked her if they are missing any information. The reply: No your VISA looks fine. Then the robotic answer, PIMS verification is under process.
I think VFS should specify it on their website and warn people about these delays. Warn people about the PIMS BS and suggest that they should not make any travel plans till they are sure this PIMS BS is resolved.

File a 7001 form with the Ombudsman's office. If I remember right, IV had sent in a recommendation for the USCIS to send GC in secure mail.
An official complaint (instead of just email to ombudsman's office) will reassert IV's recommendation.

Everyone that took part in the IV lobby day in September 2007 should get in touch with the lawmaker offices now and request them for letters. If you have met your local lawmaker offices through state chapters or on your own, it is time to visit them again for this request.

I am also from India but the point I am discussing here is clearly a violation of law by Outsourcing vendors including IBM (not just Indian companies), TCS, Wipro etc. I work for a medium size consulting firm based in US and on H1 visa ...and I am impacted by these violations and I think I have the right to oppose this act.... to prove my identity shud I tell you my stories in Chennai consulate... or shud I tell u abt my days in b'lore or shud I tell you all abt my 24 years in India.. you can decide :-).
BUT regarding the L1 violation we have decided and this time the vendor is exposed to the authorities and justice is done. We have the support of good client managers who understands visa regulations.

A few months back, when there was no visibility when priority dates will become current, my wife had converted from H4 to F1 so that she could work. She is currently working on CPT, and also has applied for OPT, which will start in August.
Now with my priority date June 2002 becoming current, we must decide what to do. My lawyer had told me earlier that filing 485 while on F1 is not advisable.
Has anyone been in similar situation? What is the best way to take advantage of priority dates, so that my wife does not have to be away from job for a long time.
Any suggestions will be appreciated.

POJ method can be used for all cases that are current and in the processing window...just keep on trying ur luck and I am sure you'll land a decent CSR who will be much much more useful and worth your trials and efforts.
Be persistent and you have every right to be after all you came this far.
Write to Janet Napolitano and mention that you are unfairly getting delayed and that you want to know what is holding your application and all checks and clearances done and visa number is available...

DOS has publicly admitted that they made a mistake in the past interpretation and allowed visas to flow to EB3-ROW and EB3.
Do yo uguys seriously expect DOS to start making the same mistake they publicy apologized for a few months back?
We all talk about staying united.. but if EB3 folks are going to get together and start asking DOS to unfairly divert visa numbers away from EB2 (mostly to EB3-ROW... numbers will run out before EB3-I even sees it), how are EB2 folks expected to just sit and watch?
How can we stay united then?
What would you do if your blood brother was in EB2 while you are in EB3? Would you do the same?

And to make matters worse, this jerk married a Mexican woman. He is alway behind Mexico and Mexicans for some reason. Imagine that, he lives in NJ, has a several acre house, makes 7/8 figure salary and then teaches American middle class a lesson to avoid goods produced in China/Mexico/India. Avoid them because they add up to trade deficit of USA, avoid them because those countries have stolen jobs from middle class Americans. Why doesn't Lou Dobbs stop using software written by some Indian/Chinesse guy? Why doesn't he stop eating at a place where in the kitchen a Mexican guy is making his meal? why doesn't he stop using Japnesse cars? Why doesn't he quit eating Pizza....afterall it is Italian food? Why doesn't he stop driving on interstate highways...part of those were made by African Americans. I am asking Lou Dobbs to show me his grand father's VISA/I-94 when he came to the USA, on a ship, half starved, half naked from some european country and never went back! This guy blames mexicans/legal or immigrations for this country's broken health care system. Other day, he was concerned that in California, especially L.A. and surrounding area, white people's percentage has gone below 50%, Mexicans and Indians are having too many kids, whites are not having enough kids.........this is by far the most racist program CNN runs and we need to do something to put a stop on it.

I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
Having a house in this market has become a pain as it has made me immobile with respect to good job offers.
I was thinking that incase i find a job in a different state and cannot travel back home frequently and also renting is not a good option then should i leave the house to the bank for foreclosure?
Will this affect my GC process. I have no plans of buying a house in coming years.
What might be an outcome of foreclosure, keeping in mind that i am wiating for my GC process.
If anyone had an experiecne like this or may know someone, please share ur thought..
My suggestion is to explore short selling to avoid foreclosure. This will not affect your credit as foreclosure does. And mortgage lenders are going ahead with this option.

withdrawing is just a matter of sending them a letter and including your receipt number, asking for that application to be withdrawn.
I am worried about withdrawing because (they have been known to do silly things) of the risk that they withdraw BOTH petitions. We both have somewhat recent PDs, and wont get a chance to file again for YEARS! Might as well let them find out and ask what-to-do. My lawyer is simply waiting for the RFE!
There is also a chance that they dont even bring up the issue of the second application and the first one gets approved in due course of time...
