Multiple 485 and EAD filing

Hi,
My wife and I both got our LC approved. She filed I-140 and I-485 concurrently for both of us in Nov.2006 (Nebraska Center), based on her LC. Then I filed I-140 and I-485 concurrently for both of us again in Jan,2007 (Texas Center), based on my LC.
The EADs she applied got aproved pretty quickly. Several days ago, my EAD applications got denied. The denial reason is, we already have approved EAD.
Originally our plan is: My wife will switch to a Finance related job soon (her LC is based on Software job), I will wait for GC. (The reason we still filed for multiple 485 and EAD is that we want to postpone the decision on who should wait for GC). Now I'm totally confused on whether she can use the EAD, and whether I can renew the approved EAD (because they are based on her application).
Any inputs or clarifications will be greatly appreciated.

I really don't know why someone would file the 485/EAD through the spouse when the spouse is planning to change the career field, and you know that you need to be in a similar job description to work on EAD. It almost seems like a no-brainer that the guy in this case should have filed for the 485/AP/EAD.

Its interesting that July 2nd apps have not been receipted yet. I made two applications (based on the same I-140 from TSC because of the July fiasco), one on July 2nd and one on July 19th.
You can see the first application details in my signature. My second app's checks cleared the bank on 09/12/2007. This is the application that reached NSC on July 19th - the receipt is from TSC.

I am copying into here a great document which I followed to the letter for filing my adjustment of status in May. It is prepared by a major state university who have dozens of people each year going through this process. Thought it might be helpful to some of you.
DOCUMENTATION FOR APPLICATION
BASED ON EMPLOYMENT
The primary applicant and all dependents must each file the following documents. All checks/money orders should be made payable to the �Department of Homeland Security� and stapled to the top left-hand corner of the Form I-485 (Application for Permanent Residence). Place documentation for each application in the order listed below.
1. Form I-485 (Application for Permanent Residence) and fee. Fee is $325 for each person aged 14 and over, $225 for each person under the age of 14. Check box (a) in Part 2 of the form. Form
I-485 Supplement A is not required unless you are illegally in the US.
2. Fingerprint fee ($70) for each applicant aged 14 to 79. USCIS will send notification of time and place for later fingerprinting. Fee may either be included with the check/money order for the Form I-485 or written as a separate check/money order.
3. Two color passport pictures (click here). Staple an envelope with photos to the lower left corner of the Form I-485.
4. Form G-325A (Biographic Information).
5. Sealed I-693 (Report of Medical Examination) and Supplement to I-693 completed by a certified USCIS Civil Surgeon. Children under 14 years of age do not need the x-ray or blood serology.
6. Evidence of valid nonimmigrant status. Prepare an outline or �history� of all prior periods of stay and visa status in the U.S. Include copies of related documents
(I-20s, IAP-66/DS2019s, I-797s) and 2 year home residency waiver letter, if applicable.
7. Photocopies of I-94 (both sides), passport identification, passport validity/extension, and US visa pages.
8. Photocopy of Form I-797 Approval Notice, showing approval of I-140 Immigrant Petition for Alien Workers. If you are filing while the I-140 is pending, write CONCURRENT FILING on the cover sheet and mailing envelope. Be sure to attach a copy of the I-140 Receipt Notice.
9. Photocopy of birth certificate showing parents� names. Passports are NOT acceptable substitutes for a birth record.
10. Photocopy of the marriage license of the primary applicant and spouse.
11. Photocopies of divorce decree(s) and/or death certificate(s) from all prior marriages of the primary applicant and spouse (if applicable).
12. Current employment letter for the primary applicant. Letter must certify continuation of permanent employment, starting salary, and duties.
13. If family members are applying, Form I-134 (Affidavit of Support) must be completed by primary applicant on behalf of any accompanying family members. Be sure to include documentation. Employment-based applicants do NOT file Form I-864.
14. If you or any family members are applying for work authorization, Form I-765 ($180 fee) must be completed. Download page 10 only. Staple an envelope with two additional photos to the lower left corner of the I-765. Mark (c)(9) in question #16.
15. See attachment on travel to determine whether you wish to file Form I-131 for Advance Parole.

Public rallies are hard to organize compared to intense dicussions online. There is an issue of permits from the city before you hold a public event and also other things to take care of. Its not worth doing it unless it gets attention of national media for which you would need atleast 5 to 10 thousand people.
For example, if you want to hold a rally in central park in New York City, you would need a permit I believe from City of New York and then organized efforts to make sure that the media shows up there and you can say something for the cameras.
Immigration is not one of the issues that are hot enough to get media's attention and time and cover a public rally.
Our strategy is to get the attention of specific groups of people:
The congress.
The people affected by retrogression
And the people who hire people affected by retrogression.
Using energy to take our cause to the entire populace is not fruitful because it will be forgotten soon and the people who need to hear us are very few.
ON the other hand, if you or others on this website can organize get-togethers at a private venue, like a banquet hall or something and mobilize people to volunteer on this website in terms of time effort and money, then it would be just SWEEEEET and we would be sending you a thank-you note.:) :)

Is that mean they are going to move the PDs much further and again move back during the end of the year!!
So isn't this implying that the PDs will advance very very further than the available visa numbers!!!!!!!!!!

Doing so will give DOS better visibility into EB-3 upgrade demand in the pipeline, and will better ensure that all visas allowed annually are used. However, a rapid advance could spur a surge in demand that could impact the cut-off dates later in the year. The May Visa Bulletin, generally issued mid-April, will contain a discussion of visa availability projections for the remainder of the year.

I checked some family based data and Date jumps 2-3 years once in a 2-3 year period and NVC gets enough files to work on for next 2-3 years , so dates moves slowly for next 2-3 years. USCIS learned lesson from July 2007 and may follow same approach what NVC do.
They might go upto 2008 or 2009 in advance this year or next year so they have almost 20-30 k Eb2 cases on hand which can last for year or two. USCIS needs some new cases to work on. All pre adjudicated cases are ready for approval so chances are there they can advance date so that they can get enough cases for next year's spill over quota.

HR5882 was sponsored by Congresswoman Lofgren and Congressman Sensenbrenner. This bill recaptures all the unused visa numbers that have been lost since 1992 due to processing delays in Employment based category and Family category. It is estimated that 216000 green cards will be recaptured which would help to eleviate the employment based backlogs.
Please use the instructions provided below to make the phone calls.
(1) Call the congressman/woman office and request to speak with the aide who handles Legislative and Immigration matters
2) If they are not available leave a VM for them -
"I would like Representative "Representative Name" to support HR 5882, bill to recapture the green cards lost due to processing and bureaucratic delays. As you may already know that this is a bi-partisan bill with wide bipartisan support in the house and will help improve American competitiveness & reduce the back logs associated with USCIS. This bill is non controversial measures that will help US to stay competitive with a highly educated and skilled work force and address family based backlogs also.
To All congress-critters:
In a nutshell, this bill allows USCIS to manage their workflow more effectively, which provides better customer service, and will eventually lead to better turn-around times.
To Democrats: More people will be able to get their citizenship in reasonable times.
To Republicans: Companies will be able to attract more talent which improves economic performance."

HR5882 was sponsored by Congresswoman Lofgren and Congressman Sensenbrenner. This bill recaptures all the unused visa numbers that have been lost since 1992 due to processing delays in Employment based category and Family category. It is estimated that 216000 green cards will be recaptured which would help to eleviate the employment based backlogs.
Please use the instructions provided below to make the phone calls.
(1) Call the congressman/woman office and request to speak with the aide who handles Legislative and Immigration matters
2) If they are not available leave a VM for them -
"I would like Representative "Representative Name" to support HR 5882, bill to recapture the green cards lost due to processing and bureaucratic delays. As you may already know that this is a bi-partisan bill with wide bipartisan support in the house and will help improve American competitiveness & reduce the back logs associated with USCIS. This bill is non controversial measures that will help US to stay competitive with a highly educated and skilled work force and address family based backlogs also.
To All congress-critters:
In a nutshell, this bill allows USCIS to manage their workflow more effectively, which provides better customer service, and will eventually lead to better turn-around times.
To Democrats: More people will be able to get their citizenship in reasonable times.
To Republicans: Companies will be able to attract more talent which improves economic performance."
(3) As usual Do NOT get into the CIR issue or illegal Immigration. If the aide is confusing with CIR or illegal immigration, just tell them that these are legal immigration bills.
(4) If the aide asks whether you belong to the district or not, tell them NO if you don't. Mention to them that you already spoke with your representative and would like the congressman/congresswoman
support.

I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".
Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

Infact my 485 got denied in August 2009 and in september 2009 filed MTR,which got approved on 22 sep 2009 and today we got 485 approval emails.
Please......put some details and how did you deal with the MTR, so that it will be very useful for everybody around here.

Dear Smisachu/ and others:
I was also planning to go to Kolkata this summer to extend my H1B for another 3 years. Now, I am so scared reading all about the PIMS verification; delay of issuing visas; and returning passports. I am also sacred because I did not apply for any AP because at the time of applying for my 485 my H1B was valid (in fact it is valid till July 08).
So, what would you guys advise me to do:
(1) Go to Kolkata (with my 485 receipt notice, original) and return before my
current H1B expires in July 08? Or, (2) apply for an AP (it is my understanding that AP is rejected by USCIS if someone has a valid H1B)? Please advise. Thanks.
this is my thinking... number of cases which are getting delays due to this PIMS check should be considerably less when we calculate in terms of percentage... all the persons who are getting passport quickly may not be coming to these forums as they will be busy in their India trip (though there are few people who posted and I salute them). And I guess whose passport get delayed .. most of those must be coming to such forums... so in terms of percentage it might be 10% or less of cases.. so if we decide to go for stamping, there will be risk of passport delay but the probability will be less...
these are just my thoughts.. no other source of information.

This disclaimer in VB, does not say "mid-month". It takes about cut off dates via bulletin only. Also, this means USCIS put some thought behind the time they will have to announce cut-off dates. They new the demand will ber "very heavy".

What if the USCIS suddenly realized that they can make more money in August due to the fee change? So someone in dept had a brainwave thinking - why not move back the dates in July and move forward again for the August bulletin??

FINALLY I GOT MY PP with Visa Stamp today !!!!
the status changed on the VFS website 'pp delivered' in the morning around 11am.
Here is my case:-
Int for H1B renewal, same company same job, at New Delhi consulate - 14th Jan. VO said "approved, you will get your passport couriered to your home in a couple of days'.
10 days went by and no response. By Feb 1st week, i started calling DOS ..DOS confirmed to have sent the clearance on Jan 25th..
Since then my lawyers and me have been trying to find out the reason for delay from both DOS and embassy.. NO LUCK @@
today on Feb 12th..30 calendar days..i got my pp back. And I am flying back home tonight.
Thanks to everyone who helped me and supported me during this long wait.
In my opinion my case was delayed only for PIMS..but since i had H4, F1, studied at 4 schools, and fairst H1 and this H1B renewal..it took VO good amount of time correlate and work on all this.
I guess mostly delays are for renewals and for people specially with longer history in states. The embassy's are swamped with work and now days a general processing time has been made to 30 days. Infact its also mentioned on their website that most cases are completed withing 30 days..Just FYI..even for PIMS verification, the embassy will report to you as administrative delay.
I hope all this helps to people who are still waiting and who may have long waits in future.

The chunnel is a great way to travel to Paris, much more door to door than flying and nearly as quick if you count the waiting around in the airport.
The only way to get cheap flights in Europe is to use one of the cheap charter companies, such as Easy Jet, BMI Baby, Ryanair etc. There are more. There is a website that I use to use called cheapflights? If you go to Yahoo UK and search for cheap flights lots of options will appear. I am pleased you enjoyed your stay in London. I like the city, but to visit, just like New York.
