I am not sure if it would be counted as out of status, but it would definitely violate the terms of the H1 visa, if your employer is not paying you at least the minimum amount specified in the H1B LCA.

I completely dis agree with you. This action item is completely different. As realiseit mentioned earlier, we should take one step at a time. we have another thread revlvoing around the IV for prefiling of AOS. Please see http://immigrationvoice.org/forum/showthread.php?t=23695
If you have any innovative ideas please come forward and once we gain enough momentum then we can request entire communtiy (including who have applied for AOS) to help us with the effort.

I gave my opinion and people gave me lot of reds. There is a majority here who already have EAD and have filed I485. You people do not care for those who are less fortunate and struggling in the early stages of the process. If July 07 had not happened, all of you would be asking for I485 filing option today.
By giving reds to people who disagree you will drive people away and make IV only for those who have filed I485 and not for the entire EB immigration people.

Students,
Please make sure your EAD doesnt start before October 2008. That way, you will have 2 complete chances of getting H1 if things wont change even after presidential elections.
General Rule of thumb is "Graduate in august put start date as October 1st for your OPT"
This is not easy coz when we graduated in 2000-2001 area we didnt had to choose some date just bcoz the visa ia not available. We used to worry more about getting a good job than this visa and we used graduate when coursework & thesis are complete. I think things have changed drastically.

Ok, so if I file the i-140/i-485 now and leave the country with a new stamp.
what do you mean by new stamp ? once you apply for I-485 , you need to wait until you get your I-485 reciept# to leave country.
Now, if my I-140 is approved after that, and then my i-485 is looked at after that date, will I considered to be in status then, because when they are looking at the AOS application, I have already left and returned to the country??
I guess you have to get new I-94 and submit that new I-94 to USCIS.
Or should be in status the day the AOS petition is filed and even if i leave/re-enter the country after that, it does not matter?!

I know you guys have been doing a great job. I joined around july last year and have been a regular visitor to your site. Actually, I was just active on the thread that GCStatus has started. I dont think he ever used derogatory statements against any of the admin. Infact, he has posted for a help from admin on more than 4 occassions with out any proper response. Actually, If you look at this thread, it was some one else who had commented admins are on vacation and will not be back until july 2009. It was not GCStatus who said that. He just replied to that . He had no clue about what you guys are up to. So let us stop this leadership fight. Now that, you have clearly told you cannot hardwire that thread on the front page. Well, we cant do much about it now, since we are at your help here. If you think, GCStatus has said any thing bad about you, please can you post it, because i did not find any comments about admin.

Do you want me to post them here? Now lets get back to "ownership" and "rudeness" debate because it always turns out that way. You can say anything and if Admin responds, all of a sudden Admin is showing attitude, Admin is rude, freedom of speech, Ist amendment, Admins is dictators, Admins are like Hitler etc etc . Nothing new, we have seen this story repeat countless times.
And one more thing, you are busy and others have all the free time in the world. Is that right?
We never received any email from you. I think you mean 4-5 posts. We did not believe that there was merit in responding to your posts. There is only so much time in a day. We can not practically respond to most of the posts, even if we want. But as I mentioned earlier, not responding to a post doesn't give you license to be rude and then later call it a joke. Its not funny because we take this effort very seriously. Our information is in public domain and we are very much reachable. Whereas you have put in bogus information in your profile and we think that using anonymous handle, you are attacking this effort. With this effort we have developed think skin because we have heard a lot of times from naysayers. But sometimes, like today, we do feel the need to respond to needless attacks/nagging/poking.

Hi Guys
I would like to point out a few things about the recent Lobby day we from IV did on June 6th and 7th in Washington DC.
I am a proud participant and I am glad I did take part in it. This was my first time and I am ready to this again when needed. Initially I was skeptical about this drive like a lot of you . But after I saw the commitment and dedication of our senior members , I am encouraged and I am glad I went there to DC and I was surprised how positive was the response I got from the offices of senators and congressmen and congresswomen. There were a lot of IV members who traveled from all across the country although there were a few states from where members could not make it to DC. Thanks to all of those who attended this event and those who attended know how much positive feeling we had on those 3 days.
In my opinion we were successful in bringing the attention of various congressmen/congresswomen and senators to the issue of employment based green card backlogs. A lot of the senators offices were already aware of what IV is doing and in some cases when we said we are from IV, They started telling why we were there and they were very supportive of our cause.
Some of them had no idea what we were talking about. They think that there is no such thing as backlog in green cards for high skilled immigrants from some countries like India and china and Philippines etc.. We had to educate them and explain the entire green card process steps to their legal aides but towards the end they understood our issue and were supportive of our cause.
Actually a lot of the staffers of senators and congressmen attended the Reception on capital hill on Tuesday. That also underscores the support we have there. To translate the support into more concrete legislative support in our favor, We need to organize more and increase number of members attending these events in future to have a more solid impact on them.
I want to bring up one point very clearly. Guys there is no one in Washington DC offices talking about the difficulties we are facing other than IV organization members . We need to lobby the lawmakers much much before any legislation is drafted and taken up for debate in congress. If we think we will rise up and make some noise when the bill is tabled, we are wrong. By then we will be very very late in the game. The deals would have already be done in congress and our issues will not be addressed at all. ( that is just how business is done in Washington . If you snooze you loose) We need to rise up and take a more active role in IV by
1. Contacting senators and congressmen in our districts and explain to them the issues we are facing , IV Can help you by providing the documentation required and any other help needed in talking to the representatives. ( you will be surprised by their support and positive response to our issues when you meet them )
2. Register and take part in the IV state chapters meetings and discussions
3. Donate what ever we can ( 10 , 20 , 30$ etc..) to our cause in IV . If we can not help ourselves, no one can help us .(keep in mind in DC We would need money to take up any advocacy efforts ).
4. Participate in the lobby drives and other such events to raise awareness about our problems. Numbers really matter in DC . just posting the issues on forums will not help us although it may serve as a consolation by venting out on forums . this will not take us anywhere
Guys please talk to your friends who are in the limbo in EB GC process and get them to actively be involved for our cause. We all will be benefited by the results from the efforts we put in. We all have day jobs at the same time we need to sacrifice some time and resources to the larger cause.
Hope I have inspired my fellow members who are sitting on fence to actively get involved in IV and support our cause.

Once here on the promised land, we had to fight our way to create a free society that you are dying to be part of. America is land of entrepreneurs.
And any one that don't have an entrepreneurial spirit is not welcomed here.
What do you have to bring to the table?
So are we putting up with all the biased folks like you. We go to work everyday and earn our pay. We are not a burden to US. We contribute to the economy. We start about 25% of the companies. I can go on and on.
My question first though to the mods is why is this guy and his IP not banned?

So the warden can still order restraints.

Congrats. I have a question, which I posted to another member. Did you get the receipt first or your attorney or you both at the same time.
Note: Checks got cashed after 2 days of Receipts.
I-140 Approved (NSC) 11/2006
485 -- July 2nd 11:30a.m
Receipt rcvd -- Aug 10th (Rcvd copy of receipts Aug 13th).
LUD Not updated.

I didn't want to dishearten anyone. What I meant that multiple RFEs are quite common. I responded to an RFE last November and counting stars since then.
An open window can again incite another RFE and then back to counting. There should not be much hope or basis on preadjudication....preadjudication is just a mode for denying cases and not giving green....one RFE responded they may shower you with more just for the fun of it.
Again hope less and don't put your life on hold

Off topic, but I'm confused in figuring out the standards for closing topics in this forum. I've seen threads with much lower tone, fewer personal attacks and cleaner language being called useless bickering and closed.
I don't mean anyone personally, and I can be wrong, but to me it seems like if the people involved are not moderators and expressing reasonable argument against an IV goal or IV practice it's quickly a target for closing. While if a moderator is involved and has enough supporters to overpower the other party, the thread is kept open with no problem even though it's the same level of bickering and insult exchange.

how goes life with you? its human to see things through personal lenses. when you are involved in a thread and want a discussion you (or i) will always feel it is a target, if it gets clsoed....
personally i hate closing threads. i give tons of warnings and keep stating...i will close...but rarely do :-)
in this case, the effort is to bring the thread back to the original discussion, in deference to the original posters.
we seem to succeed intermittently....until we are thrown back OT :-)
hope it's a sunny warm MN weekend!
ps at the same time moderators are human too...and i don't think there has been much overpowering here, last i noted, i was the one apologising :-)
