What's wrong happening in PD porting case ?? Original beneficiary is able to get a visa allocated to him by claiming he was or is eligible for EB-2 ? Where is fraud in this and as you said if law allows it and what's wrong... The point was about abusing the system to get ahead in the line. In that way labor sub shares similarity with PD porting. If a person who landed yesterday fits the job profile and the law allowed it , then what's wrong.
On the other hand if those labor are sold for a price then it is serious problem. And thats why Lab Sub was eleminated. Now thats what is going to happen (and happening) in PD porting case.

If rumors are true there is no point in sending I485 application if State dept announces that Visa is not available on July 2nd Morning. If confusion or rumor is cleared then Lawyers can send the application. That stand may be correct. But what if State Dept announces on Wednesday. Then those who are filed on Monday and Tuesday will get EAD and AP. I hope these rumors will not become true

This is my view about how USCIS has messed up in name check delays.
Name check PROGRAM that they might be using takes into account phoenetic spelling of FIRST and LAST NAME. Now just imagine, if your name is broken into 100 different spelling combinations and when your entire BIRTH YEAR IS checked against the databse--it will be surprising if there are no HITS. And to resolve those hits, pre-1995 records needs to be serached manually. There is no responsibility or time commitment by FBI or USCIS for the delay.
This might be true for Asian names. The argument is-- the names in the databse are translations and therefore, they need to check accordingly.
I BET they are not doing this for AMERICAN names, I mean for passport approval, they do not apply phoenetic program. I remember that FBI testimony included the discussion that they have set up appropriate filters for passport applicants (american citizens) so that unnecessary hits are avoided. Now this is my view and a discussion point. I may be wrong too.
In effect, Indian and Chinese professionals are deprived of immigration benefits.
Equally controversial is per country limitations in EB categories. If you do not select based on country of origin, you should not be subjected to per country limits because you are working for an american company and you are going to be american. Any demographic adjustment need to be made in diversity visa lottery.
This retrogression in effect deprives Indian and Chinese professionals of their benefits.
Justice and fairness has it that these problems need to be addressed. Abundant common sense and deeply practical approach that USA has, I am sure above problems will find attention. This great nation has always supported JUST and FAIR rules.

I bought a house in the year 2006 (2 years back as Punjabi did)....there were reports, news items, articles everywhere talking about the real estate bubble with data available by cities/states. So saying something like "what is the fault of Punjabi" is not fair as we are all here because of our "extraordinarily high skills". And where did the $200 K number come from ? In the city where I live, the average house price was $220,000, I bought a house which was worth $185,000. I knew my limits.
First of all I am not affected by foreclosure and nor do I own a property.
Now let me say this: What is the fault of Punjabi if his house price went down by $200K? He has a load which is not only more than his house value, he is also paying an interest on that loan. It is true that he has got into hot water but how many years will it take to make $200 K? Most of us are not millionaires here. It is true that he will suffer for a few years but I dont see why giving up the house is not an option. Why would he continue to pay interest and principal when his house may not get to the same value in his lifetime? I think foreclosure is a small price to pay in that light.

Nothing will happen. The dates will be retrogresses on Monday. May be we will see 'U' in Visa Bulletin. The AILA will try to pursue DOS and USICS but they will politely say "sorry for the trouble" This will lead to the law suit. Some people will submit their resignation. what is the meaning of staff augmentation case? He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.

Your posts are enlightening and breath of fresh air in an otherwise non-nonsensical forum discussion. Although people would want to, but talk about ethics and moral is not forbidden, not yet at least.
The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.
In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. If you are hostile towards him you are simply in denial. The longer you stay there the harder it will be to cope with the new realities.

You will earn it back but you can't undo foreclosure and whatever comes with it in terms of personal memory, your credit and things in future that you can't foresee now. The Gandhi Protest
Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along. The U.S. Citizenship and Immigration Services forwarded the flowers to soldiers recovering at Walter Reed Army Medical Hospital, saying it understood the intent of gesture.
Here's a sample:
"I wonder if USCIS really understood why the flowers were sent. It was a symbolic protest by legal immigrants AGAINST the way USCIS treated them. How could they send it in the 'same spirit' to soldiers whom we all empathize with?"

Just imagine what would have happened in WWII if the US would have turned away the immigrating sciencists and engineers. This comment, whoever posted it hits the nail right on head.
As a highly skilled H1B worker in the US, let me the set the record straight on a few common misconceptions:
- Many of us come from upper middle class families and didnt come to the US 'seeking quality of life'. We already had it.
- Many of us have graduated with distinction or higher from TOP US universities where we competed with 'local' talent and aced the programs, with NO SPECIAL FAVORS
- All of us are PASSIONATE about the PROMISE of the GREAT AMERICAN DREAM. We work hard because we want to, not because we need to. (Hint: We are ambitious and can hence go to any country in the world!)
- All of us are an INTEGRAL part of this society, paying 28%-33% of our $100K+ jobs as TAXES that go back to the US economy
- All of us continue the great tradition of the US being a melting pot
Go back to the age of the Gold Rush. We are the new Gold Rush. We are the new Lewis and Clarke. We are adventurers, learners, experiments, believers, doers.
We are not lowly paid 'tech slaves'. Get the media misconception out of your heads.
We are PROUD to be part of the Great American Fabric. We strengthen this country with our diversity. We will continue to contribute selflessly to make this a greater, stronger nation.
And while we are it, we wont forget that our own future generations might take it more lightly and risk messing up their careers. Anyone that has 'life handed to them in a platter' ends up messing it.
So, please take your heads out of the sand, quit being protectionist and complaining the someone moved your cheese. Look at how you can move and be flexible, nimble and adaptive.
Inspiration. Ideation. Innovation. Hardwork. Dedication. Focus. Results. Rewards. Since when have we decided to change the ingredients of the American Dream?

The Gandhi Protest
Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along. The U.S. Citizenship and Immigration Services forwarded the flowers to soldiers recovering at Walter Reed Army Medical Hospital, saying it understood the intent of gesture.
Here's a sample:
"I wonder if USCIS really understood why the flowers were sent. It was a symbolic protest by legal immigrants AGAINST the way USCIS treated them. How could they send it in the 'same spirit' to soldiers whom we all empathize with?"

"What an inspirational act. Too bad the message did seem to have gotten lost in translation. Just imagine what would have happened in WWII if the US would have turned away the immigrating sciencists and engineers. How come some 50 years later, the US is struggling to see the value of inviting the world's best and brightest to immigrate here."

"I'm sorry that these people were tricked into coming to America with the promise of a welcome and eventually a Green Card. The fact is that H1-B immigrants were brought here in order to replace US workers."

What they did not understood that they were not politicians, they were bureaucrats. When the political power behind peaceful civil disobedience was unleashed, a nation took shape, and what Gandhi told Wavell became a reality.
"Something similar repeated in United States recently when thousands of legal immigrants were given a cold shoulder, despite of their merit based claim for an American Green Card. They decided to apply Gandhian way of peaceful protest by sending thousands of flower bouquets to USCIS, an American agency responsible for immigration and citizenship. Instead of offering an apology, USCIS chief decided to again ignore the immigrants and simply issued a statement that the flowers will be forwarded to the injured service members recuperating at Walter Reed Army Medical Center. Once again a bureaucrat miscalculated the power hidden behind a peaceful protest. Now the power behind flowers is becoming a media mainstream story. NY Times, Washington Post, Reuters, Yahoo News are a few to name. Bollywood, has recently issued a statement providing its full support to Immigration Voice, the non profit organization behind the flower campaign.
"An American way of fighting injustice 'A law suit' is on its way, the usual rallies and demonstrations are about to begin. However, in America, its first time after Martin Luther King Jr., that someone has tried to apply Gandhi's way to fight injustice. It is yet not clear that what would be the outcome of this campaign, but there are rumours that USCIS is already discussing internally to reverse the discriminatory decision which caused this embarrassing flower campaign against them.
"It's amazing to witness that 60 years after Gandhi's demise, his ideology is still relevant. We are sure its gonna remain relevant till there are Lord Wavell's in this world. Lord Wavell's can momentarily laugh thinking that unorganized immigrants are helpless, but when the peaceful protest will demonstrate its political power, they surely will realize what Gandhi and Gandhian ways are all about."
