I have been a reader on this site for years and have contributed to many of the fund raising campaigns. I agree with many of the comments on this thread. Brothers and sisters we need to team up and clamour for fair treatment; let us all contribute with dollars and sweat. I assume most of us on this site can afford to contribute a lot more than we have in the past and the potential rewards (fair opportunity to Immigration) are immense.
I have personally been in the US for ten years and believe I have contributed to the society a lot - while being a law abiding tax payer (I wish I could use the word citizen). And my story is not any different from any of yours. Why then we haven't gotten what we deserve at this point, afterall we have earned it by our sweat. The reason is we haven't realized our strength: in numbers, in dollars and in our contribution to the American society. No one is going to listen until we make our plight known to the public at large and to the law makers.
Some thoughts on how to go about doing it. We need a detailed plan with names of volunteers who can contribute their time. The plan should also include a list of key law-makers we are going to contact and how. All of this will cost money - so the first thing to do is support the fund-raising efforts. I also think we need to increase the fund-raising target by a lot; because the stakes are so high.
I apologize if I have wasted anyone's time with a long post. And I thank all of you for caring for one another and by sharing so much info with all the silent readers of this site. I have learned more about immigration from this site than my employer or immigration attroneys could ever share with me.
I will now put my money where my mouth is by making a contribution to Immigration Voice.

Meanwhile they start arguing.. and many like them join their verbal-struggle..
Because of this, IV community is divided.. Earlier only 200 people used to respond to action items .. now because of the rift only 100 do... this weakens the momentum that the campaign had..
Meanwhile, NumbersUSA et all increased their efforts..
Anti-immigration forces are united and under their pressure all the EB relief bills fail...
Election is close USCIS shifts the focus to FB visas..
EB backlog, retrogression goes up..

We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I stay pretty closer to Harrisburg, PA ...thanks

Well even if you use AP, you need a passport, dont you? And the passport must be with the Consulate pending stamping. So one way to get the passport back is to withdraw the visa application.
A question though: is'nt it abandoning your H1B1 visa tenure if you enter on AP even with a valid H1B remaining?
I don't know if procedures are different in the consulates..In my country you apply for H1B visa ,they interview you and tell you that you will be granted a visa so we will call you when stamp is ready...you take your paaport and yoiu go home and whenever they call you for stamping you bring your passport and stamp it the same day...Are procedures different these days?

Apparently they want everybody to forget about this ASAP, let alone attract any further interest or god forbid inquiries. I don't know who in the world can still beleive that they are a "service" and we are "customers".
I pity Gonzales now, may be Chertoff called him up and said why on the earth is he responding to flower campaign? Or may be Walter Reed Soldiers refused to accept mourning flowers. LOL....

After so many countries who receive major immigrant influx like UK, Australia, Canada and New Zealand have implemented a points based system why on earth lawmakers here don't wake-up. In a post-crisis world if US does not regain the old economic supremacy we'll see expatriate population redirecting itself.

Check out the names in the Writs of Mandamus lawsuits or the thread on Immig Portal about people filing writs of mandamus (http://boards.immigrationportal.com/showthread.php?p=173311)-- it is not "only Indians." It is anyone whose name, when run through FBI's name combination algorithm (http://www.cyrusmehta.com/related/Ayetes_Memo_on_Name_Checks.pdf) (see pg 2 onwards in link), generates a hit in the FBI reference files.
Just for the sake of illustration -- check out the names that appear in this google spreadsheet (http://spreadsheets.google.com/ccc?key=pBQx8tqZHHU2A6Q-Pv9sULw&hl=en) (you need a gmail account to view it) with a list of significant recent mandamus rulings.

Hi Friends,
I am really sick and tired of my attorney. He is making money out of immigrants but he does not like immigrants based on our dicussion.
I think we are very well educated and can easily take care of 485 filing.
My attorney will charge me at least $3000 for it although I got his referral from AILA. On top of that he delays filing my PERM and 140 and having serious attitude problem.
I can easily take care of 485 filing by myself.
My only and great concern is- Is my attorney can screw up my GC processing if I fire him and file 485 on my own?

I doubt that the lawyer would purposely hurt a former client. Its not just unethical, its really malpractice. And its not like lawyers done get fired and they cant handle getting fired.
However, please do make sure that you have all documents that you need to do your own 485 filing. If there are some documents like 140 approval or other stuff that only he has, then you will have to get it out of him, which he just might delay (a little) in case if he is an absolute nut job.
For me, I dont care what the lawyer thinks of immigrants as long as the job is done in a TIMELY manner without mistakes. If he hates immigrants and votes for Jeff Sessions, I dont care about it. All I want is TIMELINESS and ERROR FREE job. After that, he can hate anyone he wants and stick pins in voodoo dolls of immigrants.

So, what made you import yourself here? You could have stayed back in your own country..by the way, coming on a H4 was a choice..it wasn't forced upon you...didn't you know before coming here that you would have to stay home on a H4? H4->F1, H4->H1...all these options are always open to you..

Can we remove the clause- 'Allow filing of Adjustment of Status (Form I-485) when a visa number is not available' from the letter. I think this statement is not as per Immigration and Nationality Act (INA).

We have had several fruitful meeting with the administration in 2007, some of these meetings were scheduled in September, November and then in December. Due to lack of action on legislative front our community�s patience is running out and we want some relief urgently to get out of probationary status. We are thus starting this nationwide campaign that will help our advocacy efforts and get administration to act quickly. There are several components to this campaign.
1) Support from lawmaker offices: We urge all our members to meet their lawmaker offices and get them to write to The President in support of administrative fixes and urging for an immediate administrative relief. The template of the letter is attached. Letters from lawmaker offices to administration get far more attention as compared to anybody else writing the same letter. The template of the letter is posted below. Please request lawmakers to give you a copy of the letter or lawmakers could copy IV on their letter to The President.
2) Support from employers: We urge all members to approach their employer and have them send a letter to The President expressing support for our administrative fixes and appealing for an immediate relief. The template of the letter is attached below. Please request your employer to give you copy iof the letter so that you could provide IV with the copy of the letter.
3) Plea from our community: We urge all our members to write personalized letters to The President directly and convey their plight. If you would like to write your own personalized letter, please do so with your own story. It is illegal to discriminate against work eligible individuals. Employers CANNOT specify which document(s) they will accept from an employee. The refusal to hire an individual because the documents presented have a future expiration date may also constitute illegal discrimination."

Employer is tsill at liberty not to interview EAD holder. If you are not interviewed, hiring would not come into picture and hence this text of law in I-9 form is worthless for you for that position. You basically get an I131 which has all your immi information on it. It also includes your photo and validity period. There is also an area for stamping it when you re-enter the country. I hope this helps.

My lawyer tried calling USCIS to find out the details and they mentioned they are still processing the July 2nd cases and application are stored in 4 different warehouses.
According to her at this point we can do nothing but wait until they finish processing all the application.

CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.
Couple of things...
1) Calling USCIS is useless...
2) Look for checks for cashed....
3) Keep in touch with our pending group. I gives you support and motivation.

CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.
Couple of things...
1) Calling USCIS is useless...
2) Look for checks for cashed....
3) Keep in touch with our pending group. I gives you support and motivation.

This is the email I just received from CapitalOne:
"Sorry for the delay in responding. I've been out of the office unexpectedly and am now just getting a chance to catch up on past messages. Unfortunately we can't pursue candidates with EAD cards either."
There was a thread related to similar issues which I could not find. Apologies for opening a new one.
Doesn't the above constitute discrimination and illegal ? What recourse do we have when we are disqualified because of EAD ?
Is this for a job?
According to I-9 form, employers can't discriminate based on EAD. There are some exception where they require security clearance for the jobs.
You might want to remind CapitalOne of this anti-discrimination notice on I-9 or bring it to the notice of USCIS.
