Q6: What happens if an application is filed at the wrong Service Center?
A6. Forms I-485 should be filed at either the Texas or Nebraska Service Centers. However, through August 17, 2007 only, employment-based adjustment applications filed at the California and Vermont Service Centers will not be rejected and will be relocated to the appropriate Service Center. Filing at the wrong location could result in processing delays.

I think you'll only lose 1-2 weeks as far as your RD is concered..

Employer A with EB3 PD Feb2003 and I 485 filed
Same Employer A is doing EB2 PERM with I 140 PD porting
Is it possible to invoke AC21 in middle of process??
1. is it possible to use AC21 after 140 approval??, any time constraints?
2. what about between 140 filing and 140 approval?

In order to be able to finally adjust status when your priority date become current you must either maintain a continuously valid advance parole or H-1 visa. Alternatively, you could file an I-824 requesting that your approved I-140 be transferred to the National Visa Center so that when your priority date becomes current you can apply at the US Consul in Canada for your immigrant visa.

We are in the same situation, filed 485 on July 8th at NSC & EAD/AP on August 12th using 485 proof of delivery. Received receipt notices, FP done, 485 transferred to TSC, but haven't received EAD/AP. Planning to take Infopass appointment.

That could be things like
NOID - Notice of intend to Deny.
RFE - Request for evidence.
For I-140 USCIS does not update the online status properly. For both of my EB3 and EB2 I-140s still the case status says they received the application and processing!
Wait for the document that they sent.

Looks like you have too many people checking status at your company :)
Remember USCIS server sees the IP address of the proxy...
I can understand if someone is calling too many times. Looks like the USCIS computers are also feeling fed up. :p

In order to avoid this issue, please create a Customer account (single applicant) or a Representative account (representing many individuals)."
I am logging in after many days and I was checking it for the first time today

The Kentucky Consular Center in Williamsburg, Kentucky has registered and notified the winners of the DV-2010 diversity lottery. The diversity lottery was conducted under the terms of section 203(c) of the Immigration and Nationality Act and makes available *50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States.
Winners should start finding out very soon. Notifications to the randomly-selected diversity visa or "green card lottery" winners are being sent between May and July 2010.
How does it all work?
Soon an official letter from the U.S. Department of State Kentucky Consular Center (KCC) in Williamsburg, Kentucky will be sent to the mailing address that you provided in your entry. Being selected as a lottery winner does not guarantee that you will receive a visa; you must still apply and qualify for the immigrant visa. The notification letters will provide further instructions, including information on additional forms and documentation required and immigrant visa application fees.
Only participants in the DV-2010 program who were selected for further processing have been notified. Those who have not received notification were not selected. I also asked my company lawyer and they are suggesting that since her status is H4 she can not work. For working on EAD she has to leave country and reenter on AP.
So a little confused here?
That is not true. If she has her own EAD, she can start working anytime. Whenever she does that, she will automatically abandon H4 and her status will automatically become AOS.

When I filed my I140 I put "none: in the column for A#. Now the A# in I140 (EAC-xx-xxxxx) is different from the#in I94 which one do I use. Can I put it as N/A ?

As Professor Regina Germaine of the Georgetown University Law Center observed in an email message to an Immigration Professors' Listserve, "the criteria for release has always been (since 1996) the 3 factors mentioned by John Morton - 1) ID, 2) not a danger or flight risk, and 3) credible fear. And the lack of one or more of these factors is cited when ICE refuses to release someone."
So, has Morton announced a new policy or has he simply restated the existing policy in a way which suggests release, but, in fact, will lead to continued detention of asylum seekers?
Another unanswered issue is whether the policy will be followed by ICE officers throughout the country. Professor Margaret Taylor of Wake Forest University suggests it's an open question. "Hopefully there will be 'buy in' and compliance in the field offices with this policy, but history suggests otherwise."
For now let's take the Administration at its word. But time will tell whether the draconian policy of incarcerating people who seek refuge in America has finally come to an end.

As per my lawyer (one of the best) returning based on AP does not invalidates your H1B status. Your wife can get H4 stamping based on your current H1B approval, although some consulate might create issue as you don’t have stamping in your passport (this is rare case). Again all this coming from best lawyer not me.
Once she has H4 she can enter on H4 and you can enter on AP.

Here is my situation:
1) GC process thru company A, I 140 approved,I 485 filed and had valid H1B (expired on 12/28/2009)
2) Switched to Company B using AC21 and using EAD.
3) I would like to file H1B also based on previuosly approved 140 thru Company B as a back up since my previous employer going to revoke my 140.
Since my previous H1B expired few week back,is it posible to file new H1B thru Company B at this point?
Please advise

Hi everyone
started following IV after my friend told me about it. got some useful info and really admire the time members put to answer queries. this is my post and I hope I get some info here. my hubby is looking to relocate to south FL so we both can live and work in same place. he did get couple offers - one from a insurance firm and another from a software company - Citrix. looks like first one will only do EB-3 although the position requires 5+ years exp. does anyone know if Citrix does GC under EB-2 ?

The American Immigration Lawyers Association (AILA) has applauded the brainstorm of ideas in a draft memo from the United States Citizenship and Immigration Services (USCIS). The now-public draft, leaked without the permission of USCIS, examines the legal framework of immigration and explores possible solutions. AILA commends this reflection of the pursuit of the rule of law and the willingness of USCIS leadership to take up this thorough examination.
"We have in the past seen many attempts to scour the law to find justification for draconian, and ultimately unhelpful, ways to make immigrants' lives miserable," said AILA president David Leopold. "This draft document tries to think through ways to make the legal immigration system work in support of sensible law enforcement. It respects the law and respects the people who must deal with the law. For that, the administration is to be congratulated, even if none of the proposals is ever carried out." He added that many of these proposals should be carried out. Long-needed regulations to help children and crime victims caught in the system should be published. Men and women fighting for America in the U.S. military should have the comfort of knowing that their families are safe from being deported. Immigration policies that encourage investment in America and creation of jobs should be emphasized and expanded. These are but a few of several excellent proposals in this document.

I think you should talk to a good lawyer immidiately. Waiting here for someone to answer would jeopardise your relatives entry back into US later. As per the law they should be leaving US as soon as you get the denials.
