EB2 guys( those who do not want to support EB3)::
What will you do, in EB3 shoes, if the numbers are not moving in 2-3 months. You got it. MOst of them will change to EB2, right. I will too. I am sure you can imagine the scene then. I know 8 of my 15 friends have already jumped to EB2. And I am sure they have much higher priority date than most of EB2s there. So you know what to expect. Lets ALL support for the common cause.

I understand the frustration. Until two months back my PD was retro. Now, I already have my GC on my EB2-NIW I-140 and also had an approved EB1-OR I-140 recently. I am not here to suggest anyone shouldn't do what they think is best for them.
My own understanding of the law is that EB1 gets the left over EB5, EB2 gets the unused numbers from EB1 and the EB5 that went into EB1 but unused. EB3 gets the unused numbers from EB2 and those from EB1+EB5 unused by EB2. This maintains the preference categories (USCIS's definition, I am not saying EB2 is better than EB3).
No matter how the numbers are distributed, there is more demand than supply. It is unlikely all the unused EB1 and EB2 ROW numbers would fall to EB3 ROW and then to EB3-C/I. Some would surely go to EB2-C/I. Right now everyone is retro except EB1 and EB2 ROW. So, redistribution doesn't fix the problem just redistributes the retrogression.
If we can get the recapture and elimination of country ceiling then everybody benefits. The fact that we have an immigration bill is in itself quite something.
No matter how USCIS or DOS allocates the numbers, there will be backlog and its in everyone's interest whether C/I or ROW to think about pushing for the immigration reform bills.

Yes, USCIS works backwards, dont you see, mar 2005 is still waiting while May 2006 getting approved? There is no pattern even to the approval statuses, god only knows how they work.
I was wondering why the status went backwards (from CPO to Decision) and if that that is a normal process.

Finally got the CPO emails/texts today morning for both me and my wife.

If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.
A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]

Let me tell you I am as anxious and frustrated as you all "July 2 filers, no action yet" are. But I am thinking about it a bit calmly, rather than thinking of doing something so that I feel that I have done something (i.e. complain, write to congressman, etc.). Expressing my anger by saying they should have done this or that, does not change the situation. I believe USCIS is working, as expected, with the capability/attitude of a government worker, treating our filings (which are so important to us) just another government office paper work. Best is just to wait for another 10 days, and if nothing is heard by then, take action as per procedures.

Man this is Federal government dude and more over part of DHS. This is not a privately owned corrupted company where they can dick around with people.
This is nothing new, things like this happen in almost all parts of the world. Remember Enron, one fine morning thousands of people found that their life savings or retirment savings got wiped out clean with nothing to fall back on. Same could be said of about a lot of dot com millionaires. Life is very very unfair, what other explanation do we have other than that.

of all the smooth talk..cmon we all know the one time might power ruled the world.. so its not easy for them to get over with..well for those who dont like i always say..just boycott..but i know lots of them will still give in and take the pain...
the way i see..if indian airlines were upto the task.. we could have direct flights from all major cities in US..but then again how can I simply blame the British govt. for tormenting us..its the Indian govt. who can't sort this..either encourage big businesses to launch international flights with world class service..that's something which we have to wait!

Continental has direct flights to Delhi and Mumbai from Newark, Jet flies from both JFK and Newark, Air India flies direct as well, American flies from Chicago direct.
Many Middle East airlines (Qatar, Emirates) fly from New York to their respective hubs in Middle East and then to multiple cities in India.
Aeroflot ( my parents had a great experience on the airline - good food, courteous service and good new boeing planes) flies to Moscow and then to India.
West Coast folks can fly via Singapore or HK or Malaysia........
With so many choices - why should we even bother to patronize the London airport - i have no idea.....

So they approved your case even before you could reply to the RFE?
Well I got RFE then within a week got Card Production ordered email then within 12 hrs got mail undelivered email..
I have not replied to RFE yet.

Look around you will see.... not everybody is the same.
I personally know many who had been "working in H1B" for more than 14 years.
Not everybody gives more weightage for their "immigration plan" than some personal and career interests. If you are really truthful to USCIS about your intentions, and you keep doing what you want to do with your career and life, it is in-fact very possible that you will be found without a GC even after 10 years working in USA, if your are from India.
An approved I-140 doesnt make you "automatically" qualified for an I-485. You dont file 485, if you dont "intent" to continue with that specific employment, even after I-140 approval.
7Years???? No..... you can extend your H1 beyond 6 years as many times as you want if you meet some conditions as per AC21. So it is possible for you to be in H1B for 100 years.
10years tax payed???? Yes because of the other reasons I mentioned. Also I know many who are still in que after 14 years paying taxes.
.......... but for
#3) condition "if they have paid the tax continously for 10 years", I wonder how can this
happen unless the foreign student who has worked in US for 10 years. I heard H-1b
workers maximum have 6 years plus 1 year extra for extension total add up to 7 years.
So how can have 10 years tax paid????

waiting for Adjustment of Status without current date)",
I wonder whether only students with years of US working experience (which means
years in full time study plus years of working experience) up to 10 years is counted

"interfiling" to use old EB3 PD for new EB2 is not the easiest path for EB3-I guys specially if they have used AC21 and work on EAD now ( Most of us are in this category). Priority date porting is not an issue, USCIS does not have a problem with that. The problem is with "Job definition and level". While one use AC21 claims job position matching EB3 job classification and if there no enough progression gap between AC21 usage and "inerfiling" It becomes hard for a lawyer to convince USCIS that fellow is matching EB2 capability under same job classification. Hundred of such intefilings are waiting without no action from USCIS. My lawyer's advice wait till we logically can establish the skill progression, in other words minimum 3 years of wait from the day AC21 usage. And other important thing is "real promotion" in position should happen at employment and this whole explanation is based on assumption of employment at the same employer. If you change employment inbetween after AC21 usage and before interfiling , your 3 years wait cycle starts from new emploment date. I have not filed "interfiling" just because of these reasons and waiting for correct time to do that. In other words Eb3-I is really and badly screwed.\

Hi Guys,
Please find the details of how we complaint to our client management regarding L1 violation ....(for some of you guys who are interested in educating uer clients)
Step 1. Collect the email id of uer CEO and 8-10 executive managers, make sure that your groups CIO/CTO s email ids are included, get the email id of HR Head/Legal Dept/Immigration Dept of your client (CC them in the email).
Step 2. Create an anonymous Id with something like "Against Fruad"
Step 3. Formulate the email as given below
Subject: Fradulant Activity by Vendor - CTZ Tech Solutions ...For Eg.:-)
First Paragraph: What the Fraud/Violation Is?:
Mention the L-1B violation by these companies and how these resources are legally prohibited from working on staff augmentation assignments, mention the L1 reform act of 2004, provide the link to USCIS website and attach the .pdf file with L1 reform act. Mention the list of employees at the bottom of the email.
Second Pargaraph: Why They Do This?: Key points .. NO wage restrictions, NO numerical limitation and mention the H1 visa lottery in 2006,07,08 etc. NEVER talk abt corporate greed in this whole email (hope u got why!).
Third Paragraph: How they do this?: Mention about the petition which has to do nothing the current project they work on and the visa interview where these guys tell abt someother projects and clearly mention how they gets deployed to projects where they don't have eligibility to work and skills they cannot be utilized for.
Fourth Paragraph: How to Prevent this: (To show that you are sending this to resolve an issue and not to complicate one) ... mention about how easily each hiring manager can avoid this by setting visa criterion for all jobs including contract and temporary jobs.. once criterion is set by hiring managers these vendors cannot violate the same. For Eg. Hiring managers set the criterion that a new contract position can only be filled by Citizens/Green Cards/EAD/H1 s... so L1 violation doesnt even come into picture.
Last Paragraph (BUT NOT LEAST)
Mention the NAME of atleast 5 resources (and their organisation) working on L1, their projects, technology on which they work and how they violate L1 by working on these projects and technologies.
BELIEVE ME ... WE WERE PARTIALLY SUCCESSFULL ... NO MORE NEW ONSITE CONSULTANTS FROM THIS VENDOR ... but client is not yet ready to review the existing consultants.. looks like they are having a internal probe into the matter...hope we'll get some good news regarding the same too.

I recently had to apply for a UK transit visa and the process went smooth as ever. I had to answer a lot of questions for both my wife and myself but after I have done that the process was easy. We just had to show up for finger printing just like for our 485s, send all the necessary documents to the correct address by (reliable) mail and just got emails that our visas have been approved. I have flown with BA before and their service is far better than any other airlines I have flown with before.

My attorney told me to use control number on your latest stamped visa, in my case it is 14 digit number

This is the number in red on your visa stamp in ur passport. Mine is 8-digits long. Even if ur visa stamp has expired you've to provide that number.

That is exactly what smsthss is trying to tell you. To call from your mobile phone in US using vonage, you will need to have internet access for a few minutes (say a PC or better if you have an iphone;))
1. Open your browser and log into your vonage account and click on setup call forwarding.
2. Put the destination number in India (person in india that you want to call) as the number to which all calls to your vonage are forwarded to. Yes, vonage accepts 01191xxxxxxxxx number for forwarding calls.
3. Click Save.
4. Now from your mobile phone or any phone, call your own vonage number and bingo! call is forwarded to your friend in India. (Now remember to remove call forwarding or all calls to your vonage still keep going to your friend in India ;))

Hi,
I am happy to share the news that I received CPO hard copy on exactly Diwali Day. Lord Ramachandra Ki Jai.
Here are the details of my case and what did I do to get this CPO mail. It may help others to follow up with USCIS.
1. Applied EB-3 India in July 16th 2004 .
2. Waited for about until 2006 July, but no signs of EB-3 labor approval.
3. Applied EB-2 labor under PERM Sep 2006 and got approval in 7 days. this was amazing………..
4. Applied I-140 for EB-2 labor in Oct 2006 and received approval after 6 months, still my EB-3 labor not approved.
4. Applied I-485 on July 2nd 2007 along with my wife with EB-2 PD Sep 20th 2006.
5. Received the receipt notice with the notice date of Aug 30th 2007 and receipt date of July 2nd 2007.
6. Received the Finger print notice on Oct 15th 2007 and gave finger prints on Nov 10th 2007.
6. Received the EB-3 labor approval in Dec 2007 and applied for i-140 for eb-3 and received i-140 approval in June 2008.
7. Now I have 2 i-140 approvals one EB-3 with pd of July 16th 2004 and other eb-2 i-140 with Sep 20th 2006.
8. Changed to better attorney who can better handle the i-485 in terms of the PD transfer and follow up with USCIS.
9. Attorney sent Priority Date porting request to Texas service center in June 2008 along with new g-28 forms.
10. Called at least 4 times in 2008, but got the response that my processing dates are not current yet means. Not reached the July 2nd 2007 or Aug 28th 2007 which is my i-485 notice date.
11.In June 2009 Called USCIS POJ method and got some nice officer in Texas service center who opened the SR to open my case as my case is out of processing time.
12. Got soft LUDs in June 20th 2009 and called usics cust service and came to know case is assigned to an officer.
13. In July 20th 2009, got email update saying the case is transferred to NBC for further processing.
14. Next day again got email, case is transferred to NBC and I will receive the interview notice.
15. Got interview notice to go to local office on Aug 5th 2009.
16. Online status changed to case transferred to USCIS office........
17. Went for the interview on Aug 5th 2009 to local USCIS office along with my wife, office was very nice. Officer asked general questions which are on i-485 (like have u been arrested, have you been involved in terrorist activities etc.) form and questions about my wife's name and marriage date etc.. Officer did not ask even for employer verification letter also, I myself handed over that letter to her. She did not even saw that letter.
18. Dates were not current on Aug 5th 2009, and officer told, she will take a decision after dates are current.
19. Waited for Sep visa bulletin and dates became current, as my case is at local USCIS office, all attorneys who are the members of AILA will have direct contact to local USCIS office supervisor ph no and email id. These details will not be known to applicants. My attorney sent an hard copy request on Sep 5th 2009 to local USCIS office to adjudicate my case as my PD is current.
20. Waited until Sep 15th no update was received from Local USCIS office or no update on i-485 LUDs online.
21. Took info pass on Sep 16th 2009 and went to local USCIS office and got nice Info pass immigration office, very co-operative officer. He told me that my case is now back to central storage location and waiting for the visa no. I told him my PD is current, officer himself gave me an yellow form (please request for this form, otherwise they don’t give it normally) to fill up to send to other department supervisor in local USCIS office. Filled up and gave the form along with my i-485 receipt notices and i-140 notices. Officer asked me to wait 3 to 4 weeks to contact again. No luck until Sep 30th 2009.
22. On Sep 26th 2009, attorney sent an e-mail to local USCIS office and got the standard response on Oct 1st 2009saying to wait for 3 months etc..Again attorney received an e-mail on Oct 2nd 2009 that my case will be adjudicated soon.
23.On oct 4th 2009 took info pass again and went to local uscis office, again got nice infopass immigration officer and explained that they will request visa no only once (recently Murthy law firm posted that way USCIS and DOS dept interact) and I need to wait until visa no assigned by DOS. Gave again yellow form to sent to local USCIS supervisor to look into my case.
24.Called 1-800 number and asked if there was any update on my case, got very very nice supervisor from customer service center, and he told me that my case is now assigned to an officer on Oct 6th and I should see result in 2 or 3 days.
25Atttorney sent an e-mail again to local USCIS office explaining my PD porting details just to inform officer again.
26.Got CPO email Friday oct 16th and received courtesy notice of approval i-485 on Diwali day on Oct 17th 2009.
If the case is at local USCIS and your PD is current, please take info pass every 2 or 3 weeks, and request for yellow form and fill it up and give to info pass officer. This will help to move the case faster if the case is at local USCIS office.
Overall, please call repeatedly to USCIS cust service to get some good officers and you will really here somany good things from them. What I understood from my exp, that the customer service officers now far far better and good than 6 months back..Really thankful to USCIS for providing good customer service.
