Guys,
I think all of us EB2 ( including yours truly) are guilty of too much analysis paralysis of EB2 visa no.s for the remainfer of FY 08. With today's post by a lawyer on DOS communication to USCIS to stop allocating visa numbers to India/China till OCT 1 , 08, it is clear that USCIS will never get its act straight unless we are completely united and press on for a major drive to senators to pass the visa recapture bill ( regardless of EB2 and EB3) . So let us start flooding the senators inbox, voicemail and email with letters urging them to pass the recapture bill. To that extent I request all of you double your efforts. The next session of senate, which starts next month, is a short session and we should act NOW. otherwise nothing will happen until late next year.

Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the �Court Disposition Document� which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
1. Is it safe to travel to India and come back on AP?
2. What are the possible chances that visa officer may not let me into the USA?
3. Do I need to carry any letters from my criminal attorney explaining the situation?
4. Any one in similar situation, please update me on this?
5. Please list of documents I need to carry during my travel

I have an nre repatriable demat acct thru icici - it took all of 5 mnths and over 30 calls to cust svc to get the acct opened. The acct was mainly for utilizing the indian stock opts given by employer. You can trade as an NRI but online trading is not available for US residents on nre demat accts - u can however trade thru a broker like sharekhan etc.
All dividends are credited only to your NRE savings a/c - not to regular savings a/c. Any stock sale requires an authorization number which the broker can provide. Taxes on capital gains must be paid only if you sell within a year of purchase - the percentage is the same as for Indian citizens. There is no tax on long term cap gains
Since we do not have any taxable income in India, and many NRIs make charitable contributions regularly, the tax liabilities are usually not very high
Also there is a very informative section on sify.com for NRI taxation. You are not required to file any tax returns if you are in NRI status and are within the exemption limits.

Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.

i am just curious about the alternatives that people have to iv. i came up with ZERO. there couldnt be a greater intersection of interests and goals between potential eb-gcfilers and iv. other organizations are burdened with a much larger agenda with ours being a footnote mostly. & there are ZERO ACTIVE advocates for our cause, just a few journalists here & there along with editorial boards of papers like wsj & nyt that have little influence in this debate. teh corporate lobbyists do ask for more ebgc's and h1's but their timeframe to achieve it is very flexible - they can wait for the political tide to turn. how many iv guys are comfortable with such a timescale to achieve this?if we look at the anti's/bigots,as abhorrent as their goals are there's something to be learnt from the way they tap their supporters energy & $$. they have paid fulltime staff devoted entirely to churnin out 'academic' papers blaming everything on immigrants & they dont care if they have to abuse statistics or rewrite history on the way bcos no one cares or have time to question that. they have 'thinktanks' to 'think' exclusively about vilifying immigrants. they have tv hosts with audiences in the 100s of 1000s to demagogue relentlessly, moving/setting the parameters of the debate thats going to make things much much worse. so what are the ppl on the sidelines doing? anyone?

Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.

I invested so much for this company, like working beyond work hours, working in the weekends, making up the project deadlines for the incompetitive colleagues etc. etc. and now just waiting for my Green Card. There were so many times I thought if I get my Green Card I am going to leave this moment. Years passing by and with this retrogression thing, there is very little hope of getting it soon...
The positive thing is, my direct supervisor is very nice and I can voice my opinion and she understands me and completely supports me. I am just praying god that I should keep working for her till I get the GC.
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. I am planning to file EAD/AP for my wife who is on H4 along with adjustment of status application. Will she continue on her H4 status till she gets EAD/AP?
There are 2 ways in which current H4 status changes to AOS Pending status:
1. By working on employment using EAD
2. The primary applicant loses H1-B status for ANY reason

It will bring down the workload? Can you explain how? If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?
The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.
Anybody wont be eligible. Canada has been fine tuning the immigration since 2002.
Now only people who have studied or worked in Canada on work permit are eligible.
family based is greatly restricted unlike US where around 80 is non-skill based.
If they want they always reform but the exiting H1B is so good for American Companies that they will fight to keep the existing H1B-GC servitude instead of
any point based..
Plus there is politics of vote bank: Moment the CIR comes, the sheer stampede of illegal lobby like the bulls of Spain, H1B folks get crushed. Last time, moment the CIR came, H1B people started opposing it because it literally made illegals ahead in line line with more points in the point based system.
That's why I am skeptical of CIR as of now. H1bs don't have much chance in front
of the madness of illegal lobby vote bank. Based on my observations of how the
US politics works I don't see promise in CIR (one of main reasons I left for Canada)
Not to mention, a lot of antis are not that against EB reform but moment CIR comes
all anti-s get united in opposition. The illegal bobby hold H1Bs as hostage unless they get what they want. It is such a deadlock that I just don't see how it can be fixed.

Yes, I used nycgal's and made little modification to the intro part. Picked up the IV intro from our home page. Also emphasized on the skilled-immigrants rather than just legal immigrants. Still need to send it to Mr.Sturgeon.

But one thin I enjoy is problem solving and this is one of the hardest out there as it is dynamic.
With Eb3 India the Horizontal spillover methodology kills most hope as there is the large Eb2 India backlog. In 2007(I think) the vertical spillover methodology was followed and Eb3 India got 17000 or so visa numbers. So with Horizontal spillover and no number increase I am sorry to say movement is limited.
