I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport. I-140 is approved. I-485 was filed in July 2007. I have an opportunity to move to another company for a similar job profile. But the new company wants me to work as a contractor (hourly) on W2.
Is that a problem when filing AC-21?

The requirements for the position shouldn't exceed SVP time levels for the job zone to which the position code belongs - that's all I know. If the position code falls under zone IV or V you can require MS.
I still don't understand how BS+5 qualifies for EB2. If the position code falls is in zone V, BS+5 (7 years of SVP) would be a "normal" requirement, but isn't EB2 only for people with advanced degrees AND positions that require the advanced degree?

I cant tell you how much i was moved by the momentum that got generated during the 'black' weekend before christmas. One can tell the excitement and enthusiasm among the sufferers in this community. I wholly appreciate the efforts taken in setting up this site and following up on the issues. We need to generate the same kind of membership as we saw during that weekend.
One question i have and many others like me would be interested in knowing is a clear description on how the money collected will be spent. I understand by reading your posts that it will be totally transparent and will be detailed out every week. But its more important for people to know before hand on how and why money is needed, before they can open up their purses generously. Also please take this question in a positive attitude as more people would know the actual reasons.

Someone with a EB3/ROW/PD 01/05/RD 06/05 (ie someone who got in right before retro hit) could well have received their GC in the last few months with the move in PD.
As opposed to my case, EB3/ROW/PD 04/04 RD 06/07 and havn't got my greencard :) Both cases became current in the last few months, but obviously the one with the earlier RD would get approved 1st.
There are ALWAYS exceptions to the case.
But back on topic. What to do now that your I485 is applied. Spare yourself the endless agony by obsessively looking at trackers, or figuring out how signed your application for Fedex.

I agree with jonty and nixtor...that was the point I put out as a counter during our discussion. But the underlying sense is similar to what is there for illegal immigration: border fence. Humanitarian grounds is not an excuse you could use it with Congress men and women. Revamping Maths and Science in US schools is the exact justification against highskilled_immigration. Just like the border fence for illegal immigration, I wonder the issue in waiting against our efforts for fixing retrogression of highskilled immigration would be 'Show US born could start their training and educaction first' ...

I am planning to send a letter to President, First Lady, DOS chief besides other Govt. rep. Anyone has the addresses?
I am in CP and I am writing to them to allow CP filers who are already working here in the US to file for AOS (even if the PD is not current) anticipating a very long delay for EB3 I. That way we could get atleast the minimal benefits like EAD, AP.
If any CP filers from EB3 I wanna join me, more than welcome!

Just because OP steals office supplies ( his bad habit of shoplifting) he is accusing all immigraants. I take offence to that and when someone asks others to make a choice to marry a hooker or a shoplifter wife as a defence to that shoplifter. How crazy is that?
And you are defending a guy who has committed shop-lifting with this? You should have probably come out with more ammunition than this. Because of ppl like the OP and maybe you, we Indians are getting a really bad rep everywhere. I agree that the current political climate is so screwed up that, they are not doing anything except in a reactionary way. Part of it is a lack of visionary leadership, "W" has hardly been able to unite the country behind much legislation. The Congressmen have been too entrenched in political gamesmanship and more interested in political survival than the broader national interest. Nothing illustrated this more than the recent bailout legislation. Noone liked it but clearly there was no other option either. The lack of conviction in the way congress approached it however means, they spent 840 billion (instead of 700) and even that seems too little too late. And it might even end up being the first of many more bailouts. Sometimes you indeed can be too late to help out and drag it out more than necessary. Much is all about perception and confidence. Finally, vocal special interests who have selfishness and ideology at heart have no doubt contributed to this toxic mess, and elected officials seem less and less able to divorce themselves of their undue influence (it was not always that way in this country).
The one saving grace is that an election is in the offing. Honestly it will be a breath of fresh air, no matter who is elected. Someone can then project some leadership and actually get something done. This last 4 yr term has been especially useless in terms of getting anything at all done, not just on the immigration front but any front at all.

Why should only GC holders get this 'permission'? F1, J1, L1 and H1 people should also be able to get their parents. Also, add all their dependents, H4, L4(??) whatever. We can all live as a big family then. Or, just pack up and go back to India.

This was a good find. The decision actually opens up more doors then it closes.
USCIS in the past; and specifically Nebraska service center would deny I-140's if you did not have one single source degree equal to U.S. bachelors degree (ie., combination of degrees was not allowed).
this decision basically says that 3+2 will not be considered equal to masters but will be considered to be equal to bachelors degree. However, since the labor didn't allow for bachelors and five years of experience then they consider him to not be qualified for the position.
Looks like 3+2 will still qualify for eb2 but through the bachelors and five year route.
If you look through many of the appeals decisions you will even find contradictory stuff with regards to combination of degrees to get to bachelors equivalency for eb2.
That's why when you are first starting the greencard journey it is safest to go eb3 route and then later give it a try for eb2.

As you may know, AC21 is not exactly a rule but is a guideline to the adjudicators in the form of some memos. As far as I know there are at least two or three memos addressing various issues concerning AC21. These are: William Yates Memo Dated August 04, 2003 and Michael Aytes Memo Dated December 27, 2005. You might get them by googling for those (could be in some threads or blogs on IV itself). In addition to these we also had all the documents that we sent to the USCIS as well (AC21 letter, copies of I140, old job and new job description). Yes its kind of too many documents to carry (and some might see that as a over cautious) - but after the last episode we are inclined to carry them along every time we go out of the country.
