Yes I agree with you legal immigration is not only EB category, but EB+spouse+child category is the largest when we say Legal Immigration, plus questions are posed by Engineers & Doctors and that automatically tells the person who is reading that it is about EB category. I am a registered member not contributing financially so far. I beliefs are as fake as "reverse brain drain". I am neither fake nor anti immigrant. I am not a citizen of the USA nor a permanent member to be anti immigrant. But I always like to try and see if I can walk a mile in their shoes before making tall claims about anything. I beleive the USA govt will really stop the reverse brain drain if it is that big an issue for them without even we trying to tell them.

Guys.. need your expert advice.
I am travelling next month out of the country for a week. I am currently on a valid H1B which is stamped on my passport but my 485 is pending and the dates are current. I also have a valid AP to use and return on.
Question i have is if i show my H1B visa at the port of entry and enter using that am i risking my 485 application in anyway?
Let me tell you the hypothetical situation i am talking about
lets say my 485 gets approved on sept 6th 2008 but has not been updated on the USCIS case status online. Also i enter the country on sept 6th 2008 on h1b status?
What happens then? do i lose my 485 status because the last status i enetered on 485???

1. I am pursuing an MBA from Berkeley and aspire to start a technology based firm to create products that iron out inefficiencies in various processes. However lack of permanent residency is holding me back.
2. I have almost single handedly built a product that uses complicated mathematical models that saves US corporations millions of dollars in shipping costs. The directly competing product is built by a group of professors and PhDs. I want to use my current experience along with my managerial education to positively contribute to the society.
3. My wife and I plan on buying a house but again lack of permanent residency is holding us back.
In short, I would have contributed more to the society and have grown faster professionally if I had the security of a permanent residency.
Just because I happen to be from a country with a large population, I get hit by the green card quota and have to patiently wait for about 10 years when someone from a different country with similar qualifications gets the residency in about a year. Is this fair?

There seems to be no pattern among recent approval rate-My coworker didn't get any update from USCIS- he directly got his physical GC on 4th Sept.
We are still waiting, tried InfoPass, Raised SR, Contacted Senator etc.etc. I am willing to go to Lincoln,NE if that is what it will take to get GC:D

For eg.. I was talking to my friend in India and told him about the issues here, he did not understand, he thought I am having a tough time here and told me he has some friends in US who can help me out with immigration problems. When I explained our issues to some people here, some understood and some did not, they told me they know some lawyers who are very good and can help. One of my old employer started a new company in Atlanta and contacted me and asked me to join, but I told him I cannot because I am stuck with my ppresent employer and will lose priority date blah... he did not understand that and was confused.
I had the SAME exact problem, both, with people here (indian citizens who are now american citizens) and people back home. To the point where, once i was addressing a group of my community members and a couple of Indian american people absolutely REFUSED to belive that the Govt wud give illegals a better break than they wud give us, and that it had happened in the past. It took me half an hour and quite a few examples to illustrate how that was true.
About all the confusion with the priority dates. I Myself am confused about this whole Priority Date Nonsense. I mean the part about processing 485's based on PDs makes sense. Why you cannot even APPLY makes NO sense whatsoever. I have tried making a short speech to convey the problem to friends and co-workers. Each time it ends up being so long winded and detailed that it just doesnt make it worthwhile. Midway in the conversation, u can feel the other person mentally Yawning ;)

When employees post for job, they might say �need a citizen or gc holder�. But never say we only need a H1-B holder. So when we have respected and followed the rules of this country immigration becomes a right as logic life suggested.

These types of employment advertisements are discriminatory and are thus illegal unless it is work that requires security clearance. I am surprised that the Department of Justice is going after employers (http://www.immigration.com/newsletter1/doj_investigation.html) who may have advertised jobs for non citizens while not going after the numerous advertisements that discriminate against non US citizens. I am aware of atleast one high profile company that engages in this type of activity in its advertisements (however one needs to apply and be rejected in order to file a complaint). The double standard is indeed disturbing :

I am not aware of anyway to check if money order is enchased or not, because, I think, you have to pay money upfront when you buy money order. However, I can be wrong.

Absolutely there is a way to track if a money order has been cashed. The customer service # and order # for the money order are usually listed on the bottom stub which the buyer keeps. Just call the customer service #, plug in your order number and the system should tell you if it has been cashed or not.

Most immigrants apply for citizenship in developed countries for the sheer luxury of visa free travel to most countries and to bring their spouse/families closer to them without any immigration hassles. It has got nothing to do with renouncing all the ties with their home countries.
I know a friend who recently became a Canadian citizen and he said that he was murmuring a Hindi film song when the Canadian national anthem was played during the oath ceremony. The only reason he immigrated to Canada was to get a Canadian passport so that he can work in US and travel around the world without visa hassles.
I also have a friend who�s a US citizen and he was able to get his newly wed wife into US in 3 months. He visits India regularly to take care of his property investments, watches cricket/desi movies, loves eating food at the road side eateries and by all means he�s still an Indian at heart.
Citizenship is like getting an unlimited credit our existing credit card (GC). The more the limit the more flexibility we get. So let�s avoid bringing patriotic fervor into such posts.

BUT, when one makes a decision to immigrate - he/she's not just making that decision for himself - but also for his/her spawns and the future generations to come. Is it fair for us to rob them of (well, i know most american born desi kids don't care a rats ass about going/being in India) - what it feels to be an Indian at Heart? what it 'Really' feels like to be watching/talking cricket/movies on 'em gullies, what it's like to be eating gaadi chaat, what a festival should really feel/look like .. and a bunch of other stuff- -that happens only in India.

I would say the activity in state chapter participation is '5%' at best in contributing members. By that token, you can ignore the non-contributing members. I see thousands of messages in retrogression and like forums while I see hardly dozens of messages in state chapters forums.
Take the example of state Texas, it has one of the largest pool of House Reps in congress and folks impacted by retrogression in this state is very high. Most of these House Reps are anti-immigrant. I am not sure if it is for both legal and illegal. In TX, there is no state chapter activity for the last 4 months. I called for a meeting, not one responded. I think IV core should come up with a specific schedule for each of the state chapter meetings and also core team should assign a contact for each of the state chapters. Core team should also participate in these meetings to provide a directed leadership. If need be, induct more members into core team..

First step - Write to WWJ Radio and let them know your concerns about the airtime provided to such nativist views which will result in attacks against foreigners.
Second, let's all call up/attend his show and dispute his views with facts, such as Presidents Economical report, DoL statistics on Full-Employment Economy. Lets corner him on issues such as collapse of the Social Security system if number of Tax payers decreases, and how does he intend to stop it without increasing Immigration as American fertility levels are currently below replacement levels. We can ask him if he proposes the Government should increase taxes instead which will place him on a sticky wicket.

If Gandhi can sucessfully take on the mighty British Empire "where the Sun never sets" with just a loin cloth and a staff, We are better equipped with Megaphones and Placards! I don't think I agree completely. I called all of the lawmakers for the CHC campaign, and while you are right, I spoke to the assistants, they were all polite and promised to pass on the message, which is what matters in the end.
Lawmakers know that we do not have voting privileges yet, but they also know that we are contributing to this economy far greater than many. I do not remember the source or the thread, but this question was asked before about an online petition, but ironically, that is shown to be not as effective as phone calls.
If you ask me to sign a piece of paper, I might do it even if I am only vaguely supportive of the idea. But I will certainly not take the trouble to call (or better yet) go to the senator/congressman's office and present my case in person unless I really beleive in it.

Thanks for the reply and it is not an subsitute it is an original case .so your suggesting that my PD should be May 2007 instead of April 2001. But the problem is that attorney filed the labor certification in 2001 without obtaining the PW and now the PW has come up 71656/- so there is a huge gap what I was getting in 2001 and then we requested PW for the last years from 2001 onwards and now they are telling that they can not do it also if we download the PW from the archives it is still much more than the PW send by DOL. so is there any way to get the PW for those years in back. I hired a new and very capable attorney but what he is suggesting that if we could the PW for 2001 what we applied in application then it is a piece of cake. My occupational code is 15-1031 and it I filed from California, LA county. I will really appreciate for your guidance and suggestion

What if you get GC first and some problem with your wifes petition?....Gray area no one knows
What if your wife is on F1 (got EAD and AP) and she graduates waiting for a long time for GC ..can she jump to another status ...Gray area..If yes any problem with her status...no one knows
Can you start business on EAD...GRAY area no one knows
Do you think they will allow you to travel on H1 all the time if you have AP... for some luck ones yes but for some others nope...they are forced to use AP..
Its much horrible after getting EAD and AP and waiting....
Well you will realize " Nothing is better than nonsense...interim state"
Its good to have EAD and AP but its not worth waiting for so long after you get them.
We were successful in bring in some change...why don't we work a little bit more to fix the system and get the GC faster..
