    Advantages of EAD far outweigh the disadvantages. Unmarried individuals of PD 02,03,04(eb3) might have a reason to worry but not the rest.

    there is one other catch in EAD (not just for unmarrieds): if your I-485 is denied you go immediately out-of-status and need to leave the US. If you have maintained H1, you can stay until that runs out (no further extensions though). So there is a safety net that H1 provides because of which many (esp. primary applicants) maintain their H1 even as they use AC21 etc. Also recommended by Murthy, Fragomen etc.

    I watched the whole debate, unfortunately ( as expected) they never touched on the question we voted on or the other most popular question about Katrina. There were other popular question too like NASA related stuff which never made it.
    Anyways we all did a good job within a short time to bring our question to #2 in the most popular list.

    This question is NOT about Illegal immigration but Legal Immigration issues at the govt. level... What do you think of and plan to do about the broken naturalization process that is currently hurting nearly half million highly-skilled and taxpaying legal immigrants already working productively in the United States who find themselves trapped in a system that is taking years longer than intended. The greatest impact of the broken green card process is borne by the legal immigrants and their families. Some of the major grievances faced by the legal immigrants are that they are forced to be stuck with the same employer for years; their spouses not allowed to work, they have a very limited travel freedom and so on. With the current backlog in the system a highly skilled high-tech engineer could take up to 7-10 years to get a green card. Isn't that an unfair deal for a person who works so hard to fulfill his American dream? Again: This question is NOT about Illegal immigration but Legal Immigration issues at the govt. level...

    Illegal immigration has been a topic of heated debate and has received much needed attention during this election. In the midst of all the hype and bickering about ILLEGAL immigration, there is a group of people, often forgotten and ignored, who are caught up in a bureaucratic mess and yet are patiently waiting on the path to LEGAL immigration. This is a group of high skilled workers, most of whom have advanced degrees in medicine, engineering and science from Universities in the US. These people have obeyed all laws, worked hard, paid taxes and waited their turn, many for a decade, because of a system that is hopelessly broken and inefficient. I am one of these people and I have been in the US legally for 10 years and still years away from getting a green card. As the President of the United States how do you intend to address the problems faced by future Americans already living and working LEGALLY in the United States? Please note, this question is NOT about ILLEGAL immigration but about LEGAL immigration.

    A lot of people, including me have lost faith in IV. They are not going to pay. We don't know what IV is working on and we don't believe it can do anything. The sooner IV accepts it, the better. I have seen this personally in talking to people and you can see the evidence with less than 300 people contributing. IV needs to produce results first.

    Before you ladies jump on me with your (p)curses for personal attacks, read on.

    IV needs to figure out other ways to generate cash if it thinks that would help. One way would be advertising on the site. I think IV has built this website well and it is an asset it needs to use NOW. I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.

    A lot of people told us in Jan 2006, that IV will not survive. A lot of people thought that we wont be able to cross $10,000 mark. That includes myself. I did not think we would come this far in first week of Jan 2006. I hadnt met anyone else in core in person. I didnt know CIR will not pass in 2006.

    Things turned out pretty good as you can see, as far as support, membership and contributions go.

    As far as ads are concerned, I dont think we can generate more than 2000 a month in advertisement and its not worth it making the site look like a commercial outlet rather than a non-profit grassroots advocacy site.

    I don't get this. Who is sponsoring this person's GC? He must have a sponsor to get the EB-based GC. He can't show his job skills as cooking !!:)

    A desi consulting company brought him to the US. When they realized he wasn't going to get a project, they just didn't let go of him. Since he was a reliable guy (1. he can be trusted with monthly grocery payment 2. his labor can be sold later to others 3. he servres as an insider who can get information if other consultants are trying to be sneaky by getting their resumes marketed by another company, etc etc, basically he is an asset even thought he doesn't have a project), they just decided to keep him there. These companies don't have attorneys. They take care of all legal matters themselves. Now, how much is hte USCIS fee to file for labor? How much to file for I-140? Peanuts right? So they continue to keep his application active. How hard do you think it is to get fake references when you can make fake resumes. They have fake pay stubs. Fake experience. Fake this and fake that. Everything they do is fake.

    So to others who have said that this thread has to be dropped, and have said that these desi companies are right in doing what they're doing, or who have blamed the system - I think that you are one of those people who are involved in such a racket. I know that I have touched your nerves by letting the whole world about this (not that some people didn't know this already). Why else would you want this thread dropped?

    The next step should be to reply to the senator mentioning that the data is ambiguous and asking for a more clear response. Is it I-140 or I-485, does it include families etc. etc.

    Also explain to them that based on these numbers, it will take X years for a person to get a GC and that the system needs reform.

    I have worked with a senator's office for a completely different matter and they are very responsive - since you have caught their attention and already have a file open, it will be helpful to respond with a concise letter so that you can get more accurate information.

    I agree with you immi...I would love to have that but i believe its not practical...coz as per existing laws there are 140k employement visas alloted per year...if you are gonna use uncaptured visas from the previous years then this number would be >140k.. which would require a change in the law...with the current govt in power (inspite of the President being pro immigration),Iraq war,elections,Anti immigration sentiments before elections,etc..i donot foresee it happeneing anytime soon... my $0.02

    I saw in other thread that president is signing a petition related to backlogged passport application...well that is going on smoothly with out any hurdle..
    Dream act is introduced with out any hurdle.
    May be its the right time .They are unsuccessful with the illegal immigration (amnesty bill) .... If we try legal immigration issues now... may be they will be okay .... I dont think there will much opposition for legal immigration as there was for illegal immigration

    May be they will not agree on increasing the GC numbers or taking dependents out of the GC count but i am sure they will be okay recapturing the lost numbers

    It took me around 4 years. EB2 India, started as a scientist later physician and endless headaches ...... but its over now. Got my card yesterday. Its an amazing stress relief and confidence booster.

    I could have tried EB1 too but wasnt sure how it would turn out hence stuck to EB2.

    PD Dec 2005, EB2, RD for 485 Sept 2007. Welcome notice August 5 2008.

    For some odd reason I got a red on this forum. I dont know who did that and why. But I dont care.....

    For those who are waiting: Keep pushing and thinking of new ways of making this work. if you are EB3 try to become EB2 and even EB1. In the end all that matters is getting the card.

    As regards this forum. I never contributed but found this to a good source of information.

    Nope. I sent an email to Consulate. Tried reaching them..but no luck. VFS asked me to check back at 3:30 pm IST again..it seems they get the passport from consulate at 3:30 pm every day. Keeping my fingures crossed.

    I'm in the US on a H1B visa since Oct, 2003. My current approval notice
    (I 797) has an expiry date of April, 2008. However I do not have a stamp on my passport reflecting the expiry on April, 2008. The only H1B stamp on my passport was that obtained just before my first entry to the U.S on a H1B and the expiry date shows June,2005. I didn't have to leave the country since my entry date and hence didn't find the need to get the visa (current approval) stamped on my passport.

    Since one can apply for a H1B extension 6 months before the actual expiry date which will be November 2007 in my case and if I do so and obtain a new approval notice (with an extension of upto 3 years as I have a I 140 approved with my current employer) and if that notice has an expiry of April 2011, then if I go to the Canadian US embassy in Jan, 2008 to get my H1B stamping done in the month of January, 2008, will the new stamp have an expiry date of April, 2008 (current approval notice) or can I get a stamp valid until April, 2011 (based on latest approval notice)?

    Your help is highly appreciated.

    Thanks ak27... based on your suggestion, I have started enquiry on my case through congressman.

    I also talked to second level I/O and she told me that it may be due to pending biometrics (what a relief to hear that). She didn't give me any other details so still not sure what's going (no SLUDs yet). I haven't recd any finger print notice since my first one in sep'07 so that kind of makes sense.

    I had a infopass appointment today, IO informed me that my fp expired so that may be the reason for not approving I-485. He told me that my application had some activity on July 29. Later I contacted my congressman's office and they informed me that my fp will be refreshed and I dont need to take new fp.

    Why dont you call VFS and find out what's happening and if they can help you to resolve this?

    I might have more information than VFS. The VFS agents don't know what's happening in the consulate. The agents doesn't know more than what is already present in the VFS website.

    That's interesting...from my visits to various threads and from wait times of my friends (3 to precise) who recently got naturalized, the average time after receipt of N-400 to taking oath is around only 4 to 5 months.
    Good to know, thanks. Maybe we were reading different threads :) One thing though, because of the heavy rush of citizenship filing in 2007, combined with the election-year pressure of 2008, petitions were fast-tracked in recent years. There are so many confounding factors, anything is possible.

    I too have a similar case

    My wife had approval for COS to F1 recently before we applied for Adjustment of Status. She also got her F1 approval notice by post in August.
    Now in Oct, when I got her I-485 receipt number on the back of the cheque, I went to put it in the USCIS site to track case status online. There I found that the WAC# related to her 'already approved in Aug' I-539 COS to F1 had a status update in Oct.

    It says "
    ------------------------------------------------------------------------------------
    Current Status: Approval notice sent.

    On October x, 2007, we mailed you a notice that we have approved this I539APPLICATION TO EXTEND OR CHANGE NONIMMIGRANT STATUS"
    ------------------------------------------------------------------------------------

    I wonder what that means because same WAC had the same message in Aug
