I'm with Lingo since 2005 and I just changed over to the Hello World Max plan today (thanks to this thread). I called to ask if there is any penalty for cancelling and moving to Vonage since I am getting free calls to India and the CSR (a desi gal BTW) told me about this plan. She said there was no contract to switch and it would take effect from next billing cycle. She waived the plan change fee but wouldnt give me 2 months free like Vonage.

So for now, I'll stick with them since now I really dont have much to bitch about. My phone bill comes ~$60 right now (yes I make a lot of India calls) so am glad to see it drop in half.

As far as taxes go, it depends on your address so I think Vonage and Lingo should both be the same since the taxes are paid to Federal, State, County, City and they dont discriminate between companies. I know a friend who registered his phone in some god forsaken place since taxes there are very low but since this VOIP is my primary line, I need to have some kind of 911 service and am fine with the tax.

Here is the taxes for Lingo service for VA.

    Federal Taxes & Fees: 0.36
    Universal Services: 4.64
    State Taxes & Surcharges: 3.37
    County/Local Taxes: 0.00
    Presubscribed Inter-exchange Carrier Chrg: 0.00
Regulatory Recovery Fee for XXXXX 1.99
Emergency Services Fee for XXXXXX 1.99
    ---------------------------------------------------
Total Fees, Taxes & Surcharges: 12.35

Talked to lingo Customer Service now.
When existing customers change to the new Max plan, they have to sign up for a new 2 year contract.
Also have to wait till the next billing cycle for the plan to take effect.

    Hello axp817

I had soft LUD's yesterday (9/19) on all I-485 applications in my family and on the (July 2007) EAD's for my spouse and me. My PD is May-30 2006, so I'm wondering if they are looking at low-hanging fruit for the next month (or to hang the fruit!)

    Hi hinvin66,

    What is your I 485
    NOTICE DATE? IS It 9/18/2007?

To know the reason for that you simply have to see past visa bulletins to know how long 2001-March 2004 PD's have been current... the answer is: for a long time in late 2007 and mid-late 2008.

    Hello everybody,

I was just wondering why only the people (Eb2-I) with priority dates from 2004 get their I-485 approved? why dont people from 2001, 2002, 2003 dont get their I-485 approved?.....just curious to see how does it work?

The point was about abusing the system to get ahead in the line. In that way labor sub shares similarity with PD porting. If a person who landed yesterday fits the job profile and the law allowed it , then what's wrong.

On the other hand if those labor are sold for a price then it is serious problem. And thats why Lab Sub was eleminated. Now thats what is going to happen (and happening) in PD porting case.

any action should be against the so called "paid PD porting" cases. But why harm a honest EB3 person switching companies to go up the ladder? If he is getting the benefit of the rule, what is wrong? As long he it is done by the law, I do not see any problem.

Tomorrow, if you get a position that justifies EB1 category for you, would you not move to that category? Nothing wrong in that either.

I endorse Pappu's comments. Wrong doers can be punished. But people benefiting by a certain rule should not be.

    trying to understand your problem?

the goal (and you may have to chew on this a while) of this campaign is not to bend rules. it is to create media attention for our problems.
this may be a catalyst to anything- 485 filing, bridging amendments...who knows?

the point is we have to keep trying. sounds like you want to slink away into your "reality". well, since we are all living in fantasy, friend, please let us enjoy it. thanks for your encouragement btw.

Why would you want to do that? I am EB-2, waiting for GC but don't consider myself to have some sort of monopoly over EB-2.

EB-2 or EB-3 is not our birthright. It's just a matter of circumstance that many of us found ourselves in one category or other. It does not even necessarily mean any difference in skill or experience. There are many people in EB3 with Masters degrees and many people with over 10 yrs experience.

Dude everybody wants their GC. If you want to fight injustice fight for something positive. You will only get bad Karma by undercutting other people

Section 501 and 503 would help retrogression a lot.

Section 503 will do more harm and add fuel to retrogression. Either it shall be redrafted or we shall oppose without any doubt

Landed in this country on Aug-16-1997 for Masters. Today myself and my wife both got CPO mail/text message. Thanks IV community and good luck to all. I will be doing my part to make this system better!!!

    Details:

    PD: 04 Jan 2006, EB2 I
RD: 07 Jul 2007, TSC (I-140 was with NSC, but the attorney sent it to TSC in the july 2007 fiasco)
    ND: 27 Aug 2007, NSC

Didn't do anything in 2008 and decided to do everything possible this time around.
    Aug 3 - Primary I-485 SR,
    Aug 5- Primary EAD SR,
Contacted Congress Woman on Aug 9 - Didn't get any useful info. I think, being in bay area, they might have been flooded with these requests.
Aug 10 - Opened an Infopass for Aug 18
    Aug 16, 8:30 am - Dependent SR
Aug 16, 9:30 am - Called the customer service for primary's status - got the standard response that they sent a mail (which i didn't get) asking me to wait for 60 days.
Aug 16, 10:15 am - Wife called me to inform the good news, the online status change.
Aug 16, 10:18 am - got the text message (which just said "check your status online").
Aug 16: Got the CPO mail (time stamped 10:18am)

Guys (and Gals), Hang in there and you will have your independence soon.

    Regards,
Yet Another Greencard Wait (not anymore :)

Please donate some $$$$ to IV.

    good point.

We need to track the H1b approval date and the service center that approved it.

For those who don't know, the first three letters of the receipt number in you I-797 H-1b approval notice indicates the service center.

Like SRC is Texas, EAC is Vermont, LIN is nebraska and CSC for california.

    Please include this info too.

what about WAC? (I have WAC.)

If USCIS recaptures lost visas (estimated to be in the range 300k-600k), all of us will be current. IV should start a drive to push for the recapture ....even if it is partial, it would help everybody in a big way.

Thank you for the initiative IV core, now it is upto this community to take up the suggested action items and make it a HUGE success!

I am excited about these suggested administrative fixes:
    1. Filing for AOS without PD being current... the inability to do so is the bane of our life!
    2. EAD's effective for three years
    3. Same job description=> Similar job description... this will allow us to take promotions and transfers easily... something to highlight to our employers

Everyone, let's make this a grand success!

    Hello every one,
I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
    1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
    2. If they have earned full 40 points in Social Security
    3. If they have paid the tax continuously for 10 years
    4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
    and
    5. If they do not have any criminal records in these 10 years.

Please again do not just concentrate on the GC issues. Consider this and if any one can come with a letter draft with legal openion, we can send it to all Congress members, State Governers etc.,
Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.

5 years in US legally and paid taxes: get a Greencard.
    10 years ,,,..,, Citizenship.

I do not get a benefit in this directy, but the queue will be reduced

Lets go for it .. LETS DO SOMETHING... what are we waiting for...???????

Make sure you preserve your Social Security statement and IRS tax transcript. If you have a house - the HUD statement

Then meet meet with your senator and make the case. 10 years legally in the US - no longer want to be treated like an alien

IV must include this in campaign

Finally got the CPO emails/texts today morning for both me and my wife.

Came to USA in 1996 on H1. Masters (F1) from 1999-2000.
All GC applications in EB2. Nationality : India.
Applied in Mid 2001 : company (think $15B!!!) went kaput.
Applied in Mid 2003 : I quit in mid-2005 - while labor pending.
    Applied Nov 22, 2005 : Approved Aug 11, 2010.

Labor applied via PERM - approved in about 4 months.
I-140 applied soon after - approved in about 4 months.
    I-485 applied during the July-August 2007.
    Receipt Date: Aug 16, 2007
    Notice Date: Oct 1, 2007
    At NSC.

    Quit in mid-2008 with 485/EAD, sent AC21.
Got RFE in Sep 2008 (missed the 2008 boat).
485 LUD stuck at 10/29/2008 forever until today.

Opened a SR on Aug 5th.
Took an infopass on Aug 6th - all I could get was, "your application is with an
Immigration Officer since Aug 2nd". Nothing else!
Don't know if either had an effect.
Didn't do anything beyond the above two.

I think anything that's helpful for anyone based on dates/apps/process/procedures are all listed above. Now for a bit of something in my mind. No particular theme but general rambling....if you so indulge..please continue. Else Have a good day and happy life. And thanks IV.

It has been a long journey for sure. A lot of my friends who came to
USA in 1996 are now citizens. I have NO regrets at all. I took my own
path. Sometimes I used to think that if I had done the GC process
in 1998/1999 instead of quitting my full time job to do full time masters,
I might've gotten GC sooner. OR what if I had stuck with the 2003 application,
sure, it would've taken longer to get even the Labor cleared but I would
have gotten GC in probably 2007 - and worst case 2008. And heck, I would
have made an additional $150K (since the company got acquired by "as big
as it gets" tech company). OR what if I had chosen a very safe choice out
of masters [believe it or not, I got 12 offers back in 2000 - but then heck,
every body else got 12 offers as well]. OH btw, the full time masters ended
up costing me about $45K in credit card loans. So yeah...no point in contemplating
all the "coulda woulda shoulda"s in life.

As Nike says: Just do it.

I strongly believe it was because of the masters that I got the first 2000/2001 company, I got into the next job - and because of it to the next one and because
of that to the current one - where I am extremely happy and think
will over time come out very well off too.

At all times, I never compromised on my job. Took the job which offered
me the most challenge and allowed me to learn as much as possible while
working the smartest folks around. That I think was a great benefit - all
along - since that component of life (work) never bothered me. And was never
afraid of taking (apparent) risks either. To me they were calculated risks.
The 2002 company I joined, it was a small startup - I was employee number 20-something and was the only H1-B until we had about 150+ employees.
When I quit it was 450+ folks and was about 750+ when it was acquired.
The company I joined in 2008 (via AC21), was and still is a startup. When
I joined we were 8 employees and still now, remain lean-and-mean but
kicking some serious ass. (if I say so myself..pardon me). :)

The biggest hiccup as I think of it now was that my wife was not able
to work from 2003-2007. But the EAD in mid-2007 finally solved that
problem. Oh, I never hesitated traveling either : travel to Africa (three
countries) one year, and to Europe (three countries) one year and
Asia (two countries other than India) in one year.
Also purchased a home in 2009 (it was very tempting during the
2004-2006 times...but waited out for good).

So yeah...H1-B/EAD/AP are all handicaps - only if you convince yourself so.

A couple of times I had contemplated Canadian PR or really
moving there or to somewhere in Europe (and even Aus PR).
But pursued nothing mostly because I was lazy.

But all along my wife fully supported in everything I (we) did.
Be it change of jobs, other big decisions..what not.
So thankful to god for that.

Just a bit to go back in the way back machine.
Long ago, labor was the bottle-neck. Then 485, then something else.
Things repeat - old is new, new is old...repeat.
There were times when there was no online checking, no sms, no email notifications.
Six year h1-cap was strongly enforced. no concurrent 140/485. No one year extension of h1. No 3 year extenstions of h1 after 140. No 2 year EADs. No AC21. No priority date porting. I can go on....but a lot of stuff happened...happens.

If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.

A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]

Good luck and all the best to those who are waiting.
EB2-IC seems in pretty good shape as far as I can tell.
EB3-folks need some serious legislative help - please consider contributing a fraction of what you send for your immigration-lawyers and get something done. support IV.

    And finally: Be Happy!

    Peace.
