    Hi All,

    Please help!!

    I will be completing my first 3yrs of H1 in Sept 2010. My I-797 is valid till Sept 2010. I-94 & H1 visa expired on April 4th 2010.

    My company has applied for 1-129 on April 1st 2010.

    I have a few questions -

    1. Since my 1-94 is expired and H1 too, am "I out of status"? - I-129 is still pending, I have received the receipt from USCIS on April 12, 2010.

    2. If I am out of status, is it going to effect my visa renewal or H1 extensio?

    3. What to do?

    Your response will be highly appreciated, I am very confused.

    My 6 years on H1b expires on Nov 2010. I have 140 approved from company A.

    1.What's the earliest I can apply for 3 year H1b extension based on my 140 approval?

    2. If I switch to company B right now and get company B to file for labor using my approved labor's priority date, are there any time restrictions for filing H1b extension?

    3. Suppose I get a 3 yr H1b extension from company A, can i switch to different company after that using that H1b visa?

But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

    The answer should be "yes". The job should be offered to foreign national for processing his/her PERM or GC. However, the job can be accepted by FN, only after USCIS authorization. That authorization can be either H1 or EAD or GC itself. In other words, you can accept the job even after getting GC; however, in order to process your GC, there should be always a job offer for you from sponser right from begining(PERM LC).

    May be it is worth it or may be not....In www.cnn.com there is a section (on the left hand side) asking what the democrats should do first. (They are basically asking our opinion)

    I wrote down some items that I thought they should discuss, namely, in the area of legal immigration relief for EB categories.

    We probably wont gain anything out of it; at the same time, it doesnt hurt to send them our opinion.

    Yes it is legal as long as
    - the student is in legal status (valid I94 and visa/petition).
    - the student is not working/volunteering (peer discussion/helping other students may be ok) for that employer before work authorization.

    I unable understand what you mean by "Is he allowed to sign any documents on behalf of the company during this training ?".

    Can anyone please tell, can the employee be trained by the employee before activation of visa i.e. 1st of October. The employer is not paying employee any wages for his training. Can his training be legal ? Is he allowed to sign any documents on behalf of the company during this training ?

    What is the minimum requirement for EB2? From what I read, it's BS+5yrs, or MS+1yr.

    EB2, officially known as "members of a profession holding advanced degree", requires a "Masters degree". USCIS views a BS+5 as equivalent to a masters degree for this purpose.

    1. Is there a rule that the experience should have been gained outside of the US?
    No

    2. Is there a rule that the number of years experience should be from an employer other than the petitioning employer?
    Yes

    Hi Guys,

    I used to work for company �a� which was a part of the bigger company �A�. There was another company �b� which was a part of the bigger company �B�.

    Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.

    Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�

    Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

    You are OK if you are travelling on H1B. I never used my AP and always used H1B

    Don't panic. It will be alright you can resubmit the correct fee you have 30 days to do that. Sometimes USCIS can make mistakes even you submitted correct fee.

    Thats ok even if she doesn't have AP. That is perfectly fine. Don't worry her H4 is already stamped and she has time till next year. She is totally safe even if she does not have AP.

    What is the H1 premium processing fee and what is the regular processing fee ?

    I dont know your exact visa background, but why do you want to use EAD, it is always better to stay on h1, if you are planning to shift employer then do h1 transfer. There are lots of threads explaining the pros and cons of using AC21 and switchin to EAD etc... but the safest way is to stay on h1.

    If you can then i would suggest staying on h1, if you are shiftin employer talk to new one to ask for h1 transfer...
