My fiance who works now in OPT status has just got his fisrt-time H1 approval and will be travelling to India for our wedding in August. Is it possible beforehand to make an appointment together for our respective H1/H4 a week after the wedding? Thanks for your time!

Hello, I am on H1B with an employer with dates from sep 2005 to sep 2008. I am amending my petition (with a new lca) as well as extending it for the same company. The amendment date will be from April 1st.
Now my question is shd my extension (with amendment) be from April 2008 to April 2011 or can it be for the remainder of 6 years that is April 2011 to Sep 2011. Please let me know. Thanks

Sorry you cannot claim. You have been a resident of GA, so rent/meals/commutation/laundry cannot be claimed as deductions in Tax return. You never had a home in NY/NJ. You will surely be a RED flag for IRS. Dont do wrong things to get some money. State the truth and be satisfied of the tax return you get.
However, you can surely ask your employer to give a part of your salary as expense reimbursement, which is legal.
Trust me, you get more tax return here in US, than in India.

My I-140 will be approved shortly in premium processing and I'll be applying for 3yr H1 extension. There is a chance that I may get laid-off soon and I wanted to know if I can change the jobs while my H1 extension petition is pending with USICS. My current H1 will expire in June'07.
Sorry, if I am asking a question that has already been addressed here. I tried to browse the forum but could not find anything.

This question is for an attorney:
My spouse's case is this: She has applied for AOS I-485 (India) based on an underlying EB3 I-140 (PD feb. 2007) petition during July 2007. At that time she had also applied for an EB2 NIW self petition, which was recently approved in April 2009.
Two issues arise now:
a) The PD date of the newly approved I-140 is August 2007.How do we inform USCIS to capture previously approved EB3 I-140's PD. She has used AC21 to port to same or similar job, but he previous EB3 I-140 has not been revoked. Is it possible to capture previous PD?
b) Do we have to send new I-485's or can we ask USCIS to interile newly approved EB2 NIW I-140 to the already submitted I-485s. If yes, how do we do that ?

One of my friends gave me this suggestion - go find some voice over IV. Till Now I was least bothered but because the new anti- H1 B laws are being proposed ( Sen Grassy et all ) , I have to look at this angle. Because without GC , with those new laws in effect, it might be imposs to work here..

There are some questions I have which makes me think - is it worth the wait ? IF NOT then lets look at other possibilities including starting some business in Bangalore or going to Canada. I dont know- PL Help me out here friends.
When my employer filed for labor the the promised amt of some $90K in immigrant labor applocation. I could not make that much but I was around $72K Then I had to leave him and go work in UK for the same client ( since that was a UK based company ) and my employer got paid hiring fees. He was not aversive .
So for entire 2007 my income was 0 becos I was in UK working for this MNC and paying UK taxes.
1) Then in 2008 the same client called me back to US but it took some 2 months before they could finally begin my work there and only then my pay started .
So 2008 - I was only close to some $60K PA ( annualized but I was not there entire 2008 . I came back from UK to US around mid 08).
Then on there had been no problem 08 and 09 all gone well.
2 )I read the GC terms and it said - bcos GC is prospective thing, it has nothing to do with your current salary. But in realistic terms - is there chance of problem here ? looking at this ..?
3) If I am in Bangalore after Feb 10, permanently would that be problem in case the lines moves up and I am not in USA ? Will they think that because you are not in US ...and are not working for same employer , cant give GC ..?
Which one can be hurdle in final step 1 , 2 or 3 ? Or God only know

My employer did not allow us to file EAD and AP for employees. Only for spouse) and I was wondering if I can file myself. But I don't think we can do it without a receipt notice.
As far as new fee structure is concerned, we'll be better off paying the new fee compared to the old fee and attorney fee combined.

If the I-94 was not given a full year's validity due to passport expiring within a year, Is the I-94 still valid after its expiry?

I live in Chicagoland but my attorney is Ron Gotcher in CA (Calabassas/LA area), and I would recommend him very highly. The main thing I liked about him was that he is very reasonable and you can phone/email him as many times as you need to without getting charged left, right, and center.
I would recommend that you pick an attorney that is competent and charges a reasonable price, and one that you're comfortable with as opposed to where they're located.

The lizard is well exposed, but the composition bothers me some. Feels out of balance to the left because of the cactus. The flower & lily pads are very nice, but I really like the butterfly. Good subject isolation and vibrant color.
