You should ask both law firms to send you your 485 paperwork, assuming you are listed as the client. they might not send you any I-140 documents, since this was the employer's filing, but the 485 documents should give you what you need. You should write to CIS saying that you are no longer represented by attorneys and ask them to send all documents directly to you. Unfortunately, CIS can be very slow in acknowledging these requests, so it is likely that correpondence will continue to go to one or both attorneys.

EB3/EB2 categorization depends on a lot of other factors. But I understand your question is about base eligibility.
In general Masters requirement for a job is considered to be eligible for EB2.
Similarly Bachelors+5years exp req for a job is also considered to be eligible for EB2.
So your employers advertised job "could" very well be EB2 if all other conditions are met.

My current job desc requires an MS + 3 or BS + 5 years experience, with special certification like six sigma required. When my labor was filed, I had exactly 3 years of experience. The above was what I filed for my PERM application. I am planning on moving to another job where the job description is similar ( my i-140 is approved and my i-485 has been pending for more than 6 months) , but the new job requires an MS + 6 years or a BS + 8 and no special requirements. I gained 3 more years of experience with my current job description, but does that count since I gained it after my PERM was filed? Also, do educational requirements matter in order to port? any help is greatly appreciated..

H-1B Quota is still available for all employers. Employers who have not yet proceeded with new H-1B filing can go ahead now too as per their business requirements. After many years since the Cap of H-1B started, it is still available even after Sept. 30, 2009. As of this writing, there are still H1B cap numbers available, both in the advanced-degree and regular H1B quotas. This means that H1B petitions can still be filed for fiscal year 2010. These filings can continue, as long as the cap numbers are available.
We like to share that H-1B petitions can be filed throughout FY10, until the cap numbers are all depleted. Petition filed under the 2010 Cap after October 1, 2009, the start date of work requested can be immediate. Since October 1, 2009 has already passed, and the H-1B numbers are still available, filings may request an immediate validity date. Like earlier, the start date for H-1B work can be as much as six months in the future, depending upon the needs of an employer. Usually one has to start the H-1B Cap process 6 months in advance of the requested start of employment, employers were all doing so in order to increase their chances of obtaining one of the limited cap numbers. Thus, cases were filed at the beginning of April, requesting an October 1st start date. Hi Guys,
My wife is on H4 and she got her EAD yesterday. She wants to work on EAD.
She doesnt have valid visa in her passport, we are planning for India trip soon and also planning to go to US embassy for stamping as our visa got expired.
My questions are
1. Can my wife apply for a visa after she starts using EAD? and later can she extend her H4 along with my H1 extension which I'm going to apply mid next year?
2.Is it ok to travel just on AP for her if she doesnt want to apply visa?
Please suggest.

I am applying for a green card and my lawyer sent me a case number starting with an A and in the format : A-#####-##### for my PERM.
I tried http://pds.pbls.doleta.gov/ but it does not accept case numbers starting with "A".
Can you please tell me where I can go to look at the status of this application?
The attorneys have a login when they file the PERM electronically and only they can track or the employer can track it. As far as i know it is not open to public.

if you have copy of I-140 , it contains 13 digit receipt number (SRC, WAC etc..).

Shouldn't be difficult but it is the USCIS that we are talking about after all. Unless it is passed as law, it wont happen. A dual stage I-485 application process was being discussed last year but nothing came out of it. Piecemeal legislations will not pass as the public wants CIR not bandaids.
And FYI, EAD does not eliminate employer dependency—you still need an employer.

The I-140 was sent to Vermont, mine and my wife's I-485 have gone to "the office where they were transferred" (that really narrows it down) and my kid's I-485s were sent to Texas "it has jurisdiction over the case"
Since we live in Texas, I'm not sure why all our papers don't have Texan "jurisdiction".
My lawyers are inquiring with the USCIS and AILA (American Immigration Lawyers Association).

2) I also have a Consular-H1B petition papers from same company A which is valid till Aug,
2011. But i don't have H1B visa stamp in my passport.
*My question is:
Is it possible to do H1B petition transfer from Company A to Company B without COS from L1 to H1?
OR
Should I first apply COS from L1->H1 through company A and then apply for H1B transfer from Company A to company B.
(and I believe for COS to happen i need to be still employed with company A.)
I am not planning to go India now but wanted to apply H1 transfer and work for the new company B in case of my layoff from present company A
