You might have got classified as an Electrical Engineer by TWC, and likely Level 4 with 5 years experience as a requirement. If 5 years is really the requirement, and if you are an electrical engineer, or have an EE degree, TWC usually gives this designation. It is difficult to overcome this. Your friends who had lower prevailing wages must have been in different locations or had different occupations, or both. If your lawyer has lots of experience doing PERM, you can probably trust him.

Some where I read that there is no fee for renewal of AP. I am a Jul 07 filer and am not sure about this. Further already applied last year for Advance parole and traveled once. it got expired last month. I am applying for a new one again. So just wanted to know if I need to pay the fees $305.
So my questions are:
Does July 07 filers need to send the cheque for $305 for AP renewal. (My I 485 Reciept Date is Aug 2007)
Should we also include Biometric fee of $80?
And how much time approx is it taking these days for AP?

Your employer need to submit company's Previous year W2 and also it is better to submit ur w2(couple of years).

Hello sdouglas,
That is a problem with Swift and not with your PC configuration. I'm not sure why it would freeze or lockup when importing files. My best advice would be for you to uninstall Swift 3D and re-install it again. The problem should usually be solved. If the problem appears, it could be an error external to that of Swift.
Try re-installing your graphics card drivers if re-installing Swift does not solve the problem. If all else fails, try asking Electric Rain for help. It could be a bug =)

the answer is NO, neither you nor your attorney will get any correspondence form USCIS regarding your Name Check status/progress. However you can call the service center or take an Info Pass to get the status of your Name Check / application.

My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

This is a much talked about subject around these days. I am sure many of us who renewed EAD but had a gap in the expiration and renewal date and were on a leave of absence. Would this be a problem when it comes to the GC processing?

My daughter is 2.5 years old and is on H4. She is receiving some modelling offers for commercials and photo prints. I understand since she is on H4 she cannot work. But can I apply for her EAD and work SSN by which she can work on these assignments?
I am looking at this purely for my daughters personal development and no big money is involved but still I dont want USCIS to think she is working even though she is on H4.

Unfortunately, there is not going to be a hard consensus and a good satisfying answer until USCIS comes out and fixes the law. The problem comes from inconsistent USCIS memoranda as to whether an employer who moonlights on EAD has "left" his employer.
AILA has recognized this inconsistency and has provided us, immigration attorneys, with guidance on arguing why the inconsistency should be construed to mean that moonlighting on EAD while preserving H-1B is ok; however, nobody can guarantee that the USCIS will agree with these arguments 100% of the time.

That is not true. If she has her own EAD, she can start working anytime. Whenever she does that, she will automatically abandon H4 and her status will automatically become AOS.

Guys,
Let the flowers reach them; let the suitors file the suit. But don't you think we should start a 'Seek information' campaign. Each of us write letters and faxes to DOS and USCIS and request them for this.
In May'07 the DOS moved forward the visa dates by 2 years for almost all categories. Now since USCIS have already receipted (or will soon do it) all the June applications, they should be in a position to release the information on how many applications they received for each category and for each country. We will request both the agencies to work together and release some kind of statistics some predictions like what they expect for Sept visa bulletin and further. We are living in dark and information like this will give us some insight and will let us plan our careers.
Guys please think about this seriously, I think this is the need of this hour.

Can we go after State dept to have them make an administrative fix to publish 2 sets of Visa dates, one for Visa posts and one for USCIS. CIS Dates to reflect their processing length and allow for an early AOS application..

Matthew Oh is reporting that the USCIS is planning to deny EAD applications filed more than 120 days before expiry. Source is described as correspondence to AILA from the USCIS. Hmmm!
I thought I read somewhere on their website that we should apply 180 days before expiry.
