Does USCIS usually says this. i assume it should say "AP approved " or something similar. Have anyone seen this message on tracking your online case status.

I graduated in MS (I'm on H4 currently) recently.My previous degree is from India (passed out BCOM in 1999). I dont have any IT experience.
I'm talking with couple of companies about getting a H1. What documents I need to show for H1 for USCIS? Do I need to show any experience to USCIS?

In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

I am on H1-B, and about to apply for I140.
My wife has recently got a F1 visa (and her H4 visa has been left valid).
I am applying for I140. Is it ok to mention her name on my I140 as my spouse?

Your wife's H4 is no longer valid since she switched to F1. You cannot hold non-immigrant status in two different classification at the same time. However, I think it is okay and even expedient that you mention her in your I-140.

In the past week or so we have been receiving many requests for evidence on all H1b cases filed on April 1, 2009. The RFEs received by us and practitioners across the country so far appear to only request that the single page of the I-129 Data Collection sheet be sent with the TARP question answered.
Due to the passage of EAWA, USCIS is required to collect TARP (and Section 13 funding) information on each H-1B petitioner. However, by the time the new form became available, we had already completed our packages for the H-1B cap filing period for April 1, 2009. Therefore, USCIS confirmed that the new I-129 form was not mandatory and that only the one page (of the I-129 Data collection sheet requesting the TARP information) was urged to be included.
At the AILA Spring Conference in Washington, D.C., Barbara Velarde, Chief, USCIS Service Center Operations, mentioned that if the TARP information was not included in the filing, the petitions would not be rejected. However, USCIS would need to send an RFE for the TARP information. Unfortunately, this was not clearly explained in the USCIS fact sheet on TARP issued on March 20, 2009. Nevertheless, USCIS is required under the EAWA statute to obtain this information and the easiest way for USCIS to comply is to send an RFE. This is a very annoying and time consuming process for all us dealing with H1B filings, and even more confusing for the clients. We hope that USCIS explain better such crucial changes in future matters.

Just got 3 transfer notices from CSC saying applcations transfered to NSC. Applcations reached July23rd at NSC. 140 approved from TSC.
Anybody in similar situation....

Howdy,
You cannot file for EAD or AP unless your get your I-485 receipt (A copy of the receipt notice needs to be included in the EAD and AP application). The EAD and AP should go to the same service center as your I-485 application. The address will be listed on your I-485 receipt notice. Pretty straight forward, you can do it yourself, do not pay a lawyer for preparing these documents. Good luck.

My wife had concived for 3 days in June. During immigration medical exams Doctor gave her MMR shots and stated don't get pregnant for another 3 months.
After 15 days, We came to know that she is pregnant.
last week my wife had miscarriage after 18 weeks of pregnancy. Not sure it's because of MMR or something else.

Hello,
I am working on H1-B for sometime. My project ended 2 months ago and I had been on unpaid leave since then. My H1-B expires on Sep 30, 2009. My company applied for H1-B extension in June but got a RFE due to lack of evidence. My company replied to the RFE on Aug 28. and status has been pending since then. On Sep 19, I got an offer from another company. The new company filed for premium processing for H1-B transfer and her transfer application got approved with starting date of September 24. I joined the new company on Sep 29 but haven't notified her old employer yet.
My immigration is underway and has got an approved I-140 from previous employer. That is the reason I didn't notify them as I don't want to stop that process. It is my intention to move back to her old employer if the visa extension is approved and the current project is finished so that I doesn't have to refile her Green card.
Now the question is what will happen in these scenario and purportedly 'Last Action rule' of USCIS:
1) If my Visa extension gets accepted, which VISA will hold good, the H1 ext with original employer or H1-B transferred visa with new employer ? Where should I report for work and is there anything legally I need to do before I reports to any of them ?
2) If my Visa extension gets rejected, will my transferred VISA still hold good ? Will I need to do anything in that scenario i.e. need to go out of country and get her Visa stamped ?

I believe you know that re-entry permit is required only beyond 1 year.
I will say, don't wait. Have some documentation ready regarding your "emergency need" to be out of USA. Also have some documentation to prove your intention to permanently reside in US.
In case the officer asks some question. Just be prepared to answer, and clarify that you have proper intention to continue residing permanently in US.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. My friend and his family got their GC's approved last week. They also have Canadian GC. My friend is the primary applicant and she is currently in US, but her husband is in India. He did not apply for an advance parole and was planning to re-enter the country using his Canadian GC. Now that his US GC is approved, will there be any issue at the port of entry?

What is unemployment wage report? I read that many visa seekers were asked for this.

In McDonald v. Chicago, The Supreme Court reasserted today that individuals have the right to retain guns at both the State and Local levels. The Majority consisting of conservative justices---- Alito, Roberts, Scalia, Thomas, and Kennedy based their decision on the history of the second Amendment, where militias were given the right to protect their farmlands. At that time we had no organized police force, we had no justice system in place.
Who are the militias of today? The KKK-- the uneducated people, who generally do not work, collect welfare checks, and blame all their owes on the colored people and now the "illegal immigrants."
If the Supreme Court grants the right to local levels to enact gun controls, one can only speculate for instance what kind of gun control laws Maricopa COunty in Arizona will enact.
Due Process protects every "individual"; it does not say "citizens". And just like every individual has the right to protect themselves with weapons, every individuals also have the more fundamental right to live.
Although the justices said that the Second Amendment allows for a reasonable restriction of guns, their rationale based on history of the second Amendment gives the militias a carte blanche right to bear arms. This can indeed set a dangerous precedence.
