It would give some idea I think
http://www.usvisahelp.com/art_intent.html
In order to determine whether the alien truthfully represented his or her intent to remain with his or her petitioning U.S. employer after receiving the green card, the USCIS uses the standard created by Seihoon v. Levy. That is, USCIS examines the “rapid course of events” following the alien’s receipt of his or her green card. The Department of State has reduced this rule to a 30-60-90 day formula which USCIS generally follows. If an alien ends employment with the petitioning employer within 30 days of receiving his/her green card, then it is highly likely that USCIS will decide that the alien’s intent at the Consulate interview was not, as he/she stated, to remain with the petitioning employer indefinitely. After 60 days have passed, it is less likely (but still risky) that USCIS will determine that the alien lied about his/her intent at the Consulate interview. And after 90 days, it is highly unlikely that USCIS will have a problem with the alien’s change of employment

Chandu, my question is not whether HR dept can handle it properly or not.
My intention/question here is if an applicant is on H1 (most of the cases 5th or 6th yr of H1) and then loose the job and until he finds other job (has EAD but never used it) the applicant does not have payroll running during the break. then technically is he ok or does he has to maintain h1 status or does EAD protect him.
Coz until he finds a job and files for AC21 an applicant does not do any thing.
And what do you mean by satisfy AC21 criteria. unless you find a job you cannot file AC21....so during the gap (what is the status of this gap?...technically I am trying to find an answer. please point me to a link or document. If you are aware of it, else can IV find an answer to it)
"f you lost job on h1b and satisfy AC21 criteria then you are in pending AOS state and use EAD to work."
Chandu, thanks for at least answering my question.
Good luck for you!
EAD IS NOT A STATUS. EAD is given because you filed 485 and you are pending AOS, so you are permitted to stay till a decision has been made

SVN,
One irrelevant question: Why did you wait till Aug 15th, 2007 to file your 485 when your date was current in June and you could file in June 2007?
Just noticed your question - I was actually one of those stuck in the notorious BEC. As luck would have it, my Labor cert which had been stuck in local office processing first and finally made it to the second stage of labor was stuck there as well for months until it seemed like they finally were processing applications that had been received at the same time as mine. Then it happened - all labor processing centers were scrapped and everything was shipped in boxes to the blackhole called BEC. Little did I know then the upfront delay of months would be insignificant compared to the delay of almost 4 years at the BEC. In fact, my labor cert hadn't been processed by BEC even when the Jun 07 window opened up. As luck would have it though, in the month when everything was rolled back, my labor was finally cleared (thank god for small mercies!) and I was able to apply for both I-140 and I-485 when the window opened back up temporarily between July 30th and Aug 17th. Of course, I am still last in the line since USCIS processes based on application received data and not priority date! However, as I mentioned earlier, I am thankful to all of the efforts of IV that led to the window opening back up, which actually enabled me to file my I-485 and eventually receive an EAD (if not, would have still bee completely dependant on H-1, 11th year, now)

Well, that's fine then. Let's see how posts you will get saying how to find good jobs in Canada. Bye.
All I can say is that everyone has their personal reasons for the decisions they make. This thread is information exchange thread for those who are looking to move to Canada. This isn't about why one should go one place vs another.
I welcome you to start another thread where ppl can debate whether they should move to India or consider moving elsewhere. In fact, I will be happy to discuss the options there. But I request ppl to not divert the focus of this thread.

no you dont *need* an accountant... but accounting is a lot of work and if you do not understand the law and the IRS, then you could get into trouble with bad accounting...
Do you have to go thru an accountant to start a company?

I am sure the jury will say that you are not guilty if your wife supports your side of the story. Remember, the verdict should be unanimous. So go for jury trial and request a court interpreter to make sure there is no language barrier.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.
congratulation on ur grand success of getting green card.

This is unprecedented - NSC was doing Eb3 140's slowly and now they stopped.
NSC EB2 140 is July 5th 2007 (my friend got approval yesterday by filing in Aug 2007)
Clear your cache and then reopen browser - you should be able to see MAY 15th update.
Thanks,
Unbelievable :(
If it is any more ridiculous, it'll be funny.
NSC140EB3 is like a sunk treasure ... we need to send Prof Indy to look for it

Is it a guaranty or just assumption that we get GC in few months if we pool $300 ??? sounds to me is a guaranty.. can you back this up with reasonable explanation????
Sorry, if I did not state properly. I did not mean it and there is no guaranty. But if we have more money, IV core can go ahead and lobby with full force.
Apologize for the miscommunication.

In India, the govt. collaborates with the criminals to kill the citizens.
my friend, pretty much every place in US in unsafe.
from the news: "The motive behind the killing is not known but Murthy, an official of the state-owned Bharast Sanchar Nigam Limited (BSNL), quoted Vishal's friends as saying that some African Americans shot him after an altercation. "
Not to disrespect the read, but people should realize what they are getting into before they get into arguments or brawl. This is not India.

I was current for 2 months in 2008, didn't get. lets hope for the best
Thanks nrk. I am keeping my fingers crossed. I was current for two months in 2008 but did not get. So hoping for the best this time but again I would not be surprised if I don't get it, especially looking at USCIS/DOS works.

Best way to get more immigrants to participate in advocacy efforts by immigrationvoice.org for legal immigration is by communicating to international student organizations of various universities around virginia, maryland, washingtondc, west virginia north and south carolina. Arranging busses for the students is not a bad idea. Students once convinced why they need change in current immigration reforms for employment base legal immigrants will participate in huge numbers to attend the advocacy efforts done by immigrationvoice.org as they have more time in hand
What will students get out of it? Their Green cards are not stuck? Are you offering them H1B visa that they desperately want? They do not care about Green cards. They only care for scholarship, a job after graduation and H1B sponsorship from the employer. You are offering nothing from this list.
People whose green cards are stuck should come rather than outsourcing to students?
If we cannot help ourselves and stand up for ourselves, nobody else would.
I am trying to take at least a day off from work. I would lose money from my wages if I take day off but I am ready to lose money for the sake of doing something good for myself and family. Others who are sitting on their armchairs should also consider coming to DC if they want their greencards.

Another example my ex-boss in US had. There was a homeless person in his area and he used to see him almost every day. One day he decided to do something, talked to him and asked him to sign-up with his church rehab group, get him a job etc....My ex-boss was serious but the homeless promptly rejected all the offers and instead he just wanted to remain as homeless only. He didn't even want to try....
Thanks,
GCisaDawg
USA is land of opportunity.
Moral of the story, homelessness in this country is by choice not by chance!

they also link to official site (which doesn't exist yet) :http://travel.state.gov/visa/frvi/bulletin/bulletin_4427.html
Not only they got info but non-existent links too?

Per google 4427 is march 09 bulletin ? search (http://www.google.com/#hl=en&source=hp&q=bulletin_4427.html&aq=f&aqi=&aql=&oq=&gs_rfai=CcSAss09iTKqPGIGgjgO3jYmQCQAAAKoEBU_Qocve&pbx=1&fp=c370202d9debab36)
But again this date is in sync with the date someone reported from some other site, so guess that's it. :-(
