Thanks for the reply. So we don't need to disclose to employer that we are on EAD.

    AND
Also can employer discrimnate EAD, for ex: they won't hire people on EAD, can they do that legally?

    Thanks,
    And I agree
(both about the advantages of idea sharing, and that I think I might have darkened it a little too much past the 'ideal' point -
though as you say it is hard to judge such things exactly, when all our monitor calibrations will differ...
In a similar vein, mine looks a touch darker, and the greens a little flatter, viewed here in Explorer than when it was in Photoshop  )

I work as a dentist in a company which was held in partnership by 2 partners.I have a approved H1b and my I 140 is filed in May 2006.Now as of Oct 01 the original company is finished as the partners have seperated.I am confused about my case, if I have to file a new H1b and 140 or an ammendment or just nothing. The tax id number for the company which will now give my paycheck has changed. As for me my work location has not changed and I still work in the same position. Can I take paychecks from the new company which now belongs to one of the partners or do I need to inform immigration to refile H1 or I140 or both.Any advice is appriciated

AC-21 Public law 106-396 might be applicable to your case. Please read the last paragraph in page 10 from the following link

    http://www.uscis.gov/graphics/lawsregs/handbook/ac21guide.pdf

I am not an attorney. Use it at your own risk.
    Good Luck.

the reason for denial was regarding the Company B , they were saying that Company B doesnt qualify as a employer or agent so cannot employ me

The transfer was from Company A h1 to Company B h1 not from university h1 to compnay B h1

Visible Dust products used to cost way more than they were worth (they're still expensive, but not as prohibitive as they were previously). At that time, I found this article (http://www.prime-junta.net/pont/How_to/a_Brush_Your_Sensor/a_Brush_Your_Sensor.html?page=1), which offers a much less expensive suggestion. It could be worth checking out if you want to try a brush almost identical to the VD products without paying their high prices (a bit of "elbow grease" is required - just be careful to keep it off the sensor!). ;)

I was wondering if you file for perm with company B and then at the time of 140 try to get the 2002 date of the RIR which is approved,if that can happen then you may be fine.I can be wrong in this.

good point...i will try that option. BTW, i have made an appointment to see another attorney...lets see what they have to say.

People like your (friend's) wife are a shame to the legal immigration community. We come here to work hard and make a better living. I don't think, this woman deserve to be admitted back to the US and I am not sorry to be rude in this case.

No worries...i am in same situation...did my FP early this yr. EAD renewal card says "No FP available".

Sorry - did not check this thread till today

My RD was July 11 for both of us - got Ead for me Aug 2 with 2 yr validity

    hers is still pending

Mine shows no FP on file even though I did FP in Oct 07 ( less than 1 yr) That kinda worries me

Anyways PD is May 04 EB3 - so long way to go - and besides caring at this point when I see PD of 2006 getting GC

    Thanks for your replies.

My original H1 expired last week. And I do have EAD. But need to bring my spouse in few months on H4. So can i use my EAD while H1 MTR is filed. And then go back on H1.

    Thanks everyone for replying.
However, the opinions seems to be conflicting. Is there a place where I can verify precisely what the law says?
I have not stayed outside the US for more than 3 months since 2002. Does this exempt me from the cap?
I need to be sure, otherwise, I would have to apply for a H1-B right now with a consultant who is ready to sponsor me.
I'm quite reluctant to do this because the work involved with the consultant is not in my field and does not allow for good long term prospects. Plus there might be contractual obligations.
    Please advice.

    Thanks very much,
    Sick with worry.
