Yesterday night I have send around 100 emails to my friends and collegues here in USA regarding the efforts IV is making and helping out ! Some of them are already got their GCs but they know the Pains during this process.,

yes; if you are gaining experience from current employer it has to be 50% different.
Practical issue is that DOL analyst very rarely analyzes it as such. They just deny it stating that experience was gained through petitioning employer. Then you have to go through the appeals route and try to get it approved that way.

Just a dose of how things are on the other side. This may be more obvious when more companies start outsourcing.
On the other hand, this thing may not affect non IT folks.
My 2 cents - be careful at workplaces and try to avoid discussing about our issues with co workers, 99% of them are ALIPAC, NumbersUSA, Programmer's guild etc....

Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.
It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....
Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.

I have to agree. One has to be extra careful in such matters as it is a tendency of the "majority" to always point fingers at the "minorities" by generalization. What some may think of as advice in a shoplifting case could be very easily misinterpreted as "support" in the eyes of the antis.

We me and my husband took infopass on 95th day of reciept date
(11/28/2007). The USCIS officer was not that friendly, but she promised to send an e-mail to main office. The very next day (11/29/2007)we had an update on website that EAD cards were ordered and we got it today. The date on the cards was 11/29/2007. It worked for us. It is really depends on the officer you speak with.

I have listened to a couple of speaches by Bernake in NPR. Basically that guy is completely in the blank on how to handle the economy. He simply says, we are in this mess, because the lenders were very lenient.

Have you seen the BearStearns tumble and do you understand the cause and effect it may have had if Fed/JPMC had not come to its rescue? There is a very valid speculation that it may still have a ripple effect on all mortgage brokerage firms. For now, the Fed with its tourniquet with help from JPMC seem to have tried to stop the bleeding.
And regarding your solution, the market is in a deep trouble with the 30 year loan rates around 7%. There is a very high chance that it may go up because of the risks involved in buying mortgage bonds. This is amidst news that the housing market is yet to bottom out and it may continue to fall at least for another year.
Good try, even if I had a GC, I would be a little careful to jump into this market. Ofcourse, if I had a 30% down for a 250K home, may be I might get a good deal, but not many can afford a 30% down...

I am sorry for the situation you are in. The employer should be punished. Let me ask you:
1. do you have any email correspondance with the employer asking you pay for h1b fee?
2. if you don't then pose him a question using office email something like "how much is still pending on my h1b fee that i owe you (replace you)". Address this to HR or Payroll or the boss it self. Wait for the reply, and then take copy of it for record purpose.
3. if '2' does not work then wire tapping is way to go:

As per the law in New Jersy, one party should be notified and if you are recording you conversation, you are the one party and the other do not have to be notified. Are you using voip in the office? if so use wireshark to record the conversation. If not then there are devices available outside for cheap to do it.

Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. No offense to anybody from Canada. I am simply trying to illustrate the rationale about the GREATEST IDEA OF THE CENTURY, THE SILVER BULLET, THE FINAL FRONTIER TO ALL IMMIGRATION PROBLEMS - "point based system"!!!!! Oh really???
As such, Canada does not really have as many jobs as in US. Offcourse it is a fact that PhD and Doctors drive cabs in Canada because they can't find jobs, but someone who is not a US citizen finds a good job in USA because it is simply the land of opportunities.
I am not saying points system is the best, but opportunities play an important role and thats why US has so many jobs compared to other countries, though so many jobs are outsourced. There is always growing demand and the economy is huge and accomodative.
Canada on the other hand is still slow to add jobs it the pace America does because of the lack of infrastructure (As I have not been in Canada, I don't have much information on how things work, but I know for sure that getting jobs is very difficult)
We must have a seperate thread on merits and demerits of points based system over the existing system and the issues being faced in countries like Canada etc..

IV community, do you think there is anything we can learn from the Wisconsin gatherings??????????? They are able to mobilize 50,000 people or more in a matter of hours and days. IV campaign for 200 people is running for over a month! And as per the core team, we are yet to reach that number...............
BTW, before anyone takes up arguments over WI issues, you are focusing on the wrong issue. I am only interested in the number of people that are mobilized, and why is it that we cannot do the same.
