well there will always be certain exceptions everywhere....Michael Aytes did mention it publicly when he testified before congress in his document below

he does mention that all these applications will be pre-adjudicated just short of visa number. So officially in my opinion they will not go back to these applications unless there is an exceptional condition which makes them do it. I can safely say that broadly it's not gonna happen.

Having dealt with Americans in the past 8 years, I don't believe they planted evil designs in the current immigration systems just to get the best of us. The problem here is that people in this country have a very strong and almost unstoppable tendency to complicate things. Immigration system is one obvious example. PD date, quota, and ROW, millions of different forms etc. Its complexity is simply beyond you and me. Other examples abound. Legal system, taxation, state / federal relations, college admission, business dealing, etc. Once you reach teenage stage, there is no way you will ever live outside these sytems.
So why is this? First of all, Americans believe in fair and equal dealings between each others. Then natually they set up millions of rules / systems to even the play ground. Secondly, a complicate system is a lazy man's product. It's not a big deal if you can design a extremely complicated and all inclusive system. What's great is that you can make it simple and intuitive so even your grandma can use it, while at the same time it covers all objectives & purposes served by the complicated system.
My issue with this way of working is that the more complicated the system is, the more likely it will fail. Look at the space shuttle. Each of the one million parts was probably checked, double, and triple, and quandriply re-checked, but you put them together into the shuttle itself, you still got two space disasters in the past 20 years.

Same thing for the accountants. These specialists are taking advantage of the fact that ordinary people can not get a handle of the current situations and have to ask for help.

Hi I am applying advance parole for the first time, I am a july 2007 485 filer but never really cared to apply AP. Now I am planning to go to India in december what are my chances of getting my AP approved before that. Below are my case details:

The price of GC is what you assign to it. The value of GC is not what other people tell you it is. If you get depressed, make your life hell - it's because you chose it. My PD is 2010 in EB2 and I came here in 2004. I know what I'm getting into and it's my decision so I won't fret about it or get depressed. GC is just a document, it should not define you or your life.
Enjoy time with your Family, wife, kids - it's priceless.....a new sports car will also help. Life is a great gift and will have ups and downs....don't let GC define who you are. I rejected filing in EB3 3 years back with a big 4 consulting firm and changed jobs. I also feel this "promotion" thing but I chose to be in that position. My friends in India are all PM's and Sr PM's.....they got what they chose.
Life is decided by the choices we make, not GC. GC is just a document. Enjoy and celebrate life.

for your kind information, sorry for starting rats comparison here but I came to US about half a dozen years before you. my priority date is 2006 and EB3. also I recognize that there are ppl out there who came earlier than me too. Its very easy to preach 'Life is decided by choices we make', 'your luck/fate, success is decided by your own effort, talent', 'if you have it, ppl will notice it and you will succeed' etc. when you spend the most energetic, productive part of your life in a country, you would expect that country reward you with atleast opportunities to prove your mettle. not to say its immensely painful when ppl who came years and years after you get GC and grow leaps and bounds right in front of your eyes.

i have to travel India this month and returning US in oct on AP. What will be the validity of I-94 i am gonna get? AP expires in Jan 2008.
And what will happen if this i-94 on AP gets expired. Do i need to leave the country?

I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
That company is MSU software based in Iowa ( just in case if anyone knows about it ) .
I tried several times approaching USCIS as well as Congressman's office to find the details of delay / extended review status etc but all I got was we need to wait until the review is complete.
I had switched attorney as soon as I joined company B and they AC21 and I have copy of the all the docs including the letter requesting to remove the old company A attorney . Also last my company B changed the attorney firm to a different one and they did sent a new G28 for that .
I am kind of stressed until I see the letter which is going to be delayed because of the snow Storm :( .
I have sent the email to info@immigrationvoice.com just now.
Thanks folks for all your support. it really helps that some is there to here the concerns and provide suggestions .

My own case got denied by someone who'd only been in the job for 2 weeks and she denied it because she said I didn't provide a document which was not only provided, but they had two copies! AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.

My wife got approval notice from 10/01/2006. Her employer is willing to give paystubs from March 2007. Will this put her back in status so that she can file I-485?
We are planning to resign after she file I-485 at July end and apply for COS with 2 paystubs. Will this cause a problem or is it legal?
Could you please advice?

I read from a different post that you can file for AOS if you are out of status for less than 180 days. there is a section 245(k) which allows you to do this. I don't know the accuracy of this info.

I gave him the background, and my analysis, however, it exactly happened as you put it � the reporter assumed that I was one of the organizers, since I am so often involved in US-India affairs.
[b] Had I wanted to take credit, I would not have even mentioned Immigration Voice to the reporter (the reporter wrote �Emigration Voice�, on his own probably)
It beats common sense for me to try for credit in this matter � there is too much on my plate already, and I was not at all involved in this campaign. If there was absolutely nothing I was doing, then where is the logic for me to inflate my role or ego? But yes, I have been involved as an analyst, and well wisher, of this campaign and Immigration Voice by letting so many countless people � in media and politics, in the US and India � know of this very fine initiative.
Also, just by the way, more than two days ago, before this Indian Express story came out, another media, NDTV had approached me to help them connect with the people in the campaign � and I asked a colleague of mine to inform IV; and Aman was sent an email with the name, and contact details of the NDTV reporter in New York. Plus, the CNN-IBN reporter who covered this story (the same story / video about which many of IV people are so proud on their blogs) � she was instructed by her Delhi office to follow this story only after I spoke to their international affairs editor (him and I were talking about the Lal Masjid matter in Pakistan, and then we got talking about general matters, and its then that I familiarized him of this interesting campaign happening, and he immediately sent messages so that CNN-IBN should cover this story).
In fact even before Surabhi posted on IV yesterday re this matter, at least 36 hours before that I had written an email to Aman Kapur on my own and informed him that the news report had incorrectly mentioned that I am a coordinator of the campaign. After writing to Aman I considered my duty done � as any such little misunderstanding should be clarified between mature people who are in public life.

I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport. It's just a law point. And I wish you all the best in your endeavor. Bharat mata ki Jai.
Dear Friend, I know that I had pledged my alligiance to the Sovereinty, Intigretity of the country who had issued the passport I am holding. None of my actions are against that statement. However as I have moved over to USA and applied to live in USA permanently I should respect and love this country from the bottom of my heart.
I feel if I love my country of birth and sing its paises, then I should have stayed there permanently and not aspire to become US permanent Resident and eventualy US citizen. Since I want to stay in US I should love US more than any other country including the country of my birth.
Friend, most of us say that there should not be any country quota (I too support this statement), but sometimes we only provide the reason for keeping the country quota. We do not blend in to the US melting point but keep our seperate identity of so and so country. If you regularly read the posts in this forum it clearly displays that this forum belongs to a particular country. Many of the posters post in that country's language, posts any news from that country and some even say negative things about the nighbours of that country. Although I am too from that country I do not support that and want to present myself as an immigrant who want to reside and live in USA permanently.
I will continue to sing praises of the country I have selected and want to live permanently in (USA) and work to show that I am blending in this culture of this country and try to help remove any quota based on country of birth.

This is all time low for "Highly Skilled" "Highly talented" "High INCOME" group. For the issue that affects our life the most, we are asking IV core if we could still drop to $10/month or $1/month, realizing well that we are up against well oiled and very well funded machinery of anti-immigrants. WOW!!! Is there a competition going on as to how low this community can go?
This issue affects our personal life, family life, professional life, careers, professional life of our spouses, development of our growing children and still we cannot even come up with $20/month. After reading this, not sure whether at this time I am filled with more shame or is it more anger that is bothering me. Anyways, either of the two are lowest energy levels in human behavior.

USCIS does not process cases in PD order, because they can't. Thousands of files they receive, are sequenced in order they receive them at Centers. They claim that cases are processed in order they receive them. For them "Receive Date" is not what you see on your receipt, it is the date they physically received the case (thus if case is moved from one center to another, meaningful Receive Date is the date it was recieved by the last center). You see this data online status as "...we received (or transferred) your case on ...".
PD critieria is limited to certain countries only. Therefore, by and large, "cases are processed in order they are received..." works well. However, for India, China etc. where PD cutoff has to be factored, it is used merely to decide to work or skip a file (when seen in the receive date order). If PD cutoff date is very restricted, they will have to skip a lot of cases, which slows them down. If you sent your case on June 28, 07, with July 2, 07 as the printed Receive Data on your receipt, but the case where it finally rested, was entered in their database on Oct. 28, '07 (with a Notice Date soon thereafter), you case will not be looked at, no matter what the PD cutoff date is, unless all cases received before Oct. 28, '07 have been reviewed.
PD critieria is limited to certain countries only. Therefore, by and large, "cases are processed in order they are received..." works well. However, for India, China etc. where PD cutoff has to be factored, it is used merely to decide to work or skip a file (when seen in the receive date order). If PD cutoff date is very restricted, they will have to skip a lot of cases, which slows them down.
