Actually forgot to mention that two weeks back there was LUD's on my and my spouse case. But so far no LUD on my kid's case. So I doubt my kid's application has seperated from ours.
Any other comments, guys?
BTW, taking an info pass, is it mandatory that our dates should be current?

My GC is based on future employment. I am working for company A on H1, company B has applied I 485 and I 140 also approved. I will be completing 5 years of H1 early next year.
My question is:
Can company A apply my H1 extension for 3 more years based on my pending I485 and approved I140?

I know this issue have been discussed several times before, but I am trying to get practical answers from Guru's.
About to apply for my Canadian PR next week and my current status is
H1B (1.5 Years Left) and US GC Status : EB-2 (India) (Aug 2006), I-140 Approved , but havent filed for I-485 yet. As one could imagine Canadian PR is just a backup and I want to understand risks and potential issues in future.
1) Does appying/getting a Canadian PR before fling I-485 a issue? I know lot of folks did it , but was trying to see how you handled the issue at 485 Stage.
2) Although, I am not expecting my I-485 dates will be current very soon, what happens in case if I apply for 485 and Canadian PR is approved.
3) Can USCIS reject your I485 process if it sees canadian PR or do they send a RFE ?? I can always say that I will forgo my canadian PR once I get US GC , but do they buy it or would they make a issue out of it.

Can anyone define who (what) are the nonprofit organization that would be the exempts for the regular H1-B Cap?
USIS's website says they are the "institutions of higher education or a related or affiliated nonprofit entity" or "a nonprofit research organization or a governmental research organization."
I understand colleges and governmental organization are included, but what else qualifies for this category? I mean there are millions of nonprofit orgs...from the one that does important research for a state to the one that helps promoting the US. film industry to the one that cleans up streets for free....I'm just so confused.
Any little help would be most appreciated.

I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.
Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?
If you are out of country for more than a year, your 6 year starts over.

I obtained an H1B visa through Company A (starting October 2008) and the H1B visa was valid until September 2011, unfortunately in March 2009 I was laid off. As a result to maintain my status I switched from an H1B visa to a B1/B2 visa. I actually went to my home country and got the visitors visa from the consulate in my home country. In July 2009 I returned to the USA and entered the USA as a visitor on a B1/B2 visa.
My question now is what happens if I obtain employment. What does my new employer have to do? Since my initial H1B approval is valid until September 2011, can by new employer just take over the H1B without me having to go through the lottery system again even though currently I am on a visitors visa and have been unemployed for more than 3 months?

I believe you pay 10% penalty if you withdraw before retirement age, irrespective of whether you reside in the US at time of withdrawal.

I had my EB2 PERM filed and approved with PD of May 2007. Filed 140 for this already. Just today came to know that there is a October 2002 EB3 labor available for substitution at my company and matches my profile so I can use it.
What do you guys say, I only have two days left to file labor substitution, but my lawyers can do it. I have to decide fast.

My father (over 60 years) is coming to the States in June 15, and his B1 visa expires on June 24. However, my father is planning to stay until August 20.

You must mention ALL citations. Failure to do so can result in an allegation of visa fraud, denial of your application and even the possibility of being placed in removal proceedings. I doubt that either citation would provide a basis for denial of your application, but you should consult with an immigration lawyer before proceeding with your application.

your old 140 will still be valid even if the new one is deneid and as long its not withdrawn or revoked by USCIS. You should be able to get 3 yrs H1 based on your approved 140. Hope this helps.

The date you sign the form has nothing to do with the date USCIS receives your application packet.

I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

Got married in 2005.
If (Less Probability..) i get my 485 approved and not able to add my Spouse's to my 485.
What would be my Options.
Please advice.
