Has anybody filed lawsuit against uscis for EAD delays till now ? And what is the process for this, do we need a lawyer ?
You do not need a lawyer, I can guide you thru the process :) Yes, I know a few cases where plaintiff requested court to force the USCIS to issue EAD. Some people were waiting more than a year! Those cases were usually bundled with I-485 WoM. One case is well-known class action lawsuit Ngwanyia v.Ashcroft, No.02-CV-502 (D.Minn.). Government promised to issue EAD within 100 days for the class.

IMO, we all are in the same path, some ahead of others, but basically belong to the same larger SET. Some of us have faced the problems that students are facing now, and in all likelihood these students will face the same problems that we are facing now. More personally though, I always think, if only I knew more about the GC process back when I was in school( 12 years ago), I'd have been much better now.

I even has the print out from USCIS.gov in which they have mentioned that they will honor the date on which applications were received in the mail room but he did not budge.

My question is
what are the ramifications if
1. I apply for i-485 now.
2. get married and bring spouse on h4 and she remains on h4
and my I485 is approved before the PD is current so spouse is out of status for a short while before she can apply for AOS?

The one important thing people conveniently forget about CIR : the illegal aliens will NOT be able to apply immediately for a green card. Thats pure baloney being spread by vested interests like our self-appointed "Ombudman".
If you care to read the fine print, the original CIR has clearly mandated that all legal applications pending at the time of passage must be cleared before ANY illegal alien can apply for a green card. So assume CIR gets passed into law on 30 jan 2007 (OK that was overly optimistic :) ). All family-based and employment-based petitions with a PD prior to 30 Jan 2007 must be cleared before any illegal alien is eligible to apply. Anybody who has glanced at the visa bulletin might know that retrogression in FB goes back to 1980 in some categories. So, it may well be close to 25 years before any of today's illegal aliens can apply for a visa number. I would think that is sufficient time for congress to shore up USCIS to reach the strength required to process that many applications. This is the INTENT of the original CIR, what changes in the new (posibly more liberal ? ) version and how strictly USCIS will implement it is a different ball game altogether.
Realistically, it is highly unlikely that a democratic congress or the president will entertain standalone legislation like SKIL given the chances of CIR being revived. So chances are any relief we can get has to come through a comprehensive measure like CIR.
Assuming this congress and senate would favor CIR...

This was discussed before and I cannot find it now..but here is an extension of the degrees idea.
1. Get everyone involved in the GC process to make a copy of their degrees/ qualifications/ certifications/ patents/ papers/ publications/ etc
2. Format it into standard size (perhaps A4)
3. Get a stamp on each of those sheets that says 'TRASH' or something else - maybe 'REVERSE BRAIN DRAIN' or 'KEEP TALENT IN THE US' - we can work that out. - it has to be bold, in RED, if possible across the page.
4. Get each State Chapter to create a binder/ maybe more if we can get enough participation.
5. We can submit a copy of that to local congressman and senators. We can also put all states together and send that to the White House, perhaps.
This will take a lot of coordination from all state chapter...but it is doable.
Any thoughts???

What we need this time around is a basic introductory article describing the Green Card journey to the general public overseas.
What do you mean by GC Journey? Do you mean the various USCIS stages (labor, I-140, I-485, ...) in the GC process? If yes, I can do that. However, I am not sure when it will get done. What is your deadline?

No soft or hard LUD's sofar. :mad:

I got mine and my wife insurance with him for $15 a month covering 250K Term Life insurance ( We are on H1 )

merely talks of leaving- and that's free will aint it!
now individuals will discuss it based on their own experience, and fortunately or unfortunately the majority here belong to one country, it really should not offend you, although once again i repeat, i do not think it is ideal.
being so sensitive is easy here, bet you have much thicker skin at work in in your neighborhood. please show tolerance in your comments, that's all i asked. you can point out the same think politely, or gently refer to the irrelevance of the discussion which is clear anyway to most people. not a lot of contributors to the thread you may note....
oh and by the way- when threads like this are shut down, people scream free speech. everyone will dislike something when there are 10,000 people. please chill out. live and let live.

If you are market savvy you would take a term policy for the insurance and invest the difference between the term life policy and whole life policy premium and get a better return when compared to a whole life that on average has given a return of 8-12%pa.

My lawyer advised against filing AC21 proactively. His opinion is that it may trigger a big RFE requiring financial details of the new employer. How true is this? I have a feeling my previous employer might withdraw my approved I-140 on the advice of their corporate lawyers (Fragomen, who I believe recommend I-140 withdrawal as past of their standard procedure when an employee leaves). I would like to preempt that and file AC21 documentation.
Yes, most Attorneys advise against proactive filing primarily because AC21 has no formal process associated like form, fee, reciepting or standard. It is based on guidance, most times the AC21 docs may or may not reach your file.
Some Attorneys advise the HR to proactively file for AC21. There is one company (huge) where when you are being offered a job on EAD after AC21 - the HR dept makes a big fuss - asks for all documents like copy if Labor, 140, 485 reciept any any other documents and then makes you sign G 28 and then file for a G28 change in Attorney and associate AC21 docs with those.
