What about the false promises and carrots and propaganda of liberty, equal opportunity and land of opportunities? Of course they wont say its land of indentured servitude. Its our fault that we didn't figure this out, isn't it?
ummm...name another country which is better on those fronts which you mentioned (try to be objective with no rhetoric) ?
I do agree about the indentured servitude part but is it our fault we did not figure it out ? certainly Yes.
Try telling what your salary is to a person who is making the national average.
All the rhetoric about going back to India (yes I have seen random cases, heard anecdotal cases) is nothing but empty threats. I do not see mass exodus and highly doubt if it will happen in the near future.
Waiting for GC and then citizenship being hell kind of statements is doing more of a disservice than any real effort to help our cause. Growing up and acting like mature professionals with a proper plan like many active members who are working so hard is so much better than to open childish threads (the last para is not directed at you).

Outlook is very very grim without a bill from what I understand. EB3 India is going to be in a hole and EB3 PDs that are 2006 and later have a really long wait time ahead that they are not imagining. We are all hopeful by nature and look forward to visa bulletins with a positive attitude but such PD folks may be disappointed month after month for several years. For EB2 India it is important to know number of ported cases. EB3ROW folks also need to worry now. Their journey may not be that smooth due to spillover rules and high demand. We need to get data via FOIA to make a better guesstimate. Without such data we will hear various theories, predictions and interpretations from various websites and blogs that may not be always true.
As I remember our FOIA can take as long as 2 years to get processes. Now that they have preadjusted almost all cases ( Means they have all required information on hand for all pending EB based AOS , can IV push USCIS to work on our FOIA ? ) FOIA result can help us lot to convince lawmakers when CIR time will in sep - oct.

My Above mentioned EAD is approved today. I got the Card ordered mail from CRIS today at 7 pm...
My Wife's EAD e-filed same date as mine on May 28th is approved today. I got a Card Production ordered mail just now. MIne was approved yesterday.
There was just 12 numbers difference in Receipt nos.
Looks like they picked up speed as they reach the 90 day mark....

Hi,
The notice doesn't say that I-485 was denied. for I-140, it says notice of Automatic revocation. For I-485 it says Acknowledgement of withdrawl. It looks to me that my previous desi employer actually withdrawn the I-485 application and thats the reason it says the I-140 is automatically revoked.. But how can they withdraw my I-485 application ?
Thanks in advance for your reply.
did you file a new g-28? if not do that right away..maybe they denied accidentally
I think MTR will be successful in your case..it will just be a few anxious weeks...
Remember worst case scenario..go back to INDIA which I think is not too bad as a software engineer !! Cheer up...
DESI employers are the biggest dousche bags around..i have decided that I will not work for another desi

One big missing piece in your analysis - Country quota.
As per your analysis, there are around 125K pending cases. If there is no spill over (that is the case this year and that will be the case for the coming years as per State dept.), then EB3-I or EB2-I gets only 2700 visas per year.
Now, please redo your math and you can easily see that the current retrogress might look like there is hardly any retrogression.
This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?
So, 150 K plus whatever that was pending as of June 2007.
So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.
Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.
I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.

Exactly! You can not expect them to do equally well in Indian school system as what they are performing in US. The school system focus is completely different and there is no easy way out for kids/parents to adapt to it. I am not criticizing either school systems. Both of them have pros and cons. And all this discussion holds true when you have option to move to Canada. If you don't, then it's better to pack before the kids grow older. If you have kids then its easy to move to India before the Kid goes to 2nd or 3rd grade ie before they are 8 or 9 yrs old. After that there is no way you can take a kid out of school in US and expect them to be competitive in India.
This is based on US public school system standards (if you are homeschooling its different). I had friends when I was in India who had lived all their lives in Middle Eastern countries and even though they had studied in Indian system they felt it difficult to compete there.

Not baby sitter. I want to take care of my parents.
it is part of our culture, we all live together forever.
well then since its such a problem that they come and go so frequently, have you considered to move back home and go to US every few months to keep the greencard?? Why are you making them travel so frequently so that you can stay with them ??

This is a good discussion. Hope others benefit from it !
I recently purchased 250K term-insurance policy for $11.66 per-month from NY Life. I'm 30 yrs old and qualified for their top-level health rate (eating right and exercise has financial benefits !). I guess they are the only good ones who sell policies to H1. Also, my policy has terminal illness coverage meaning that they'll pay out the amount in-case of terminal illness even if I'm not dead. I have another 100K coverage from employer (no cost). I'm not covering 10 times my current salary but I'm calculating by using equivalent Indian salary and not US. I consider myself amply covered. Also, my policy will remain active even if I decide not to wait for GC and move to India.
Now my 2 cents about Term vs. Whole Life debate. It doesn't make any sense to buy whole-life at young age. But since the cost of term maybe prohibitively high at 60+ one should convert to whole-life at some point unless one can find/buy a fixed rate policy till 80 or something (plan to die a little b4 that :D )

Even if we concentrate only on getting our money back, USCIS will be scr..d big time. The total money will be in Billions.
They would just increase the fees , and we will paying them that money back.
State never looses...

Hello To the IV Core Committee,
Thanks to you all for the tireless efforts in pushing the immigration reforms forward .
I just wanted to take this opportunity to give my thoughts on this important Bill HR 5882 that is due for hearing on the 23 Sept'2008 after several postponmetns / adjournments.
I guess that we are fortunate that our Honbl Prime Minister Manmohan Singh is visiting the USA during this week and is scheduled to meet the President George Bush to discuss various issues related to US - Indai Relationships / businessess etc.
I feel that if the IV Core committe makes use of this golden opportunity to meet up with our PM and request him to also discuss on the pending immgt bill that would help several of us.
I'm not sure how best this advise of mine sounds, but i think there is nothing wrong in trying out.
Hope the IV core committe consider this view of mine.
Thanks again to one and all and in particular to the IV folks.
Regards,
Rav

Patton Boggs is a lobbyist hired by IV, Can he help in this situation ? It may be the case he already may be working to get something thru ..
we all write to Bernake that some 10, 000 immigrants will buy homes if we all get a GC. 10, 000 may or may not buy a home, but let us just polish the numbers a little bit. 10,000 * 300,000 (average home price) = 1 million billion dollars . Actually the total figure is 3 billion $$; enough to give a massive jolt to the sagging economy.

Friends I need an opinion regarding my wifes situation. She is currently on H4. She was on H1B before some time back which she had stamped in India itself. That H1B expired. She moved back to India. After 5 years now she applied for new H1B and got it in the quota. When the dates advanced we applied for her EAD. We were hoping to get it in 60-70 days. Now its been 75 days at TSC and no signs of approval. She had job offer based on EAD since we thought might as well use that. Now we are thinking she should get her H1B stamped because we dont know when her EAD will get approved. For that do you think going to Canada for stamping is safe. She has a Bachelors degree from India. Or do you think going to India only is thesafe option. Mainly I asked was I did some search and found out that its safest in Canada if you have US/Canadian Degree. Is that true or I am wrong and its safe for everyone. Thanks.
