Looking at the Labor cert , it says "Masters degree" and NOT "Masters or equivalent". that might be the caused the I140 denial .
Any one had this situation before ?

Both Franklin and GooblyWoobly have a valid point, but let's not offend anyone on the forum. I see a trend on this forum where some people are trying to differentiate people who attended the rally and who did not. Should we divide the forum to 2 groups now? One being "attended" and the other "no show". It is totally childish... I contributed some money to IV as well since I believe in its effort, and I did not include that in my signature to say "contributed $$$". Do not take your frustration out on anyone 'cause you know other people have the same right... I am not a programmer but it is a endless loop...

I had all paper work ready for PP and were sent to my Lawyer for premium processing of my Sch. A case. But retrogession occured that night in Nov. visa bulletin. So my lawyer advised me that it is not advantageous to go for it unless your date is current. So we did not filed it.
As I remeber you were not ready for premium process. Any reason or justification for rethinking your decision? let me know if you can outline some advatage of PP of Sch. A at this point, or have seen some cases which enjoyed some advantage due to PP very recently.

I tried the following a couple of days ago.
i got a letter from my company about my status and issue with retrogression, I took a printout of the webfax from the IV site and sent a certified mail to our state senators (i am from CA). I think this is better than a web fax, i am not sure if they even read the web fax. I havent received a response from them as yet, but i am sure i will. Others can try it too and see if they get a response.
I did this because a senior manager from my company got fed up with his visa process and returned to Canada last month. He was ROW EB3 when he started his process.
good response. we are all in this together and need to work together in order to get things done. IV is not just IV core but each and every member. each member should try to do something positive in order to help IV in whatever way theycan. - contributing money, help increase members, contact their local lawmakers and also contacting media. we need to raise awareness andevery small positive action done by an iv member helps in the overall scheme of things.

If I understand your question correctly, then if you are using H1 then you need to be on payroll all the time. Does not matter whether or not using AC21. This applies even after 180 days of your AOS. If you use EAD then you can be without a job.

I am very sorry. I know exactly what you have been through. My wife also experienced a very complicated pregnancy. My baby *nearly* was born prematurily. Then Thanks God that did not happen. I felt all the pain because my wife was kept flat on bed rest for 4 months.
To make things more complicated, the doctors made an apparent mistake and mixed two type of incompatible medicines which made her develop fluids in her lungs. She was transferred to another hospital, in which a young doctor, an intern, believed she had developed a blood clot on her lung ! She was submitted to several exams to determine that was not a blood clot.
The bill for all that ? $40,000+. If I had to pay that on my own, I would be in bad shape.
In this country is dog eat dog, rat eat rat. It is about money. I am still happier here than in Canada though. That varies from individual to individual though.

My PD-Oct 2001..Eb3..My wife RIR-almost making it thru I140when all hell broke loose in our lives...my wife was pregnant and because of stupid gynaecologist..she ended up in hospital with complicated premature preganancy..guess what..as if it was not bad enough..her company got acquired just when she was admitted in hospital...imagine wondering about health insurance when she was kept to bed rest with no mobility allowed..we filed for insurance by mistake..which said that 20% in patient.....we were so shaken that even human resource did not advise us..guess what..baby was born..and it was surmised that baby will have long stay in hosiptal...2-3 months(eventually it was 4 months!)..somwhere around the first month..I realized that her insurance..will rip me off..I called right at the end of the first month..and tried several times to put my wife and baby on my insurance so that i don't end up paying 20%..it was lot of efforts until I found some desi in Blue cross insurance who put the whole family from the first initial month..when normally people get the policy for the following month at that time.
one down --and then another came..my wife was called to her office from hospital saying that..since there was lot of work in her office..she could come for some days..guess what..she went back..thinking..she could finish work and then take extended leave....guess what..she was laid off..and with baby in hospital..and lay off..plus a rush to change her status to H4 visa..imagine the workload.....finally got her status changed..to h4 visa..with GC and labor in trash...
I was so disgusted..that I started writing to Governor Shwarzenegger' office..who put me with Senator Diane Fienstein..and of course labor secretory Chao..after all the correspondings..all I got was my D number listed from Dallas..their sympathies...ALL I WROTE to them..Hey I want to change jobs because in those days I was commuting between LA to San Diego..where my baby was hospitalized...I wanted to be with my baby..and not work..but it was not possible..if I did..then I could get out of status...I even wrote to Department of Homeland security...and got no reply...they don't care..I ahve to be illegal to get sympathies..I guess!
Situation was bad..finally baby was out of hospital and I weathered all with help of Almighty...and now I am so disgusted with system..that I am moving to vancouver...
But I have another pleasant surprise..my boss wants me to work from vancouver and visit office once in a month...I don't know...whether it is possible...stay in vancouver and visit LA for 2 weeks and then go back and still maintain H1 status..

While some members might have jumped too hard on the whole thing, Some stuff goes unanswered.
1) Why has not USINPAC endorsed IV all this while on their website? Does not USINPAC know any thing about IV?
2) While I understand the importance of fund raisers for politicians, why USINPAC has not involved US citizens of American origin to contribute to the cause? What about grass roots efforts?
3) I dont have the exact statistics, but I am positive that every one out of 2/3 Indians living in the US is plagued by this problem of GC. How come Orgs like USINPAC are not pushing this by all means?

I personally am neither defending the outrage of some members nor appreciating it, but most of the Indian American citizen community does not want to be in sync with the plight of Indians immigrating to US.There are various reasons. Most important one as I have seen, Many in the Indian American citizen / Indian Permanent Resident community run consulting companies and they would hate to see these guys slip away from their hands by getting GC's. Fcuk, its like the damn door closes right behind you. I am positive most of those shops will come down to earth if Indian citzens start getting their GC's. May be its time, the Indian American Citizens/ Indian PR's ask themselves, what they really want. I have been to some Indian regional association meetings and the big guys or folks from my generation ahead would love to see their kids get married to an Indian or would love to see their kids grow with the rich heritage, but damn it, they just want it to happen with out doing any thing.

Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.

If this is the kind of ideas the �lobbyists� QGA is giving us, may we need some fresh blood in helping us out. I completely agree �eb3retro� in working with AILA.org in helping us get our message across.
