While this question may sound redundant, I want to make an honest attempt to understand it. How does creating media awareness translate into making politicians understand the complicated issues suffered by legal immigrants? Further do they give any weightage to the fact that the stories are in the media and therefore they need attention?
I am biased towards the opinion that we might have already run enough media stories. I believe that the real fight now is to convince the politicians to do something about it. Propaganda and lobbying is the only thing that works with politicians in this country. And you have to choose a medium that politicians directly refer to. Meeting politicians and their representatives in person is most effective I believe. With due respect to your views, Pappu, can we discuss some of these questions?

1) I downloaded the form G-639 from USCIS website just now , after briefly going thru it seems like just I-140 approval copy should not go above $25 , may be less. However much complicated requests will add higher costs.
2) No, employer will not get to know. I dont think they sends anything like that to employer. After all you are the beneficiary of the I-140 petition. Its not that you are getting "Tax Returns for Company" by using 3rd party tools.
Rather moving forward USCIS should make it a rule that I-140 should be shared with the beneficiary as well. I-140 is meant ONLY and ONLY for you.

digging through my old documents now.
I was mistaken reading the labor cert application. It did say "we accept BS + 5 years progressive experience".
I am 3 year Eng diploma + 1 year Eng post Diploma + 10 year exp in India + 5year Exp in US before filing Labor Cert .
I do have a copy of the Educational evaluation used by my old attorney which says US master equivalent.
As one member pointed out , there is a possibility that my original employer might have sent a letter saying Labor cert has mistakes but I have no way to confirm that . Or it could that the Officer is just trying to find any small thing to make the case deny.
I am digging all my old docs to give it to my attorney and see what he is going to day .

Greetings! I have been watching the flower campaign after I got the email last night in IV news letter. While We are extremely happy getting the media coverage we needed, we are ignoring one thing. There is one more important issue that we are missing here. USINPAC is rapidly claiming that they are behind this whole thing. This is more than plaigarism. some of you might say that this is not some thing as we should be considered about media attention as our primary issue amidst of this whole thing, but this can come back hurting if USINPAC starts claiming the credit in more sites. If they go beyond the cliff, they will do their own press release to claim credit and it gets more messier at that point. If you look at their press releases, they clearly denied us any credit by refering to the org as Emigration voice. I am positive reporters across the worls know the difference between Immigration and Emigration and whether people from India immigrate to US or emigrate to US. I feel that this is deliberately denying any google search for IV

I am going to call them first thing tomorrow morning and explain them to clearly give credit to Immigration Voice (with clear spelling) for the flower campaign. He is also the very senior columnist and well respected media person in Delhi. Being a Bachelor and previous personal assistant of Rajiv Gandhi, when he was a PM, he has never entered politics and very honest altruistic man. Calling him a fraud should be incorrect.
I have personally spoken to him in Last fortnight several times and create a campaign for immigration issue in Indian media. Personally on my request he has taken up this issue. He has very great regard for Immigration voice and told me to join as the volunteer of IV. He never misrepresents for any fame, and he has been quoted by Indian Media on any US affairs. Indian Media does not have a clue to diiffrentiate between USINPAC and IV. He never have any malicious intent against IV and does not require any personal credit. I have not spoken to him after reading this posting and I will again post my reply after talking to him.
Three years ago myself and Robinder met with US consulate general in India and requested for working on making E-1 and E-2 visas available to Indians by creating an envirnment to make India as the Treaty country. Eventhough we have a long way to go still periodically he is pushing this initiative out of India.

How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would allay a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.
What do you guys think ?

Most also believe that the system needs to be changed for the better. But just how this should be accomplished is not so easily agreed upon, and so it is a hot-button issue. Many of the hardliners, who took a strong anti-immigration position, lost the recent elections. But there are some who took this stance and won. It also is widely believed that many of the newly elected Democrats expressed anti-immigrant sentiments in their campaigns. Achieving any strong pro-immigration measures may prove to be more daunting than originally was anticipated; certainly more than many hoped it would be. Needless to say, we can expect 2007 to mark the beginning of a time for change and flux in the arena of U.S. immigration law. There is a possibility the DREAM Act could be passed, allowing the children of undocumented immigrants (who complete their high school educations in the United States) to obtain conditional "green card" status if they enroll in college or join the U.S. armed services. I would like to know if a person who has H1 valid until jan 1, 2009, files for AOS on oct 5, 2008 and then goes out of the country in Dec 08 and get paroled into the U.S as "AOS" in his/her I-94, using AP. What happens to this person...is he/she still deportable even though that person is now officially on AOS.

Based on the example Sunny has provided, this person will be under parolee status till (whichever occurs earlier)
1. End of the date mentioned in the I94 when peroled in to US.
OR

From then onwards he will be deportable if his/her I485 is denied. Then his illegal presence will be counted from the next day of either 1 or 2 (mentioned above) whichever occured first.

I am not saying that it is working on the USCIS. We dont know yet coz the flowers start reaching there tommorow. If it is working on USCIS, we would know by the end of the week. Not now.
But it is working on the media.
What I am saying is we are getting a good amount of attention from a lot of newspapers - which is important to create more awareness on the plight of half a million law abiding immigrants and the backlogs they are facing.
Make it as visible as possible in the most peaceful manner. Thats the idea here. I think we must keep the flower campaign going and encourage more members.
I sent mine out on Saturday and is scheduled tomorrow.

People who left employer early or want to leave early will say it is ok; because it suits their needs.
People who plan on staying later or don't have any intention of leaving early will say to stay.
Bottom line is it is upto everyones own risk tolerance. I have just seen some of the biggest cowards in terms of immigration all of a sudden get so brave after they got the greencard.
If people are waiting years and playing it safe then what is the possible harm to wait a little longer and not get riled up by every small story of someone who got questioned at citizenship time, etc.
Immigration laws don't change very often; however, uscis interpretations and memos do change quite frequently. When you have to start hiring lawyers, go to court, face uncertainty then we'll see how brave people are.
As I see it, hiring a lawyer is still cheaper than losing 20K per year because you are working for a exploitative consulting company. But if the company is treating you well, there is no reason to leave.
