kudos to what u accomplished in July 2007, but the reality is we haven't seen any major action after that. I guess its mostly frustration from ppl here, who think that the US housing/EB crisis can be pursued aggressively than expecting for CIR to happen.
thanks
Your suggestion to pursue this option gels really well with the below proposal
http://immigrationvoice.org/forum/showthread.php?t=23962&referrerid=15623
To quote realizeit:
"I believe the above proposal is a small step in the eyes of the protectionists where as it is a big leap for all retrogressed country applicants. We may be able to achieve this using administrative fix or an action from the Executing branch, as this won’t change the annual GC quota of 140000. Apart from this, this will encourage all those skilled immigrants to invest in American economy within 1-2 years of filing AOS application. At present most of us are sending our money to our home countries as our situation is so uncertain. This effort will definitely help the ailing economy and will serve as a boost to the housing market."
thanks

Hi everyone.
I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.
Thank you

Spartan King Leonidas and 300 Spartans fought to the last man against Persian King Xerxes and his army of over one million soldiers. Aren't these stories that inspire us and generate admiration about those brave few.
Now, the 300 number at San Jose is incorrect. There were around 400 to 450 people there.
When flower campaign started it was just a few people. They never waited for a large number of people before starting. Others were inspired by their leadership. This effort became huge, even skeptics joined in, smitten by the contagious enthusiasm of rest of the members. Same with San Jose rally. We just had five days to do it, 450 people showed up, that is amazing.
These two small successful events were instrumental in change of July visa bulletin fiasco. This clearly demonstrates that your argument about small numbers can't make a difference is incorrect. We have a past precedent of successful outcome based on a small grassroot effort.
As Andrew Jackson said, "One man with courage makes a majority"
Lets be leaders rather than followers.
On the other hand if you still want larger numbers than join us, we need your help. We have a Nor. Cal yahoo group where you will meet a lot of motivated people. Your neighbor was part of a 35 or so people who flew from California.
PM me and send your phone number if you want to chat. I can explain in more detail.

Honestly though, OP's proposed law would get much more congressional support than EB reform.
If first you gave amnesty, and then allowed ppl to sponsor their parents on a GC, the illegal immigrant lobby would be very very happy.

Ours was filed in NSC - July 2nd (hand delivered is what lawyers say.)
I had 1 question.
How long should we wait for receipt to be issued? I am concerned if USCIS misplaces package or something happens, we would miss window of opportunity to file.
Also since lawyers say its personally delivered, how do we track/keep proof that ur package was delivered?
Should we just go ahead and re-file if we dotn hear from CIS in 10 days?

pappu,
With limited information, it was the best I could do :)
What is your take on all these bills.. I am sure you have much more info. Do you see any hope of EB relief in 2009?
There is growing pessimism in EB community.
We have some rough plans for 2009.
We need to wait for some time to see how immigration bill becomes a priority. We anticipate some more placeholder bills that will make a statement. However in the end, there will have to be a bi-partisan effort and strong will to write a CIR. I feel economy will take priority initially but they will have to look at immigration sooner than later. Admin fixes is another possibility we see. While the EB2 India and China are now getting direct benefit from horizontal spillovers, in 2009 we need to meet again with the administration and make a good case about EB3 India, China and EB3ROW backlogs. The problem seems to be increasing due to limited visas per year. This is the reason dates have not been moving. Several Other small items for admin fixes are also in brainstorming stage. Like We want to address processing delays on all applications for all categories, do something to protect the rights of immigrants, etc.
We also want to involve more members who got their greencards or immigrants who are now citizens on IV. We want suggestions from members how we can do that and get their support for this cause.
I am sure with the new initiatives you will love Immigrationvoice more and want to come to IV everyday.
At your end, please try to spread the word about IV. We can be successful in all our initiatives only if we can get more participation. Thus we need to get more EB India, china and ROW members in the IV fold. This must be our top priority early this year before we launch our big campaigns.
We look to members reading this post to help us reach out to their friends and introduce IV to them. We have well meaning intentions for everyone in every category and country and want to help and bring relief. It is important that we come together on IV and make a united effort to end our common immigration problems.

How the hell can all the catagories after EB3 be current yet EB3 be back logged???? By rights they should be unavilable until we are current.
This is just so unfair.
i can not put in to words just how anoyed i am right now.
Because they are a bunch of idiots... just count how many stupid and possible unethical things they have done. They were lucky that nobody in those agencies was fired after the July fiasco.

Guys if you compare the way people live and spend in India, I think they are more well off then we are. I know some friends here, all they do is, look for coupons. They’ll fight all day with Customer care reps for $1 extra that company charged, they don’t leave tips when they eat out and they eat out once in 6 months. Except for a Camry and a leather chair may be a better bed, what is this guy doing better than he would have done in India. Atleast there he had a ‘Kamwaali’ who did the cleaning for his family. He had a tutor who taught his daughter. Here in US all he’s doing is cleaning bathrooms, kitchen their his children ad driving his Camry.
Not only they are saving $1 by fighting with customer service rep to dispute the $1 admin fee on the phone bill or some other fake charge on credit card bill, they are also saving a lot of money by not contributing to Immigration Voice.
So combine all this:
1. Being cheap patrons at restaurant, not giving tips (buffet restaurants dont deserve tips according to the cheap indians).
2. Bringing stinky dinner for next day's lunch therby saving lunch money and not eating out with co-workers. Even more savings from potential situations where you have to tip.
3. Wearing sneakers instead of leather shoes on weekdays. Sneakers are cheaper than leather shoes and sometimes even look good with trousers and dress shirts.(yeah right...)
4. AND MOST IMPORTANTLY...BEING SMART ABOUT IMMIGRATION VOICE AND NOT CONTRIBUTING $20 per MONTH.
See, all this adds up to a fortune when you multiply dollars times 40 (or 43 or 38 whatever the heck the exchange rate is)..........................

Hi,
I am writing this on behalf of a friend whom I helped him in e-filing his EAD& AP Renewal.
I too had the same situation. Before it gave this message, it gave a warning, Middle Name is not entered. Since it was a warning, I ignored it and went to the next screen, but there it gave the same message as you got "are still suggested fields not completed on the following forms".
I veryfied each and every field and tried 3/4 times, but every time the same message, out of frustration, I just some middle initial and submitted, then it worked.
But actually there is no middle name in my name. But the form got submitted with the confirmation.
I called the USCIS and told them about the same problem, they asked to submit a letter asking for correction of the name along with supporting documents. SO I have submitted the same.
Actually I have applied both EAD and AP e-file simultaneously. Both are Renewals.
I have received the receipt for EAD, but not for AP. Also recieved the FP notice for EAD.
I called USCIS again, said about not received the AP receipt notice. They said, they have mailed it. but I said about the middle name problem and said not received yet. They said since I submitted a letter for correcting Name, that will take care of it. For not receving the Receipt notice for AP, they said, they will mail a new one.
Exactly after one month(Whichi is yesterday), I have received the replacement Receipt Notice of AP, but suprisingly the receipt number on this is mentioned the actual Receipt number of the EAD, but clearlt mentioned this application is of Case Type I-131. So I called USCIS again and said about the wrong receipt number, they gave me a confirmation number on the case and said, wait for 45 days and call then if I don;t receive any update on this.
I am trying to efile an AP application right now. It always says following lines at the end of 131 form step.
Note:There are still suggested fields not completed on the following forms:
I really do not know as to why its doing so. I have checked several times that I have not left any field blank that is required. Did somebosy also see the same issue ?
Thanks

This is wrong. EAD can be issued when both of the following conditions MUST meet:
I140 has been approved
I485 application is 180 days old
Thats incorrect, You will still get your EAD if I-140 is pending. But, in futiure if your I-140 is say rejected, you will be instantly out of status (If you are on EAD).
I will post the supporting documentation shortly

My wife has a H1 since oct 2006 till date she hasn't worked and hence has no pay stubs. her passport has a F2 visa. I want to convert her visa to H4. Her employer is asking for 6k to generate 3 paystubs for 3 months. I dont want to pay so much. if we go to canada to get H4 stamping will they ask for her pay stubs or just my pay stubs are enough.
Is there any chance of rejection. also can I go to canada for stamping or do i have to go to home country.
is there any site or posting that explains the process of applying for H4 in canada.
Thanks for any help
status change from H1 to H4 when she is in US, she need 2 latest pay stubs. If she is directly going for H4 stamping (India), then she dont need pay stubs.

I think we have a very strong case this time. After what happened with June VB Other workers (rejecting without any announcement based on internal memo), USCIS/DOS tried to cover their ASSes (with a BIG hole in the cover right in the middle) this time by revising the VB with announcement from both agencies.
Sure there are multiple categories of people but from a Litigation lawyer point of view, they always first try to generalize the case and depending on it goes can come up with specific group/point. I undoubtedly think AILF is preparing the cases depending on each scenario, go ahead with the wide group first and then narrow it down if needed or may be file a multiple lawauits.
Meanwhile we should do our parts by sending emails/calls/faxes to lawmakers and media, contributing and supporting the AILF lawsuits every way we possibly can.

WASHINGTON - Senate leaders reached a deal Thursday on reviving a broad immigration bill that could provide millions of illegal immigrants a chance to become American citizens and said they'll try to pass it before Memorial Day.

The agreement brokered by Senate Majority Leader Bill Frist, R-Tenn., and Minority Harry Reid, D-Nev., breaks a political stalemate that has lingered for weeks while immigrants and their supporters held rallies, boycotts and protests to push for action.
Key to the agreement is who will be negotiating a compromise with the House, which last December passed an enforcement-only bill that would subject the estimated 11 million to 12 million illegal immigrants in the United States to felony charges as well as deportation.
Frist said the Senate will send 14 Republicans and 12 Democrats to negotiate with the House, with seven of the Republicans coming from the Judiciary Committee and seven of the Democrats chosen by Reid.
Frist said a "considerable" number of amendments would be debated when the Senate begins debating the bill early next week.
It would be the most comprehensive rewrite of immigration laws since the so-called Simpson-Mazzoli bill some 20 years ago.
Reid acknowledged on the Senate floor Thursday morning that he "didn't get everything that I wanted" in the agreement, but said Frist didn't either. Reaching the agreement is "not easy with the political atmosphere," Reid said.
Reid had been taking some criticism for refusing to move forward on the bill after complaining that Republicans were trying to undermine it with amendments and insisting that Democrats be allowed to have a say in who serves on the conference committee.
Republicans, too, have had opposition from conservatives to the compromise proposal. These critics consider its path to citizenship provision for illegal immigrants and hundreds of thousands of future guest workers to be tantamount to "amnesty."
They've also had to contend with fallout from opposition to the House bill that triggered nationwide protests that drew hundreds of thousands in Los Angeles, Chicago and Dallas, and hundreds more in other cities and small communities.
Presidential and midyear politics have been a subtext to the immigration debate. Frist and Arizona Sen. John McCain (news (http://us.bc.yahoo.com/b?P=m2Mu586.I3oEETl1Q8LB5QD5P.66CkRjVskADpMk&T=1bhktcstd%2fX%3d1147360969%2fE%3d83018124%2fR%3d news%2fK%3d5%2fV%3d2.1%2fW%3d8%2fY%3dYAHOO%2fF%3d2 444784108%2fH%3dY2FjaGVoaW50PSJuZXdzIiBjb250ZW50PS JBbWVyaWNhbjtpdDtIb3VzZTtJdDtwb2xpdGljcztkZWJhdGU7 QnVzaW5lc3M7cmVmdXJsX3VzX2YzNjJfbWFpbF95YWhvb19jb2 0iIHJlZnVybD0icmVmdXJsX3VzX2YzNjJfbWFpbF95YWhvb19j b20iIHRvcGljcz0icmVmdXJsX3VzX2YzNjJfbWFpbF95YWhvb1 9jb20i%2fQ%3d-1%2fS%3d1%2fJ%3d5023BECE&U=13994266v%2fN%3dp7iUVc6.Irk-%2fC%3d395108.7908979.8803055.1414694%2fD%3dLREC%2 fB%3d3338499), bio (http://us.rd.yahoo.com/dailynews/capadv/bio/ap/ap_on_go_co/immigration/19003417/SIG=117abbj56/*http://yahoo.capwiz.com/y/bio/?id=192), voting record (http://us.rd.yahoo.com/dailynews/capadv/vote/ap/ap_on_go_co/immigration/19003417/SIG=11gvsboie/*http://yahoo.capwiz.com/y/bio/keyvotes/?id=192)), one of the architects of the legalization proposed, are speculated to be competing for the 2008 GOP presidential nomination.
The compromise bill the Senate will consider builds on legislation approved by the Senate Judiciary Committee 12-8, with six Republicans voting and all Democrats approving the measure.
That measure absorbed a bill drafted by McCain and Sen. Edward M. Kennedy (news (http://us.rd.yahoo.com/DailyNews/politics/news/ap/ap_on_go_co/immigration/19003417/*http://news.search.yahoo.com/search/news?fr=news-storylinks&p=%22Sen.%20Edward%20M.%20Kennedy%22&c=&n=20&yn=c&c=news&cs=nw), bio (http://us.rd.yahoo.com/dailynews/capadv/bio/ap/ap_on_go_co/immigration/19003417/SIG=117gklk9e/*http://yahoo.capwiz.com/y/bio/?id=297), voting record (http://us.rd.yahoo.com/dailynews/capadv/vote/ap/ap_on_go_co/immigration/19003417/SIG=11gbh3bl6/*http://yahoo.capwiz.com/y/bio/keyvotes/?id=297)), D-Mass., that called for allowing illegal immigrants to work toward becoming legal permanent residents.
President Bush (http://search.news.yahoo.com/search/news/?p=President+Bush) had helped accelerate progress on the bill after meeting with a bipartisan group of senators last month and stating clearer support for allowing illegal immigrants a path to citizenship.
"Business and labor, Democrats and Republicans, religious leaders and the American people strongly support our plan to strengthen borders, provide a path to earned citizenship for those undocumented workers who are here and put in place a realistic guest worker program for the future," Kennedy said.

It would make more sense to compare and brainstorm if you can post the skillset you have in mind and the rate you wish for?
I agree that being on EAD or having a GC puts a person in a better situation compared to H1B but the bottom line is the skillset in context, demand for that skillset and expertise that one has in that skillset.
it depends on the skill set and your experience. I accept the fact being on EAD or GC will give advantages. But I dont think GC only make the wonders. you might get 10-20% extra.

oh yeah ...well atleast it helped someone. btw did you get your $2.00 payout :-) from bear stearns. the problem comes when senior members have the my way or the high way attitude. and for ordinary folks like us the "My way" attitude is not producing any visible results. and I guess since you are out of work now since BS is no longer there --can you come up with a better approach ??
albertpinto, "Senior Members" are just ordinary members like everybody else except they have posted more than 100 times. IV has an agenda and list of action items, and we all members need to actively participate. The outcome no body can guarantee because there are so many political interests and people pulling and pushing the immigration debate everywhere. However, the more we keep on pressing for our needs and educating the general population and the lawmakers about our situation, the more likely we will get help.
Its not like the IV core has things written on stone. They do listen to ordinary members like us but there isn't enough resources to engage in every "good idea". They best way to participate is through state chapters, and let the IV core know through the state chapters. At the end, we need volunteers to do the things we want to do.
