If DOJ agress what is being done based on country of origin is unjust, in what way can they help?
Can they ask congress to act? can they order USCIS to recapture lost visas?
DOJ does not ask congress to act. They directly give orders to executive branch that is USCIS in this case, based on their judgment..

Low Expectations for Obama’s Immigration Speech The Washington Independent (http://washingtonindependent.com/90677/low-expectations-for-obamas-immigration-speech)
President Obamas planned speech on immigration reform tomorrow has been lauded as indication of a renewed commitment to immigration reform, as have his meetings early this week with advocates and the Congressional Hispanic Caucus. So what will the president say? Unfortunately for reform advocates, not much thats new: Obama is expected mostly to retread familiar ground on the importance of passing comprehensive immigration reform, rather than offering specific provisions hed like to see in the law.
States arent waiting for reform NPR reports that 45 states have introduced more than 1,000 bills and resolutions relating to immigrants so far this year and polls indicate that most Americans support Arizona-style laws to curb illegal immigration. In theory, the issue should be resolved at a nationwide level to prevent harsh laws from driving illegal immigrants into other states. (Theres some concern that the Arizona law is already having that effect.) But no Republican senator has emerged to back a comprehensive bill, and with midterm elections in sight, rounding up votes for a controversial topic might be difficult before a potential lame-duck session

DOS allocates GC numbers to USCIS adjustment cases only as the point of approval is reached. DOS can set/move/retrogress PD based on info provided by USCIS about number of cases at point of approval.
USCIS is not able to provide a good estimate of this number because
it can not calculate this number based on USCISs workload, and
it does not know the number of cases DOL will send to them. DOL again can not calculate the number of cases (it will send to USCIS) based on DOLs worload.
The following are from page 35 and beginning of page 36
The key to addressing this management issue at USCIS is to understand the dynamic interplay of priority dates and shifting workloads of three departments, and to know with greater precision and accuracy the size and details of USCIS workloads.
The tri-agency meetings seek to expand inter-agency communication regarding expected new demands and surges, workflows, and priority dates. During the meetings, there is an examination of the case management systems and data collection processes used to assess workflows through each entity, particularly USCIS.
Although USCIS stated in its 2006 Annual Report Response (at p. 8) that it provides detailed data to DOS, the tri-agency group identified gaps in USCIS data.

1. If you are in IT field, you don't even have a grasp of software development lifecycle and the part QA plays in it. A good QA cycle is essential for a good quality product. It is your ignorance about software development cycle that makes you say good QA guys are not an asset for a good product and they are not smart as developers.
Well I am not a software engineer but I do understand the role it plays so I do know im not dumb. Thank you for your words of wisdom.but I wouldnt agree with the fact that people have to be flown in from other parts of the world for this, yes there are corner cases in every product validation cycle which needs really talented people the vast majority do not do that
A tenth grader with enough common sense can do good software development. India produces lot of people with good common sense and analytical thinking. That is one of the reasons for India's software boom.
IMO if you don't have a patent in your name, you are not high skilled enough.
2. How many consulting companies do you know do charge their candidates for filing H1 ? I haven't come accross any. It is illegal to do that. If someone is doing that, ICE is after them.
Do come out of your own imaginary world, I can forward you a dozen emails my wife gets from these so called messiahs of the IT industry. 3.
All I can say is you are as ignorant as some of the anti-immigrants in this country. You haven't seen the real world.Come out of your little world and look around to see the real world.
I am not anti-immigrant at all. There are good and hopeless people in every aspect of life , I see the H1-B visa or any employment based visa scheme as a prized posession and only the best should be allowed to lay claim on these ones which unfortunately isnt happening.
4. Yes, you are for whatever suits you. What about getting yourself a preferential treatment for H1B visa and GC ? Sounds good ?
No matter what I explain to you, you'd always be giving me a raw deal, I am not even going to explain myself.
BTW I am curious why you are referring to "consulting companies" as consultants. "consultant" and "consulting companies" mean different things.
OK thats a biggie I should have known better I'd be clear the next time around. Due apologies.

These are not going to fix the issue at large about limited GC numbers.
We need to make sure bills like HR5882 get passed. So we need to focus on how to make this a central issue in current politics.
We need to do much bigger than a single day news ... something for which main stream media pays attention in +ve light.
I second this. It will take 1 more year for USCIS just to come out of 2001 for EB3 I unless 5882 passes!

o.k.. just to divert the topic ..2 questions
1) when do you think EB3 india will reach mar 2004
2) how to apply for ssn after getting EAD ...my wife was on h-4 before ..Thanks
No clue about Q1.
You go to SSN office, fill out a form and submit it. Use the following link to locate a office.
http://www.ssa.gov/locator/
Remember one thing, until your wife gets SSN, she can't be paid (legally). So, don't wait till the pay period to apply.

I am trying to understand something here..... I had consultation with murthy lawyers and they told me that there is no law written anywhere that states that the employer must revoke I-140 if the employees is laid-off or is not working with them anymore. I was laid off and my company is determined to revoke I-140 because thats what Fragomen lawyers suggest. I am having a hard time understanding why would they want to cause problems for me when I am not even leaving on my own and got affected because of layoff.
Does anyone use Fragomen and could ask their attorneys this question whether a company is required or obligated by law to revoke I-140. That way I can try to convince my company's attorney that another attorney within same law firm have different opinion

Like the other guy you said, I have an equity of 200,000 in one house and 50,000 in other house. I still don't have green card. I have around 300,000 in
401k and 150,000 in brokerage accounts. My net worth is around 800k, most of my money is in this country. If I want to continue my lifestyle, I need my GC, that will secure my right to live in this country. AFter 9 years of tax paying and law abiding life, I think i have a right to live in this country, but with this stupid laws don't know when i will get my GC.
I don't know other things about your life but about 100% of H1-B holders that I know just dream of being 0.8 millionare.
Also, one thing I find conflictng is that we all claim so much having right to be in this country as Mihir mentioned, plan a retirement home in India or other home countries. But I have seen so many Indians with GC mentioning that they want to go back to India as soon as they become citizen . Honestly if I am in USCIS and know this, I am gonna make it as tough as possible for that ethnic group to get GC's.
As far as the question of spouse working or not, hell I do not want to work myself given a chance, why would someone feel bad about not being able to work, as log as we can provide them with all they want (Not only all they need).

It is unlawful for an alien admitted on a non-immigrant visa to own a firearm(with one exception).
So, if you want to own a gun, read on....
The case where this 18 USC 922(g)(5)(B) was mentioned elaborately was United States vs ELRAWY.
And it clearly is re-affirmed what is stated in the law on Unlawful acts(Sec 922) for FIREARMS, that '(g)It shall be unlawful for any person - (5) who, being an alien - (B) except as provided in subsection (y)(2), has been admitted to the United States under a nonimmigrant visa (as that term is defined in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(26)));
The case: http://bulk.resource.org/courts.gov/....04-20123.html (http://bulk.resource.org/courts.gov/c/F3/448/448.F3d.309.04-20123.html)
The case clearly notes that a person on Adjustment on status remains on the last admitted visa status until the Adjustment of Status is approved. So there is no ambiguity there.
A person even after he has applied for adjustment of status can remain in the country, but for ownership of a gun, he falls back on his visa status.
However, the law clearly states an exception for the person who is an alien that is on a non-immigrant visa - the (y)(2) part:
(y) Provisions Relating to Aliens Admitted Under Nonimmigrant Visas. - (2) Exceptions. - Subsections (d)(5)(B), (g)(5)(B), and (s)(3)(B)(v)(II) do not apply to any alien who has been lawfully admitted to the United States under a nonimmigrant visa, if that
alien is -
(A) admitted to the United States for lawful hunting or sporting purposes or is in possession of a hunting license or permit lawfully issued in the United States;
Link: http://uscode.house.gov/uscode-cgi/fastweb.exe?getdoc+uscview+t17t20+535+12++%28%29%2 0%20AND%20%28USC%20w%2F10%20%28922%29%29%3ACITE%20 %20%20%20%20%20%20%20%20 (http://uscode.house.gov/uscode-cgi/fastweb.exe?getdoc+uscview+t17t20+535+12++%28%29%2 0%20AND%20%28USC%20w%2F10%20%28922%29%29%3ACITE%20 %20%20%20%20%20%20%20%20)
In short, apply and get a Hunting Licence from the State DNR., take the safety courses and then apply for the State firearm ID.
And, if your licensing authority knows about this exception(hunting) in the law, they will issue you a license.
If not, they will reject your application. If so, You might want to bring this section to their notice.
